ZBA-Minutes 12041986December 8, 1986 Mr. & Mrs. Richard Olson W183 S8922 Racine Avenue Muskego, WI 53150 Dear Mr. & Mrs. Olson: The Board of Appeals wishes to advise you that your appeal for a 1,500 square foot variance for the construction of an addition to a second garage structure has been denied as submitted but granted with a variance of 1,200 square feet for the addition to the second garage structure contingent upon the garage having the same width as the existing structure to keep the roof lines even. Chairman Gerald Fohr called the meeting to order at 7:30 P.M. PRESENT: Chairman Gerald Fohr Vice Chairman Erno, Carol Nievinski, Linda Koester, Peter Passick and Zoning Officer Gerald Lee. ABSENT Thomas Berken MINUTES Mrs. Nievinski moved to adopt the minutes of the October 23, 1986 meeting. Mr. Passick seconded and the motion carried. APPEAL 19-86 - Gary Hartson Mr. Hartson appeared before the Board of Appeals to request a 00' setback variance to construct a garage. The electric company had informed him the cost of removing the utility pole to conform to the setback requirement would cost approximately $1,200. He also stated that the other garages along Kurtze Lane were not more than 35 to 40 feet from the center line of the road and his would look out of proportion to these. Zoning Officer Lee explained that the lot was nonconforming and the electric company easement was put in before the lot was created. The Board inquired whether Mr. Hartson would consider a lesser variance in setback and reduce the size of the garage. Mr. Hartson stated that this would be alright with him. APPEAL 23-86 - INGERSOLL CABLE Mr. Norman Dubuc, General Manager for Ingersoll Cable appeared before the Board of Appeals to request a fence height in excess of 6' and a 50' front offset variance to construct a chain link security fence. This was deferred from the October 23, 1986 meeting. Mr. Dubuc now stated that they would put the fence along the front of the building - starting point behind the front stairway. The barbed wire would not be along the fence line facing Highway 24 but the barbed wire would start approximately 40' east from the front lot line and continue to the rear and the south property lines and would not be visible because of the trees and brush on the property line. The 6' fence being built along the front property line would not require the 50' front offset variance but would require the height variance because of the additional footage of the three strand barbed wire around part of the fence. APPEAL 25-86 - KUGLITSCH ALPINE LANES Mark Kuglitsch appeared before the Board of Appeals to request an 18' variance to increase an existing sign above the total square footage requirement. Mr.Kuglitsch explained he ran a commercial business but was under the Industrial sign limitations. The existing sign BOARD OF APPEALS - Page 2 December 4, 1986 would not be changed but would be added on to with inter- changeable letters advertising special events to attract the industrial park clientele. Zoning Officer Lee explained that the Alpine Lanes sign had been put up before the existing ordinance was adopted. APPEAL 26-86 - RICHARD OLSON Mr. and Mrs. Olson appeared before the Board of Appeals to request a variance of 1,500 square feet for the construction of a second garage structure on their property. This storage structure would be a 50' X 30' extension on to an existing pole building. Zoning Officer Lee explained that the Olson's were denied a variance in 1973 for a 30' X 50' pole building because this exceeded the requirement of accessory buildings being allowed over 60% of the principle building. The Board inquired whether the Olson's would be in favor of cutting down the width of the structure by 6' to keep the roof lines even. The Olson's stated that they would not be adverse to this suggestion. APPEAL 27-86 - DONALD DOUGHERTY Mr. and Mrs. Dougherty appeared before the Board of Appeals to request a variance of 785 square feet for the construction of a second garage structure. Mr. Dougherty explained he needed more storage space. Zoning Officer Lee explained the garage would be 1,440 square feet with 655 square feet allowable under the requirement of 60% of principle structure leaving 785 square feet for the variance requested. Mr. Erno asked if the roof could be turned the opposite way which would then make the garage more in conformance with the house. Mr. Dougherty stated he could not do this. The Board remained in open session. APPEAL 19-86 Mr. Passick moved to deny the appeal as submitted but to grant the appeal of a 101variance in setback. The hardship is due to the electric company easement which was put in before the lot was created. Mrs. Nievinski seconded and the motion carried. APPEAL 23-86 Mrs. Nievinski moved to approve the amended appeal with the following conditions: That a letter be sent to the adjoining property owners advising them of the barbed wire and requesting their response within a two week period and that no barbed wire be put along Highway 24. Mrs. Koester seconded and the motion carried. APPEAL 25-86 Mr. Fohr moved to approve the appeal as submitted. Mr. Erno seconded and the motion carried. The hardship is the distance of the sign from Racine Avenue. APPEAL 26-86 Mr. Erno moved to deny the appeal as BOARD OF APPEALS - Page 3 December 4, 1986 submitted but to approve a 1,200 foot variance to the existing addition with the same width. The hardship is the location of building and this variance would have no adverse affect to the basic intent of the ordinance. Mrs. Nievinski seconded and the motion carried. APPEAL 27-86 Mr. Erno moved to approve the appeal as submitted conditioned that the height of the garage does not exceed 15' and the offset requirements are met. Mr. Passick seconded and the motion carried. The hardship is the size of the house in relation to the the garage and amount of storage needed. ADJOURNMENT; Mrs. Nievinski moved to adjourn the meeting at 9:10 P.M. Mrs. Koester seconded and the motion carried.
