Zoning Board of Appeals 42-1992CITY OF MUSKEGO BOARD OF APPEALS MINUTES OF BOARD OF APPEALS MEETING HELD ON SEPTEMBER 24, 1992. Chairman Gerald Fohr called the meeting to order at 7:32 P.M. PRESENT: Chairman Gerald Fohr, Terry O'Neil, Lloyd Erno, Thomas Berken, Donald Pionek, Robert Vitt, and Chuck Dykstra, Sr. ABSENT: Darryl Rowinski MINUTES: Mr. Erno made a motion to approve the minutes of the August 27, 1992 meeting, and Mr. O'Neil seconded. Upon a voice vote, the motion to adopt the minutes passed unanimously. APPEAL 37-92- Lynn Kurer, S67 W14831 Janesville Road, Muskego, Wisconsin, was unable to appear due to surgery. She will need to resubmit a new appeal and fee if she still wants to pursue this appeal. APPEAL 41-92- Donald A. Erno, 5103 W20251 Kelsey Drive, Muskego, Wisconsin, appeared appealing the Building Inspector's decision to deny a permit to fill a low area located to the south of his existing home. The area in question hasn't been filled in 16 years since the City redid Kelsey Drive. He is requesting this permit to fill a low spot in his back yard so the water doesn't pocket and also to alleviate a mosquito problem. The site was examined by Chuck Dykstra and without current and accurate topographical information on this site, he doesn't know what effect the filling would have on surrounding areas. Mr. Erno is requesting permission to haul in at least 10 truckloads of clay mixture from a recent subdivision. Mr. Henry Herdeman, 5103 W20171 Kelsey Drive, a neighbor, objected to his request stating that the water would just be diverted to his property that much faster. The City requires a fill permit for any amounts over 2,000 square feet and does not allow any filling if it will direct water to another property owner. The low spot to be filled is 50' x 100 and approximately 3 feet deep. APPEAL 42-92- Address amended from Public Notice Hearing to read Muskego Moose Lodge, S86 W21693 Janesville Road, Muskego, Wisconsin. Representatives: Karl Wegner (Moose Lodge President), Brent Ryan (Contractor), and Dan Hilt (Advisor) appeared to request a variance of 35' from the setback requirement of 75' measured from the Janesville Rd. right-of-way and a 40' variance to the offset requirement of 50' at the East property line to construct a new building. Zoning A with an OHS overlay. The Moose Lodge was originally going to get it rezoned to B2 instead of applying for two variances. Agricultural zoning with OHS overlay allows commercial use. A larger setback is required on agricultural zoning to allow for more open land. Existing building and sheds will be removed to accommodate space for the BOARD OF APPEALS Page 2 September 24, 1992 new building. There will be a service driveway off of Janesville, with the majority of traffic coming in from Crowbar. APPEAL 43-92- Amended from the Public Hearing Notice to read for a firewall and to a 274 sq. ft. size variance. Greg Wieckowski, S64 W 18807 School Drive, Muskego, Wisconsin, appeared requesting variances to construct a 24 x 36 ft. detached 2nd garage structure. Mr. Wieckowski is the owner of 3 original lots. Zoning is RS3 / OED. He needs the storage for extra cars he is not working on and lawn & gardening supplies. This structure will be used strictly for storage and a driveway won't be needed at this time. ******************************************************************* APPEAL 41-92- Donald A. Erno, 5103 W20251 Kelsey Drive, Muskego, Wisconsin. Hardship being water standing and a mosquito problem. Mr. Robert Vitt moved to uphold the decision of the Building Department Director unless Mr. Erno submits additional information. He will not be required to pay an additional appeal fee on the same issue. Chuck Dykstra, Sr. will make his final decision upon receipt of this information. Mr. Lloyd Erno abstained from voting. Motion carried with four members voting yes. APPEAL 42-92- Moose Lodge, S86 W21693 Janesville Road, Muskego, Wisconsin. Hardship being the "A" Zoning setback location, the membership outgrowing the size of the present building, and the age of the building. Mr. O'Neil moved to approve the appeal; Mr. Erno seconded. Upon a roll call vote, the motion passed with a vote of five to one. APPEAL 43-92- Greg Wieckowski, S64 W18807 School Drive, Muskego, Wisconsin. Mr. Berken moved to grant the variance with the stipulation that the Wis. Electric Power be contacted to make sure the power lines above the structure don't interfere with the building. Mr. O'Neil seconded. Upon a roll call vote, the motion passed with a vote of five to one. ADJOURNMENT There being no further business, Mr. O'Neil made a motion to adjourn and Mr. Vitt seconded. Upon a voice vote the motion to adjourn passed unanimously. The meeting was adjourned at 9:58 P.M. NOTICE OF CLOSED SESSION: PLEASE TAKE NOTICE that the Board of Appeals of the City of Muskego will convene, upon passage of the proper motion, into closed session pursuant to Section 19.85 (1) (a) of the State Statutes for the purpose of deliberating concerning cases which were the subject of a quasi-judicial hearing; said cases being the above listed appeals.
