1993. Chairman Fohr called the meeting to order at 7:45 P.M.
PRESENT: Chairman Gerald Fohr, Mr. Terry O'Neil, Mr. Robert
Vitt, Mr. Donald Pionek, and Mr. Chuck Dykstra, Sr.
ABSENT: Mr -Darryl Rowinski, Mr. Thomas Berken, and Mr. Lloyd

MINUTES: Mr. Donald Pionek made the motion to approve the
minutes from August 26, 1993, as received. Mr. Robert Vitt
seconded, motion carried.
APPEAL #26-93 _ Mr. and Mrs. Alan Wittenburg, s75 W19236
Bayshore Drive, Muskego, WI 53150, appeared requesting 1
variance:
1) A 16'6" variance from Section 8.07(3) requirement of 20
feet, to allow construction of a new garage and home addition
within 316" of west property line.
Mr. Dykstra discussed RS2 zoning. Mr. Dykstra also expressed
his concern regarding the location of the well and the new
addition.
Mr. Wittenburg explained to the Board members that neigher the
roof line nor the porch will be over the well. Mr. Wittenburg
supplied the Board members will a letter from Mrs. Virginia
Skebba, S75 W19246 Bay Shore Drive, his immediate neighbor to
the west. The property to the rear of his lot is entirely
wooded. The hardship Mr. Wittenburg described is the lack of
storage, garage space, additional bathroom facilities also the
homes existing location and floorplan layout.
The electric company and the gas company have already been
advised of this project. The electric pole will be moved three
feet west. The gas will be capped off until after work is
finished.
The existing home is 1639 square feet, the addition proposed is
1855 square feet a total of 3494 square feet.
APPEAL #27-93 - Mr. Gerald Geboy, W199 S7872 Sanctuary Court,
Muskego, WI 53150, appeared requesting one variance:
1) A 4'0" offset variance from Section 8.08(3), requirement
of 15', to allow a deck to be constructed 11' from the
southeast property line.
Mr. Dykstra explained this property is located in a RS3--OPD
zoning which requires 15,000 square feet, 10,000 square feet of
open space. The city requires offsets of 15 feet at the rear

of the property, however, Lake Forest deed restrictions require
20 feet at the rear of the property. The City is not
responsible to the deed restrictions, but the home owner would
be required to have architectural approval before a building
permit could be applied for.
Mr. Pionek asked if the steps are located 11' from the rear
property line. Mr. Geboy stated the steps could be moved to
another side of the deck if necessary. Mr. Geboy presented the
Board with a letter signed by four of his neighbors: Frank
Kulaszowicz, Lana Marten, Peggy Simandl and Gary Koster stating
they approve the proposed deck construction.
Mr. Geboy stated he has trucked in 30 loads of fill to help
eliminate the slope at the rear of the property, however, there
is still a considerable slope and the only way to use this
property is build a deck. Mr. Geboy also stated his house is
the last one on the court and the back abuts the park.

APPEAL 26-93 - Alan and Susan Wittenburg, S75 W19236 Bayshore
Drive, Muskego, Wisconsin. Mr. Robert Vitt made the motion
after first amending the request to read 16'6" from Section
8.07(3) and 3'6" from the west property line, to grant the
variance. The hardship being the location of the existing home
on the property. Mr. Vitt also included the stipulation that
all IDNR regulations regarding wells location in relation to new
constrion. Mr. O'Neil seconded. Upon voice vote, motion
carried.
APPEAL 27-93 - Gerald Geboy, W199 S7872 Sanctuary Court,
Muskego, Wisconsin. Mr. O'Neil made the motion to grant the
variance as submitted. The hardship being the topography. Mr.
Vitt seconded. Upon a voice vote, the motion passed
unanimously.
ADJOURNMENT - There being no further business, Mr. Vitt made
the motion to adjourn and Mr. Pionek seconded. Upon voice
vote, the motion to adjourn passed unanimously. The meeting
was adjourned at 8:30 P.M.
