ZBA-Minutes 20-1990CITY OF MUSKEGO BOARD OF APPEALS MINUTES OF BOARD OF APPEALS MEETING HELD ON AUGUST 23, 1990 Chairman Gerald Fohr called the meeting to order at 7:30 P.M. PRESENT: - Chairman Gerald Fohr, Vice Chairman O'Neil, omas Berken, Bonnie Posbrig, Donald Pionek, Daryl Rowinski and Director Gerald Lee. ABSENT: - Lloyd Er -no. MINUTES: Mr. O'Neil made a motion to approve the minutes of the July 26, 1990 meeting and Mr. Rowinski seconded. Upon a voice vote the motion passed unanimously. APPEAL 20-90 - MYRA STOLZE - Chairman Fohr read the appeal for Myra & William Sto ze, S65 W18764 Onyx Drive, Muskego, WI requesting 3 3/4' setback variance from Onyx Dr.; a 26' setback variance from Gold Dr.; and a 4' height variance to construct a 10' x 12' storage structure. Zoning: RS-3/OED. Chairman Fohr asked Mr. Lee to brief the members about the zoning requirements. Mr. Lee quoted Section 4.05(g) and discussed the appellant's request. Chairman Fohr asked Mr. & Mrs. Stolze to explain their hardship. They presently don't have a garage and wish to use this storage shed for tools. He has an existing driveway nearby. This shed will be approximately 20' from the existing house. Mr. O'Neil asked why they built the shed with a 12' height? Mr. Stolze responded for storage. They have a swimming pool on the lot already. Mr. Pionek asked if this shed is on a slab? Mr. Stolze replied no. Mrs. Stolze asked if she could present a petition from neighbors voicing support for this shed? Chairman Fohr responded that she should give it to the secretary for the record. The petition stated that they have no objections to the location and height of the storage structure on this property. A member asked Mr. Lee if this 12' height is becoming a common request for these storage sheds? Mr. Lee responded that it was because of the attractive designs for sheds on the market. His department had checked shed heights and put the 8' height in the ordinance. Also, a question was raised as to whether the ordinance requires a slab? Mr. Lee said no,only treated materials right on the ground. Mr. Stolze stated he had treated 4 x 4's and blocks to level it. Mr. Berken questioned if he intended to build a garage later? Mr. Stolze said he would. Chairman Fohr commented that they have a screening fence on Gold Drive already and this shed is barely visible from the street. Mr. Stolze asked Mr. Lee what constitutes an attached garage? Mr. Lee responded it would be attached by the roof, have 4' frost footings, etc. Pg. 2; Board of Appeals Minutes of the August 23, 1990 Meeting There being no furthur discussion Chairman Fohr told Mr. k Mrs. Stolze he could call the Building Inspection office in the morning for the Board's decision or wait to receive it in the mail within five (5) days. The Board remained in Open Session. APPEAL 20-90-MYRA STOLZE - The Board briefly discussed the location ot the shed and the hardship. The members felt the owner needed storage and the location was in the best spot on the lot. Mr. O'Neil made a motion to grant the variance as submitted sub ect to obtaining a building permit. The hardship being the eon iguration of the lot, as he has no other place to locate the shed. Mr. Pionek seconded. Upon a roll call vote the motion to adopt passed unanimously. ADJOURNMENT: Mr, O'Neil made a motion to adjourn the meeting at 8:00 P.M. and Mrs. Posbrig seconded. Upon a voice vote the motion to adjourn passed unanimously.
