MINUTES OF BOARD OF APPEALS MEETING ON AUGUST 25, 1994.
PRESENT: Chairman Donald Pionek, Mr. Terry O'Neil, Mr. Dan
Schepp, Mr. Gerald Fohr, and Mr. Chuck Dykstra.
EXCUSED ABSENT: Mr. Dave Warhanek and Mr. Henry Schneiker
ABSENT: Mr. Darryl Rowinski
MINUTES: Mr. Jerry Fohr made the motion to approve the July 28,
1994, minutes. Mr. Dan Schepp seconded. Upon voice vote, the
motion to adopt the minutes passed unanimously.
APPEAL #22-94 - Mr. Dan Dotson, S68 W17909 East Drive, Muskego,
Wisconsin. Chairman Pionek read the appeal for Mr. Dotson:
1) Requesting a 1517 square foot variance from Section 17:5.08
requirement of 5202 square feet of open space (75% of lot) to
allow construction of an addition to home. Which would reduce
open space to 3685 square feet.
2)Requesting a 716" street side setback variance from Sections
17:8.08(3) and 17:9.07(3) requirement of 32"6" by average, to
allow construction of an addition at NE corner of existing
dwelling 25 feet from base setback line.
Mr. Terry O'Neil administered an oath to Mr. Dotson. Mr.
Dykstra explained the RS3 OED Zoning. Mr Dykstra also explained
Section 17.:5.02(2) B4 allowing the request to be reduced to
7'6" street side setback and 32'6" base setback. Mr. Dykstra
also stated the new survey does not include a 30' by 50' parcel
of land vacated by the City that was used in the calculations.
Mr. Dotson informed the Board of Appeals his garage has a wooden
foundation that needs to be replace and at the same time he
would like to extend the foundation 10' by 10' to add 100 square
feet to the home and an upper story. This addition will not be
any further toward the street than the front is now. Also, the
side would not extend out any further than the present site.
Mr. Dotson provided a letter from his neighbors in support of
his addition. Mr. Pionek questioned to need to add on to the
existing residence. Mr. Dotson stated the family is expanding
and this addition will not encroach on the neighbors, there are

Drive, Muskego Wisconsin. Chairman Pionek read the appeal for
Mr. and Ms. Drenzek: 1) Requesting a 1,245 square foot
variance from Section 17:5.08 requirement of 8,441 square foot

which would reduce open space to 7,196 square feet.
2) Requesting a 12' 6" streetside setback variance from Section
17:8.08.(3) and 17:9.07(3) requirements of 33'7", by average, to
allow the construction of an addition 21' 1" from base setback
line.
Mr. Terry O'Neil administered an oath. Mr. Dykstra explained the
RS3 OED Zoning. Mr. Dykstra also explained Section 17:5.02(2)
B4 allowing the request to be reduced to 1216" street side
setback and 331711, by average, base setback. Mr. Dykstra
further explained that the home along that street have varying
setbacks.
Mr. Drenzek explained the house has not had anything done to it
for 25 years and the porch is sinking. There is a shortage of
closet space and there is only a 6' by 6' entrance and porch.
APPEAL #24-94 - Mr. Randy Wegener, W162 S7913 Baylane Place,
Muskego, Wisconsin. Chairman Pionek read the appeal for Mr.
Wegener: Mr. Wegener requested to be removed from the August
Agenda and placed on the September Agenda.
DELIBERATION OF APPEALS:
APPEAL #22-94 - Mr. Dan Dotson, S68 W17909 East Drive, Muskego,
Wisconsin. After a short discussion, Mr. Terry O'Neil made the
motion to grant the appeal as requested. Hardship being the
existing lot size. This will not be contrary to public interest
and allow the Dotson's to fully utilize their home with the
square footage increased. Granting this appeal does not
jeopardize public welfare. Mr. Dan Schepp seconded, upon voice
vote, motion passed unanimously.
APPEAL #23-94 - Mr. Peter Drenzek and Ms.Gloria Drenzek, S70
W17635 Muskego Drive, Muskego, Wisconsin. Mr. Jerry Fohr made
the motion to approve the appeal as submitted due to the shape
of the lot and the lack of space in the home. Mr. Dan Schepp
seconded, upon voice vote, motion passed unanimously.
NEW BUSINESS
Mr. Terry O'Neil questioned the board members about starting the
meeting at an earlier time, perhaps 6:30 P.M.or 7:00 P.M. After
some discussion, it was tabled until the next meeting.

made the motion to adjourn. Mr. Terry O'Neil seconded. Upon
voice vote the motion to adjourn passed unanimously. The
