MINUTES OF BOARD OF APPEALS MEETING HELD ON JULY 22, 1993.
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Gerald Fohr, Mr. Terry O'Neil, Mr. Robert
Vitt, Mr. Darryl Rowinski, Mr. Thomas Berken, and Mr.
Chuck Dykstra Sr.
ABSENT: Mr. Lloyd Erno and Mr. Donald Pionek.
MINUTES: Mr. Rowinski made the motion to approve the minutes of
the May 27, 1993 meeting. Mr. O'Niel seconded, motion passed
on voice vote, unanimously.
APPEAL # 18-93 - Hunter's Nest, S80 W 144010 Schultz Lane,
Muskego, WI 53150, appeared requesting 1 variance:
1) A variance to firewall requirement of Section 30.43 (3)
(c), which requires a 720 square foot maximum area for a wood
frame garage structure (firewall required over 720 sq ft).
Mr. Dykstra explained this building will be used in conjunction
with the existing business. Contractor Tim Lang explained this
is the smallest available size to house all the items that need
to be undercover. There will be no hazardous materials stored
in this building. The firewall would restrict utilizing all
available space.
APPEAL # 19-93 - Raymond Zangerle, S192 W7586 Racine Avenue,
Muskego, WI, appeared to request:
1) A 4' offset variance from Chapter 17, Section 8.07 (3)
requirement of 20' to allow an attached garage to be
constructed within 16 feet of the NW property line.
Mr. Dykstra stated there would need to be an additional exit on
the residence if this were approve.
Mr. Zangerle stated he needed room for a second car, and due to
his poor health, he needs to park his car inside. There is
7000 square feet in back, however, the topography does not
allow for building.
APPEAL # 20-93 - Dennis Hoeft, W149 S6526 Spring Drive,
Muskego, WI, appeared to request:
1) A 65 square foot variance from Chapter 17, Section 4.05
(2)c4, requirement of 715 square feet (60% of principle
buidings), to allow construction of a 780 square foot garage.
2) A variance to firewall requirement of Section 30.43 (3) (c)
which requires a 720 square foot maximum area for wood frame
garage structure (firewall required over 720 square feet).

Mr. Dykstra stated this new garage would be within the required
offsets of 40-20-20.
Mr. Hoeft stated he has 2 and three-quarters acres and is
willing to remove lean-to shed. His family is growing, he now
needs a three car garage, this would prevent him from building
a second garage. He also intends to side the garage with the
same material as the house.
APPEAL #21-93 - John Barkby S70 W17837 Muskego Drive, Muskego,
WI, appeared to request:
1) A variance from offset of 2'-6" from Chapter 17, Section
8.08 (3) and 9.04 (3) requirement of 6'0" to allow construction
of an addition 3'-6" from NW lot line.
2) A variance to Chapter 17, Section 4.06(2)A. requirement
that a nonconforming structure not be expanded, to allow the
construction of an addition to an existing nonconforming
structure.
Mr. Dykstra explained that this zoning is highest density lake
shore zoning. The offset should be 10 feet, and if calculated
at 91% the closest it should be is 6'9" on the northwest lot
line. This property is exiting nonconforming.
Mr. Barkby stated this residence was built in 1935, he does not
intend to build any closer to the lot line than already built.
Mr. Barkby stated the basement walls are caving in 2 to 3 feet,
plus he stated there are no closest in any of the bedrooms.
He would like to do all this repair and remodeling at the same
time.

APPEAL 18-93 - Hunter's Nest, S80 W14401 Schultz Lane, Muskego,
Wisconsin. Hardship being utilization of storage space. Mr.
Vitt made the motion to the varinace as submitted.
Mr. Berken seconded. Upon voice vote, the motion passed.
APPEAL 19-93 - Raymond Zangerle, S192 W7586 Racine Avenue,
Muskego, Wisconsin. Hardship being poor topograph and his
ailing health. Mr. Berken made the motion to approve this
appeal as submitted. Mr. Vitt seconded. Upon voice vote,
motion carried.

APPEAL 20-93 - Dennis Hoeft, W149 S6526 Spring Street, Muskego,
Wisconsin. Mr. O'Neil made a motion to approve both appeals
as submitted, with the condition the old shed be removed.
Hardship being lack of storage. Mr. Vitt seconded the motion.
Upon voice vote, motion passed.
APPEAL 21-93 - John Barkby, S70 W17837 Muskego Drive, Muskego,
Wisconsin. Mr. O'Neil made the motion to approve both appeals.
Hardship is dealing with existing structure. Mr. Berkens
seconded. Upon voice vote, motion passed unaminously.
