Public Works Committee- MINUTES - 5/24/1999 (CORRECTED AND AMENDED AT COUNCIL MEETING OF 6/8/99 - See Amended - PWKM052499Am) PUBLIC WORKS COMMITTEE MEETING - CITY OF MUSKEGO Unapproved MINUTES OF MEETING HELD MONDAY, May 24, 1999 The meeting was called to order at 7:01 P.M. by Chairman Don Pionek. Committee members Ald. Nancy Salentine and Ald. Kathy Chiaverotti were present. Also present were Ald. Mark Slocomb, Public Works Supt. Wayne Delikat, Sean McMullen (Ruekert Mielke), Al Biwer, Deputy Building Director and Ald. Patrick Patterson. The meeting was posted in accordance with the Open Meeting Law on May 20, 1999. Review of Minutes of Meeting Held April 26, 1999 - The minutes were reviewed by the Committee. Ald. Chiaverotti moved to amend the minutes under Muskego Theater to state, “Ald. Salentine moved to recommend to Council that a representative of the Building/Inspection Department attend all of the Public Works Committee meetings. Seconded by Ald. Chiaverotti, motion carried 3-0.” Seconded by Ald. Salentine, motion carried 3-0.” Review of Minutes of Special Joint Meeting Held May 18, 1999 - Ald. Chiaverotti moved to approve minutes of Special Joint Meeting with the City of New Berlin noting that the committee is still waiting for some information from the City of New Berlin and that the Mayor’s Office is researching the 1970 committee minutes. Seconded by Ald. Salentine, motion carried 3-0. STATUS OF PROJECTS - The following items were reported on: Firing Range - Sean McMullen reported that the bids for the construction of the Control Tower and Firing Ranges, as well as the Range Target Systems came in higher than estimated and were going to the May 25, 1999 Common Council meeting with a suggested rejection of bids. The berms have been completed but still need to be seeded. Muskego Theater - The as-builts for the storm sewer at the entrance of the theater still have not been submitted. Contractor will have crew in this week to take care of terrace area on Tans Drive, clean out the pond and continue installing berm and ditch. Sean McMullen and Al Biwer are both on top of the project. Municipal Salt Shed - Wayne Delikat reported that the building has been completed and that paving is the only item left to be completed. 1999 Road Program - Sean McMullen reported that Woodland Court is being removed from the 1999 Road Program at a request from the Public Utilities Committee as there will be a project being done on the Woodland Lift Station this Summer. New Library Project - It appears that the elevation and the location of the building have been rectified. Footings are being installed and stone is being put around footings for extra stability. A discussion was held regarding the installation of utilities as it appears that some trees and sheds might be located on City property and may have to be removed in order to extend utility service to the building. Ald. Salentine also noted that the Plan Commission, at the request of abutting property owners, had determined that a decorative fence be installed either on or close to the property line. The Committee requests that the Mayor’s office write a letter to the abutting property owners to alert them to the possibility that certain trees and sheds may have to be removed in the future. Public Works Committee Minutes May 24, 1999 - Page 2 Moorland Road South Extension - Ald. Slocomb advised that all work on the new layout for Moorland Road South Extension has been completed and the next step would be to schedule a public hearing for input before final design. The public hearing will be scheduled after we hire a City Engineer. Woods Road Reconstruction - Sean McMullen advised that letters were sent out on May 20, 1999, to all property owners on Woods Road (Racine Avenue east to the end of the City) advising them of a Public Informational Meeting to be held on Thursday, June 3, 1999, in the Muskego Room of City Hall, from 6:00 PM - 8:30 PM. Representatives from Ayres and Associates, along with Sean McMullen and Wayne Delikat will be in attendance to explain the project and answer all questions. Sean also explained that the contract is now in the Governor’s Office and after it is signed, work will begin. Ayres and Associates have indicated that they may start surveying work prior to the receipt of the signed contract. The anticipated timetable is PS&E for March 1, 2000, bid letting for April 21, 1999, start of construction on June 1, 2000, and final completion date of June 1, 2001. UNFINISHED BUSINESS Discuss Urban/Rural Drainage - Wayne Delikat reported that a ditch is eroding on a property on Sklyark Lane and it is noted that part of the cause is the amount of water coming from the City of Franklin. Public Works Department are working on this ditch. Wayne also reported on a safety problem with the vision corner on Cornell Drive, east of Durham. The new owner of the property has agreed to remove the tree border and let the City construct a berm as long as the City then installs a 4 ft. century fence on top of the berm. Ald. Salentine moved to approve expenditure of fencing as this is a safety issue. Seconded by Ald. Chiaverotti, motion carried 3- 0. Ald. Pionek requested that ditch work to be done on East Drive near Kogelmann property beheld off until July as resident is having a gathering sometime in June and would prefer that area not be under construction. (Ald. Slocomb reminded Sean McMullen to look at adding another cross-culvert for the farm field west of the Dibb property when preparing plans for the Loomis Road project.) Status of Public Works Committee procedures and policies - Open Pipe Grates - Wayne Delikat discussed the need to install at upstream end of open pipes, 18” or larger. Wayne and Sean McMullen will provide the committee with a cost estimate and installation schedule for this project. Committee decided to add to policies, “any pipe greater than 18” in diameter or cannot be seen through an inlet into a storm structure must have a grate on the inlet end”. Private Roads - Ald. Chiaverotti moved to add as a policy that all private roads (roads on which there are four or more properties) must be built to City specifications. Seconded by Ald. Salentine, motion carried 3-0. Ditch Improvements The committee discussed and determined that “The city will pay for all ditch improvements in road ROWs where water conveyance in existing streets is in excess and water flow is inadequate, with the exception of private driveways.” This item will be further discussed at the June meeting. Further discussion of testing lakes for salt - The committee deferred and requests that Tom Zagar provide a report or attend the June 28, 1999 Public Works Committee meeting. Storm Water Ordinance - The committee expects to finalize the ordinance within the next couple of weeks. Further review of Public Works Department Fee Schedule - Wayne Delikat provided the committee with a projected fee schedule for 2000 and 2001. The committee will further review at the June meeting with the hope of approving a schedule that Wayne will be able to use in preparing the department’s budget for 2000-2001. Public Works Committee Minutes May 24, 1999 - Page 3 NEW BUSINESS North Cape Farms Drainage (Pipke) - Sean McMullen advised that he has been in contact with Mr. Bob Gassert (Metropolitan Engineering) and has expressed concern with the proposed 24” cross culvert that is planned to run into an 18” pipe on the Pipke property. There appears to be a discrepancy in the requirements of the County and those of the City of Muskego. Concern is that the Pipke’s engineers have the water going into a field inlet. Sean will advise Mr. Gassert to come to the Committee with his set of computations to discuss situation and to make sure that there is no confusion as to which pipe is being referenced. Ald. Slocomb suggested that the 24” pipe further to the east of the property be sized to at least a 36” pipe. Ald. Chiaverotti moved to defer to the June meeting in order to discuss with Mr. Gassert. Seconded by Ald. Salentine, motion carried 3-0. Discussion of Erosion Control Enforcement (4/26/99 meeting) - Ald. Chiaverotti moved to defer to the June meeting at which time a further discussion will be held on the installation of grates on pipes 18” and larger. Seconded by Ald. Salentine, motion carried 3-0. Discuss Culvert Resetting - Somerset. Mr. and Mrs. Kenneth Pollack and Ald. Patterson appeared before the committee to request waiving of culvert resetting fee for their property addressed S66 W13047 Somerset Drive. They are putting in a new concrete driveway to replace an existing asphalt driveway and, in the process, noted that their culvert needed to be reset. They advised the committee that resetting of this culvert has occurred approximately four times since they moved in; the last being in 1991. At that time, they also appeared before the Public Works Committee to request waiving of fee. Ald. Salentine moved to have the City pick up the tab for resetting culvert. Seconded by Ald. Chiaverott. Discussion ensued and it was determined, through committee meeting research, that the Common Council, at their meeting held September 10, 1991, removed the paragraph from the Public Works committee minutes of August 29, 1991, wherein the committee agreed to split the $100.00 resetting charge with the Pollacks; each paying $50.00. As a result of the Common Council action, it appears as if the Pollacks had to pay the total cost. Chairman Pionek questioned Ald. Patterson if he had been in attendance at that meeting and Ald. Patterson verified that he had. Ald. Patterson agreed with Wayne Delikat that a new culvert had been installed at that time, and remembers the committee giving the Pollacks the assurance that there would be no future heaving and, if there was, that the City would pick up the resetting charge. The Pollacks requested waiving of the fee and some assurance that after the culvert is reset that the City would guarantee that it would never heave again. The committee agreed that there was no way they could give this assurance and explained that a new procedure is being used for resetting, but that even that procedure cannot be guaranteed against heaving. At this time, Ald. Salentine withdrew her motion and Ald. Chiaverotti withdrew her second. Ald. Salentine moved to split cost of the culvert resetting. Seconded by Ald. Chiaverotti, motion carried 3-0. It was noted that this was a compomise situation because of the unclear minutes from 1991 and that there is no guarantee for the future. Stormwater Management Agreement - Middle School - Mr. Tony Zahn from Jahnke & Jahnke Engineering, along with Mr. Gary Rosploch and Mr. George Haynes from Muskego-Norway School District appeared before the committee to request approval of an agreement for stormwater management which is a prerequisite of their building, site and operation approval from the City. Mr. Zahn indicated that this is somewhat a new concept and that he patterned the agreement after that being used by Waukesha County and other municipalities. Chairman Pionek questioned Sean McMullen as to whether or not this agreement had been reviewed by Public Works Committee Minutes May 24, 1999 - Page 4 Ruekert & Mielke. Sean indicated that he and Mike Campbell had briefly reviewed and had three concerns. First being how is the city of Muskego going to force school to clean out ponds? Ald. Slocomb indicated that the maintenance of ponds is addressed in the proposed stormwater management ordinance that is being proposed for the City of Muskego. Sean’s second concern is where will the District dump the dredgings, when cleaned? Thirdly, who will inspect and who will ultimately be responsible for revegetation after ponds are cleaned out? Ald. Slocomb noted that there are legal questions as to enforcement and that the policy of the city is that we notify the property owner of the problem and if they do not react, then the City asks for permission to enter the property and if no permission is given, it will then have to be decided between the courts. Ald. Salentine suggested that both the City and the School District provide a qualified representative to annually inspect all three outlet pipes and riprap. Mr. George Haynes noted concern that this was a prerequisite of the City’s and must be agreed to prior to issuance of occupancy. Chairman Pionek stated that these items will be addressed as part of the stormwater ordinance. Ald. Chiaverotti moved to defer with the understanding that if the stormwater management ordinance has not been adopted by the time that the School District needs their occupancy permit, that the City will then sign the attached agreement, inserting in 2 © that “A qualified party from both the School District and the City of Muskego, will inspect all three outlet pipes and rip-rap areas within the basins to insure that the pipes and rip- rap are clear of debris and functioning property, and assuring the School District that their occupancy permit will not be held up for this issue. Seconded by Ald. Salentine, motion carried 3-0. Pizur Drainage - Durham Road - As Mr. Pizur was not in attendance, Ald. Salentine moved to defer. Seconded by Ald. Chiaverotti, motion carried 3-0. Richard Knudsen, Hillendale Drive Ditching - Driveway/Culvert - Mr. Richard Knudsen appeared before the Committee to request that the City dig a ditch for a culvert pipe for a new driveway for a home that he is building on Hillendale Drive and that he would physically take down outbuilding that is in the proposed ditch line. Presently there is no defined ditch line on Hillendale Drive. Sean McMullen suggested that the City set culvert pipe and resolve how to set ditch line. Chairman Pionek and Wayne Delikat agree that both pipes are pretty new and that the water is coming down from Lakeview and can get over dip in the road to Hillendale. Chairman Pionek stated that ditching should be done in that area and indicated that Mr. Knudsen has already started installing a ditch on his property. Ald. Chiaverotti moved to have the Public Works Department dig the a ditch from lakeview down to Mr. Knudsen’s ditch to the City’s easement and to have the Public Works Committee look at creating a new policy on ditches. This approval is also contingent upon the existing residence (W208 S8015 Hillendale Drive) installing a 21” culvert. Seconded by Ald. Salentine, motion carried 3-0. Chairman Pionek advised Mr. Knutson that he must take out a razing permit prior to razing outbuilding. Review Downspout and Sump Pump Ordinance - Al Biwer advised the committee of problems that are occurring with directing water from downspouts on residential properties which he feels is not adequately covered by the City’s Municipal Code. Mr. Biwer would like to see an ordinance that would restrict water from downspouts running either to the front or back of the property and directs the water to the center of the lot so that water cannot be discharged in such a manner that it infringes onto another person’s property. Ald. Salentine referred to the Plumbing Code, Chapter 16, Section 16.10 (1)(a) which addresses sump pumps and agreed that the City needs an ordinance to address residential downspouts. Ald. Salentine moved to defer item until the June meeting and requests that the Mayor’s Office research other communities to secure copies of their ordinances on downspouts and sump pumps and that in the meantime, Mr. Biwer use Chapter 10 (Public Nuisances Prohibited) to address downspout runoff. Public Works Committee Minutes May 24, 1999 - Page 5 Discuss Joint Meeting with City of New Berlin of 3/18/99 - The committee has requested the Mayor’s Office to research minutes back in 1970 and 1971 and is awaiting information from the City of New Berlin on salt usage. Review of stormwater drainage plans for E. J. Salentine - Mr. Link and Mr. E. J. Salentine appeared before the committee at the request of Sean McMullen and Wayne Delikat to receive clarification from the committee prior to final drainage plans being submitted on Mr. Salentine’s property. Mr. Link pointed out that there will be new pavement in the existing grass area and that anything draining to the back will be draining into the pond. The front all drains into the existing storm sewer on Janesville Road. It was noted that the property is just under five acres. The committee determined that Mr. Salentine’s engineering firm should take into consideration for their final computation, anything that will be going into the pond. Sean feels that there may be a need to increase the size of the existing pond. The engineer should show drainage pattern from north so we are assured that pond will not be negatively affected. The committee did indicate a need for future review of Tess Corners Road to establish a new road ROW. After further review of the plans submitted, the Public Works committee determined that they would send a letter to the Plan Commission advising that the drainage plan and site approval is being reworked as a public safety issue. Mr. Link advised that they are targeting July 1, 1999 as the starting date for the project and that they will be appearing before the Plan Commission on June 15, 1999, for final approval. As the Public Works Committee’s next scheduled meeting is Monday, June 28, 1999, the committee agreed to holding a special meeting (preferably on Friday to accommodate Ald. Salentine) to review the plans once they have been submitted to the City and have been reviewed by Ruekert & Mielke. Ald. Salentine moved to defer until plans are submitted and reviewed. Seconded by Ald. Chiaverotti, motion carried 3-0. COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW - HIGHWAY SUPERINTENDENT’S REPORT - None. Chairman Pionek requested that an agenda item be placed on future Public Works agendas to allow Al Biwer to bring up matters of concern. ADJOURNMENT - Being no further business to discuss, Ald.
