BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON October 27, 1988.
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: - Chairman Gerald Fohr, Vice Chairman Carol Nievinski,
Thomas Berken, Lloyd Erno, Terry O'Neil and Assistant Director
Gene Kovacs.
ABSENT: Linda Koester.
MINUTES: Mr. Berken moved to approve the Minutes of August 25.
1988.
Chairman Fohr stated that he has received a letter of resignation
from Vincent Caporali.
APPEAL 20-88 - JAMES J. YUST Mr. & Mrs. Yust appeared
before the Board to request a 2 offset variance from the west
lot line for an existing asphalt driveway. Mr. Kovacs stated
that it is zoned RSA residential with planned development
overlay. Mr. Yust stated his hardship was that there was an
existing gravel driveway and he considered it to be an
improvement to the property. There had been a dust problem with
the gravel also. He showed the board members pictures of his
driveway. Mr. Berken questioned Mr. Yust about the paved area on
the side of the garage. Mr. Yust replied that he would possibly
park a boat there in the future. Mr. Roger Fenzau, S69 W14841
Cornell Circle, a neighbor was present and stated his concerns
about the driveway being too close to the lot line and he felt
that an ordinance is an ordinance and should be enforced. He
feels the driveway should be 3' off the lot line. There was some
discussion on the Durham Meadows area and the parking problems.
The Board remained in open session.
APPEAL 20-88 After some discussion Mr. O'Neil moved to approve
the appeal amended to read that the offset variance be 3' for the
asphalt driveway. The hardship is based upon the pre-existing
conditions on the lot, more specifically the gravel driveway that
was in place when Mr. Yust purchased the property. Mr. Erno
seconded and the motion carried.
ADJOURNMENT: Mrs. Nievinski moved to adjourn at 8:30 P.M. Mr.
Berken seconded and the motion carried.
