PUBLIC WORKS COMMITTEE MEETING - CITY OF MUSKEGO Approved
MINUTES OF MEETING HELD MONDAY, February 22, 1999
The meeting was called to order at 7:04 P.M. by Chairman Don Pionek. Committee members
Ald. Kathy Chiaverotti (7:05) and Ald. Nancy Salentine were present. Also present were Ald.
Mark Slocomb, Public Works Supt. Wayne Delikat, Christopher Zoppa, City Engineer/Building
Inspection Director, Mayor David De Angelis and those per the attached list.
The Recording Secretary noted that the meeting was posted in accordance with the Open
Meeting Law on February 16, 1999.
STATUS OF PROJECTS - The following items were reported on:
Police Firing Range - Waiting for more favorable weather.
Muskego Theater - The pipe and catch basin design that was requested by this Committee at last
month’s meeting has not been submitted. Chris Zoppa has performed a site visit and indicated
that the pipe and catch basin have been installed. The Committee requests that the design
drawing still be submitted to become part of the parcel’s permanent record. Ald. Chiaverotti
questioned if the silt fence on the property had been re-installed? Chris Zoppa will discuss with
Tom Chiconas to determine if this has been done to his satisfaction. The Committee discussed
methods to ensure that property owners for commercial developments maintain the silt fence,
including a possible fine or an additional amount of money required up-front for the Developers
Deposit. Any repairs or installations that are not done within a prescribed period of time, as set
by the City, would result in a contractor performing the task as well as the developer being
charged for administration of the repair by the City.
Muskego/Norway Middle School - Waukesha County responded on 2/8/99 regarding the
necessity for signals on Racine Avenue. Per the County, no signals are warranted at this time.
Woods Road Reconstruction - Chris Zoppa provided a comprehensive status report on the
upcoming project. Chris has manipulated the proposed road sections into different configurations
(Urban, Rural or a combination of Urban/Rural) and the cost projections associated with each
model. The water main design on Bay Lane/Kurtze Lane have already been approved by the
Utility Committee. The road improvement from Racine Avenue to Durham Drive will use the
million dollar grant almost in its entirety. Chris reports that ample Right-of-Way exists to
accomplish this project. Formal plans will be provided to the Committee in March. The project will
be going out for bid to some of the State approved consulting firms. In this area, there are 10
firms (all 10 will not be asked to participate). A minimum of 3 firms are required by the State.
This Committee will review the qualifications of the firms who submit bids.
New Library Project - Too wet to do anything at this time.
Moorland Road-South Extension - Chris provided detailed computer generated drawings. The
treatment for the corridor south of Woods Road to McShane will have a cul de sac at both ends of
Durham Drive. Proposed subdivisions (20,000 square acre lot sizes), intersection treatments and
R-O-W adjustments were shown to provide as much detail to the Committee as possible. Chris
estimates that the cost to move the road will cost approximately $200 per foot. The Mayor stated
that the 8 homes along Durham Drive could cost the City less to acquire outright rather than
physically move the road, based on the actual cost of the homes vs. the cost per foot to move the
road. The Mayor is not advocating this action but is just looking at the economics of the situation.

Chris also reported that Towne Reality is interested in developing a parcel and Chris has shared
this preliminary plan with them.
Municipal Salt Shed - Bore samples are being taken. Waiting for contracts to be returned for
signatures.
UNFINISHED BUSINESS
Discuss Urban/Rural Drainage - Wayne reports that on Richdorf Drive on 2/11/99 a grate was
blocked with debris as well as Freedom ponds. Wayne would like to install angled grates so that
the debris will not stick to the grate and potentially flood individuals in the area. Additionally, Mr.
Pizur Who lives off of Durham Drive has a neighbor who has filled in his yard and is now
experiencing flooding in his yard. Essentially, this individual has created a “wetland” with the
additional dirt. Options were discussed to divert the flow of water away from Mr. Pizur’s property.
Chris and Wayne will shoot grades to determine a viable solution.
Status of Public Works Committee procedures and policies - At last month’s meeting the
Committee approved the policies including “All subdivision grading plans to be field verified by the
Developer and be within 3/10th of a foot of plan at lot corners, and at side lot lines at setback plus
20 feet.. Ald. Pionek questioned if the variance allowed could potentially cause problems with a
parcel that was flat in configuration. Chris stated that it could be a problem, but with careful
review of plans and the water drainage, it should not be much of a concern. The Committee will
review other policy manuals currently in use to update the language and make the policy and
ordinance stipulations agree with each other. At this time, discrepancies exist between the two.
Further discussion on City Engineer’s recommendation for mountable curb design - Several
consulting firms provided samples of curb designs for Chris. In lieu of “one size fits all” curb
design, a “preferred spec” design for curbing can be used. This will allow for a bit more flexibility
in design for a better fit and blending. 30 inches will still be the specified width.
Further discussion of testing lakes for salt - Tom Zagar (Lakes Project Coordinator) has talked
with Chris and has indicated that the DNR, Army Core of Engineers and the USGS program
(recently approved at Finance Committee) routinely perform testing on the lakes. This Committee
is concerned that the two times per year that testing occurs and the incomplete testing practice
does not give the complete picture of possible run-off of road salt. Since the City is planning on
using salt on the roads entirely in the future, the Committee would like more frequent testing at
specified locations on a consistent basis. Tom Zagar can perform these tests at those areas
specified on a monthly basis if mandated by this Committee.
Update of site grading plan - Holz-Arrowood Property - Plans were resubmitted to Chris, which he
approved. All areas that required attention were handled to his satisfaction. The Committee
questioned the area where the house is located and the amount of run-off discharging onto the
adjacent property. Chris stated that the home is a “significant” distance from the surrounding lot
lines. The home size is less than 2,000 square feet and the amount of run-off going to the
closest adjacent property handles less than 500 square feet of hard surface run-off. Ald. Pionek
is concerned about future problems the run-off may cause. Wayne stated that the surrounding
area is relatively flat and getting the water to drain has been an issue on other properties in the
area. Ald. Salentine would like to see how this home will impact the other properties in the area.
The Committee discussed the possible request of this Committee to instruct the homeowner to
dig a ditch to divert the water. Chris stated that having this home builder change the drainage for
the area to correct an existing drainage problem is not fair and is not the intent of the Ordinance.

The Committee wants to have small problems (such as this example) corrected while they are still
small. Chris explained on how the grading will work with the existing drainage and will not
adversely affect the adjacent properties to a large degree. Ald. Chiaverotti stated that this home
builder should not be responsible for the correction of a neighboring problem when they are not
adversely impacting it.
Review of proposed Cook-Kingston Drainage correction - Mr. George Tomouich and Bela Portik
were present to discuss their situation. Due to the drainage problem, a catch basin with a storm
sewer running under the driveway connecting into the existing storm sewer was suggested by
Chris. Wayne reports that Kingston is slated for roadwork this summer. Ald. Salentine asked if at
the time of the road work, could the pitch of the road be changed to better accommodate the run-
off? Wayne felt that it should not be difficult to perform that routine task. Wayne and Ald.
Salentine suggested a cross culvert under the driveway and ditching. The cost to the
homeowners would be approximately $576.00 for the installed culvert pipe. Ald. Salentine
moved to approve the installation of a ditch in from of the Cook Drive property with a culvert
pipe. Installation of a crossover pipe to the south towards the Church will also be
performed. Additionally, a culvert pipe in front of the Kingston property will be installed.
Property owners to pay for the driveway culverts. Pitch of road will be addressed at the
time of the roadwork, set to occur this summer. Seconded by Ald. Chiaverotti. Carried by
all.

NEW BUSINESS
Review open cut permit fee waived for Jones sewer connection on Boxhorn Drive - Chris stated
that it will be less expensive to do an inside drop and connect the lateral to the manhole. Due to
this change, a road cut will need to be performed at a cost to the City of $3,000. This road cut will
be performed by the City’s Utility crew. Chris requests that this fee be waived since it will be the
City “owing” itself for the service. Ald. Salentine moved to waive the $3,000 road cut fee.
Seconded by Ald. Chiaverotti. Carried by all.
Review revised drainage plans for Wiza Industries (MBA Development) - Chris had received a
revised plan. Ald. Pionek had also reviewed the plan at length. The submitted plan was not in
agreement with the original grading plan from 1972 which the Committee also reviewed.
Discussion on the water draining onto adjacent properties as well as the contour lines not being
extended in the plan. Mr. Chuck Hunt was present and stated that at past Planning Commission
meetings the elevations necessary to be used were decided upon. This was done so that “no
harming of adjacent property would occur”. Mr. Hunt states that he has photographic samples of
the damage the diverted water has caused. The Committee re-focused the group and Chairman
Pionek reminded those in attendance, that the agenda item was the drainage plans, not
discharge pipe issues. Chairman Pionek also pointed out that the submitted plan had two
structures on the plan with only one drainage plan. Each structure needs it’s own plan (they can
be on the same piece of paper), but need to have the water they each discharge and where it will
go noted on the plans. Culvert sizing may also be an issue. Wayne will check to determine if
culverts may require re-sizing. The attorney for Mr. Wiza contacted Chris by telephone and at
that time, Chris told the attorney that, in his estimation the drainage plan was correct. Ald.
Salentine moved to defer until extended contours are provided and to the southeast the
existing conditions are including as well as the method to divert the water if it is currently
shown draining onto adjacent properties. Seconded by Ald. Chiaverotti. Carried by all.

Those interested in getting the discharge pipe issue on a subsequent agenda were advised as to
the required actions needed.
Review drainage plans for Senior Village - Woods Road - Ald. Pionek again stated that this plan
was lacking contours and drainage onto adjacent properties was an issue. Chris explained how
the drainage is slated to work. Discussion on the 2-year and 100-year run-off impact of this site.
The pond on the site has been designed twice as large as is required. Ald. Slocomb questioned
the curve numbers that were provided and questioned the (pre-development and actual
development) calculation figure of 80. For this type of soil (Type “C”) a (pre-development and
actual development) curve number of 70 should have been used. Ald. Salentine moved to defer
approval until the pre-development and actual development figures are re-calculated using
the 70 curve figure. Elevations showing where the water will flow as well as connecting the
missing contours is necessary. Seconded by Ald. Chiaverotti. Carried by all.
Review of proposed Storm Water Ordinance - The Storm Water Committee is working to
complete the Ordinance. At that time, this Committee will review the document. The City
Attorney needs to review the entire document. Ald. Salentine moved to send proposed
Ordinance to the City Attorney for review. Seconded by Ald. Chiaverotti. Carried by all.
Review tree cutting policy - Ald. Pionek related a situation that occurred on his street, in his
District last week. A large tree was cut down which was located on private property. The owner
stated that they were not notified of the tree being slated for cutting and received no notification
to that effect. According to Wayne, the tree was supposed to be located in the R-O-W and was
diseased. His Department attempts to contact via mail that a tree will be cut down on the area
adjacent to a person’s property and they are also asked if they would like to retain the firewood
from the tree. Evidently, the tree was located on the individuals property and the City survey
maps were in error.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW - None
HIGHWAY SUPERINTENDENT’S REPORT - Wayne reports that the fuel tanks were moved last
week. They will find out in one week how much soil will need to be removed due to
contamination. The State has eased the regulations for removal of contaminated soil due to
budgetary shortfalls. Wayne reports that there is sufficient money in his budget to handle the soil
removal process.
ADJOURNMENT - Being no further business to discuss, Ald. Salentine moved to adjourn the
meeting at 9:58 P.M. Ald. Chiaverotti seconded, Carried by all.
