Public Works Committee - MINUTES - 5/25/1994‘0 *AMENDED PUBLIC WORKS COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD WEDNESDAY, MAY 25,1%'4 The meeting was called to order at 4:05 P.M. by Chairman Dumke. Also present were Committee Members Misko (arrived at 4:lO P.M.) and D'Acquisto, Mayor De Angelis, Plan Director Sadowski, Public Works Superintendent John Loughney, Mike Campbell (Ruekert & Mielke) and those per the attached list. Chairman Dumke moved, at 7:05 P.M., to recess to Special Common Council Meeting in the Muskego Room in the matter of Revocation or Suspension of "Class B" Retailer's License for the Sale of Fermented Malt Beverages and Intoxicating Liquors of Jeffrey L. Bosanac d/b/a/ Jeff's Black Duck. Seconded by Ald. D'Acquisto, motion carried. The meeting reconvened at 8:25 P.M. The Committee reviewed urban/rural drainage. There was nothing new to report. Mr. Calvin Klimeck appeared before the Committee to discuss status of Terra Development projects. Mr. Jeffrey Met2 (MS1 General) also appeared before the Committee to discuss commercial corner of CTH Y (Racine) and CTH L (Janesville Road). A discussion was held on installation of berms and Terra Development will install all berms around the wetlands; it was noted that both the City of Muskego and the DNR have approved the installation of sunset berms. Terra is awaiting approval from the DNR for installation of berms around wetland areas. Ald. D'Acquisto moved to approve installation of berms around wetland areas subject to receipt of DNR approval. Seconded by Ald. Misko, motion carried. The Committee discussed the effect of the berms with Mr. Sonny Koch, the abutting property owner. Mr. Koch understands that the berm will cut off part of his drainage and the plan is acceptable to him. Mr. Doug Eiche and Mr. Wayne Salentine appeared before the Committee to review with the City Engineer, Mike Campbell, three (3) alternatives for the Parkland South drainage. Ald. D'Acquisto moved to request the City Engineers to prepare cost analysis for alternates 2 and 3 for review at the June meeting. Seconded by Ald. Misko, motion carried. Mr. Doug Eiche has agreed to pay the same proportionate share of the study as was paid for the original study which was 11%. Mr. Richard Anderson, 580 W16902 Woods Road, appeared before the Committee to further review alternatives for storm sewering on Woods Road. Mike Campbell, Ruekert & Mielke, presented two alternatives; Alternative A (pipe) @ a cost estimate of $14,300 and Alternative B (ditch) @ a cost estimate of $5,500. Ald. Public Works Committee - Page 2 May 25, 1994 Misko moved to adopt Plan A Alternate to be installed by Mr. Gregory Boehm and request that Mr. Boehm be in attendance at the June 23, 1994 meeting. Seconded by Ald. D'Acquisto, motion carried. Mr. Greg Gabor, 583 W17323 Woods Road, appeared before the Committee to discuss drainage concern on Woods Road. The Committee discussed installation of a ditch vs. storm sewer and related costs. Additional concern and input was received from Big Muskego Lake/Bass Bay Protection & Rehabilitation District's Deputy Commissioner Collette Klenz regarding wetlands. Ald. Dumke moved to defer. Seconded by Ald. D'Acquisto, motion carried. The Committee discussed with Mr. Gabor the procedure that he could follow to request DNR wetland delineation study. Mayor De Angelis informed the Committee of a recent discussion he had with Mr. Zillig regarding installation of turn lane on CTH L and Lannon Drive. Cost estimates are due within a week and Mr. Zillig anticipates construction to start in July, subject to his reaching an agreement with FirstStar Bank. Mayor De Angelis and City Engineer Mike Campbell discussed with the Committee retrofit plans for the Little Muskego Lake Dam which would require some minor filling and tree removal along easement area. Plans are being submitted to DNR for approval. The Committee discussed status of Meadow Green West developments (Boehm). Supt. Loughney and Ald. Dumke advised that they had done an onsite inspection of curbs, gutters, etc. on the developments. Mayor De Angelis was requested to refer to City Attorney for legal opinion as to steps that can be taken to rectify situation. The Committee reviewed claim submitted for storm sewer freeze-up submitted by Mr. Larry Slamann (S81 W17708 Brennan Drive) which has been denied by the City's liability insurance company. Ald. D'Acquisto moved to deny per recommendation of Public Works Superintendent John Loughney. Seconded by Ald. Dumke, motion carried. Mr. David Belsha appeared before the Committee to discuss drainage concern on Lot 2 of his development. Mr. Belsha requested approval to dispense sump pump water on lot 2. Ald. Dumke moved to deny request for exception to ordinance and directed Mr. Belsha to direct all water to Hidden Creek Court or Durham Drive. Seconded by Ald. D'Acquisto, motion carried. Mr. Stan Potrykus appeared before the Committee to review new grade specifications for Subdivisions and Kimberly Estates. Swales and ditches finish to -3; overall lot grade finish to -6; house pad finish to -12; lot corners +/- 2". Ald. D'Acquisto moved to approve above grades specifications. Seconded by Ald. Dumke, motion carried. Public Works Committee - Page 3 May 25, 1994 Plan Director Matt Sadowski appeared before the Committee to review final plans for Freedom Square Ponds that have been submitted by the contractor, R. A. Smith & ASSOC. Ald. Misko moved to approve Alternative "A" with option for Sub-basin "A-3" included. Seconded by Ald. D'Acquisto, motion carried. . Mr. Tim Bast appeared before the Committee to discuss restoration of Durhamswood Pond and request release of $l,OOO.OO for stone already installed from the Durhamswood Cash Bond. Ald. Dumke moved to approve the release of $l,OOO.OO which will leave a balance of $1,072.40 in the account for future restoration. Seconded by Ald. D'Acquisto, motion carried. Mrs. Laurie Czaplewski, United Auto Body, appeared before the Committee to discuss the intersection of CTH L and Bay Lane as the paved portion of Bay Lane is actually on the Czaplewski property. A letter was presented to the Committee from the Czaplewski's attorney indicating that the owners are receptive to selling that portion of their land to the City. Ald. Dumke moved to direct the City Engineers to do a field survey of the area and report back to the June meeting. Seconded by Ald. Misko, motion carried. Mr. Stan Potrykus appeared before the Committee to review Subdivider's Exhibits for Lakewood Meadows Addn. #l. Mr. Potrykus requested waiving corner radius requirements. Ald. Dumke moved to remove radius corner requirement for Urban sections and to keep radius corner requirement for Rural sections, in accordance with new policy. Seconded by Ald. D'Acquisto, motion carried. The Committee noted that arterial intersections need to be reviewed. Under Superintendent's Report, John Loughney advised that during the recess he and Scott Krause discussed Champion Villages exhibits and that the item will be put on the June agenda. supt. Loughney also reported that Underground Pipeline, contractors for Lakeview Highlands North, are in violation of the recent order to cease and desist work on berm. Ald. Misko moved to direct Supt. Loughney to advise Underground Pipeline that the berm must be removed and reinstalled under supervision of city inspector. Seconded by Ald. D'Acquisto, motion carried. Ald. D'Acquisto advised the Committee of communication received from Waukesha County Corporate Counsel, dated May 10, 1994, to Lake Forest Homeowner's Association, advising that the County is engaged in litigation with Terra Development Corporation regarding erosion and sedimentation damage in the Muskego County Park. This matter is scheduled for trial in Waukesha County Circuit Court on October 3, 1994. The issues in litigation involve the design, construction and maintenance of the stormwater detention pond located adjacent to the Park and Public Works Committee - Page 4 May 25, 1994 south of lake Forest Subdivision.
