MINUTES OF MEETING HELD WEDNESDAY, MAY 14, 1997

The meeting was called to order at 7:05 p.m. by Ald. D'Acquisto.
Also present was Committee member Ald. Woodard, Mayor DeAngelis
(arrived at 7:15 p.m.), public Works Superintendent Loughney,
Mike Campbell (arrived at 8:30 p.m.) and Rich Eberhardt (Ruekert
& Mielke), Ald. Slocomb, and those per the attached list. Ald.
Pionek was absent.
The Committee noted that the meeting was posted in accordance
with the Open Meeting Law.
The Committee reviewed minutes of previous meeting.
The Mayor reported that he is waiting for one property owner's
response as to the HEC-2 Study in order to proceed,.
The Mayor advised that the Loomis Drive Road Reconstruction bid
opening is Thursday, May 14, 1997.
The Mayor advised that restoration on the Lannon Drive turn lane
should begin the week of May 19, 1997, weather permitting.
There was nothing to report on urban/rural drainage.
Rich Eberhardt uDdated the Committee on the status of Moorland
Road extension. Mayor discussed the need for traffic counts on
the surrounding streets.
The Committee discussed status of drainage concern of Mr.
Ferrito on Groveway Lane. Mayor advised that he is meeting with
the DNR regarding permit approval. Ald. Slocomb expressed his
concerns.
There was nothing to report on the Big Muskego Lake projects.
Rich Eberhardt updated the Committee on the status of the
removal and installation of fuel tank at the Municipal Garage.
Rich Eberhardt reported that tanks will be located on the south
side of building, with project to be bid in June and bid awarded
in July.
There was nothing to report on the status of Little Muskego Lake
dam. Item should be removed from future agendas.
The Mayor reported to the Committee that widening of Janesville
Road has been delayed to 2003.
The Committee discussed status of Linnie Lac Dam. Ald.
D'Acquisto updated the Committee on the recent meeting held at
New Berlin City Hall, with ownership of the dam being a critical
issue. 0

The Committee reviewed status of Holz Drive dredging project.
Rich Eberhardt explained map of area to indicate where dredging
was undertaken. Property owners are looking for reimbursement
in the amount of $1,044.00 for Phase 1 of the project as
dredging was done in front of City-owned property. Ald.
D'Acquisto expressed the problem he has with authorizing payment
after work has been completed. Mr. Gary Stewart explained the
project and how costs were allocated. Ald. D'Acquisto addressed
the issue of what benefit was being received by the City due to
this project being undertaken. The Mayor noted that the City
historically has paid a share of lake dredging projects. Ald.
D'Acquisto explained that there appears to be special
circumstances involved in this situation, and that is the reason
why the Committee will consider this request since it will be an
exception to a recently adopted policy disallowing payment for
services after the work has been performed. Ald. D'Acquisto
moved to recommend to Finance Committee payment in the amount of
$1,044.00 for Phase I as requested subject to verification of
project costs and verification that work has been completed, and
payment in an amount not to exceed $2,352.94 for Phase 2 subject
to receipt of verification of project costs and verification
that work has been completed with 10% retainage to be held until
DNR and Army Corps of Engineers has signed off the project.
Seconded by Ald. Woodard, motion carried 2-0.
The Committee discussed final payment to F. C. Price for Garage
addition. Supt. Loughney advised that final payment can be made
as soon as damaged ceiling tile are replaced. Rich Eberhardt
advised that correspondence has been forwarded to F. C. Price
stating that fact. No response has been received to date. Ald.
D'Acquisto moved to hold payment until response has been
received from F. C. Price. Seconded by Ald. Woodard, motion
carried 2-0.
There was nothing new to report on grading plan for Graves
property on Hillendale Drive.
The Committee reviewed drainage concern for Muskego Regency.
Ald. D'Acquisto read correspondence from Ald. Pionek regarding
issue. Ald. Slocomb expressed his concerns. Ald. D'Acquisto
advised that remedial steps to correct situation have been taken
under the direction of Tom Chiconas. Rich Eberhardt explained
history of problem, and stated that developer has decreased
the amount of water coming off this property. Regrading is
planned, with new plans needing approval of City.
The Committee reviewed drainage concern of Mr. Jeff Olson on Elm
Drive. Mr. Olson explained situation. Supt. Loughney stated
that Mr. Olson's home was built directly in a drainage way, and
he feels that it is Mr. Olson's responsibility to deal with
water coming onto his property. Ald. D'Acquisto moved to defer

to June meeting to allow Committee time to review video
presented by Mr. Olson, with the understanding that this issue
will be resolved at the June meeting.
motion carried 2-0.
The Committee reviewed memorandum from Mark Paulat regarding an
update on the Freedom Square ponds. Construction is anticipated
to begin June 1, 1997.
The Committee reviewed drainage concern of property owner on
Hillview Drive. Supt. Loughney advised that property owner's
garage is built below the road grade, and that measures that the
Public Works Department has taken should alleviate the drainage
problem. Ald. D'Acquisto asked that Public Works Superintendent
review area to see if any other properties in area will be
experiencing a similar drainage problem.
The Committee reviewed the following bids for a new patrol
truck, including a wing plow, front-mounted plow, and sander:

Lakeside International $ 82,974.00
Supt. Loughney indicated they have a 1967 International water
truck to dispose of. Ald. Woodard moved to accept bid from
Lakeside International in the amount of $82,974.00 with the
understanding that proceeds will be used from the sale of the
1967 International water truck. Seconded by Ald. D'Acquisto,
motion carried 2-0.
The Committee discussed Little Muskego Lake winter ice damage.
Ald. D'Acquisto read correspondence from Ald. Pionek, wherein he
advised that there are three residents in his district
reporting damage. Ald. D'Acquisto advised that past discussions
with the DNR revealed that many lakes in Waukesha County are not
drawn down every year as is Little Muskego Lake.
indicated that they are not responsible for damage. The Mayor
advised that the DNR has indicated they may issue permits for
repairs, but financial assistance is unlikely. Ald. Slocomb
expressed his concerns with the type of repairs that are being
requested. Ald. D'Acquisto will meet with Ald. Pionek to advise
the property owners as to whether they may make minor repairs on
their own, or suggest that they consult with the DNR before
proceeding. Ald. Slocomb advised that Mark Paulat has a list of
property owners who have contacted the City regarding damage.
Ald. D'Acquisto suggested that Mr. Paulat share this information
with the Committee.
The Committee discussed winter sanding, salting and plowing
wherein he suggested that residents be surveyed to see if they
DNR has

favor only main streets being sanded/salted. Supt. Loughney
responded that if constituents favor this procedure, he would
agree to it. Mayor advised that although some complaints have
been received regarding the amount of sand/salt being used on
streets, he feels for safety concerns we would want to continue
our same procedure of sanding/salting all streets. Due to
environmental concerns and financial constraints, he does not
favor an all salt application. Ald. D’Acquisto concurred, and
stated that the Public Works Department snowplow personnel did
an excellent job this past winter.
The Committee discussed drainage and water studies-residential
with Ald. Slocomb. His concern was cross culvert replacement in
the HiView Drive/Acker Drive area prior to sewer project. Rich
Eberhardt advised that the culverts are not scheduled for
replacement. Ald. Slocomb suggested that the area be reviewed
prior to sewer project so that problem areas in ditches be
corrected prior to the project being undertaken. Supt. Loughney
responded that problems other than those in the street can be
addressed after sewers are installed. Ald. Slocomb expressed
concern with the Bluhm Creek drainage area, and asked how this
project can be undertaken. Rich Eberhardt advised that DNR
approval would be necessary, due to the creek probably being
classified as a “navigable waterway”. The Mayor will question
the DNR when he meets with them tomorrow.
The Committee discussed proposed ordinance to regulate ditch
debris with Supt. Loughney. Supt. Loughney advised that there
are a few specific problems ie. residents who do not remove
leaves from their ditches. The Mayor suggested that issue be
addressed carefully, since enforcement of removal of leaves
would be difficult. The Mayor and Supt. Loughney will discuss
further.
The Committee discussed drainage concern of Mr. Knudsen on
Hillendale Drive. Supt. Loughney updated the Committee on the
history of the problem, and stated that the cross culvert was in
place before Mr. Knudsen purchased the property. Ald.
D‘Acquisto will inform Mr. Knudsen that should he wish to block
off the cross culvert, he would be responsible for costs
involved in upsizing downstream culverts across the street.
Supt. Loughney will determine which culverts would need to be
upsized, with information given to Ald. D’Acquisto who will
inform Mr. Knudsen.
The Committee discussed introduction of platting ordinance for
parcels not covered under subdivision platting ordinance. Ald.
D‘Acquisto reviewed correspondence from Ald. Pionek. The Mayor
expressed his concerns. Ald. D’Acquisto will forward concerns -@ to Ald. Pionek. Mike Campbell explained model Stormwater

Management Ordinance which County is working on which may
address issue raised by Ald. Pionek.
The Committee reviewed subdivider's exhibits for Deer Creek
Subdivision with Mr. Dean Olson and Mr. Clark Tabbert, Premier
Development. Mr. Tabbert addressed issues of concern to the
Committee. The Mayor advised past history of Mr. Barker's
development (Lakeridge Apartments) relating to the present
problems in Deer Creek. Mr. Tabbert requested copy of plan
indicating where Parkland Drive has been planned. Ald. Woodard
moved to defer to June Public Works Committee meeting. Seconded
by Ald. D'Acquisto, motion carried 2-0.
Ald. Woodard moved to adjourn at 10:30 p.m. Seconded by Ald.
D'Acquisto, motion carried 2-0.
