BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING ON JULY 25, 1991.
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Fohr, Vice -Chairman Terry O'Neil, Lloyd Erno,
Donald Pionek, Bonnie Posbrig and Director Chuck Dykstra.
ABSENT: Thomas Berken and Darryl Rowinski.
MINUTES: Mr. Pionek made a motion to approve the minutes of the
June 27, 1991 meeting and Mrs. Posbrig seconded. Upon a voice
vote, the motion to adopt the minutes passed unanimously.
APPEAL 19-91- Dale E. Galten, S83 W15249 Mystic Drive,
Muskego, Wisconsin. Chairman Fohr read the appeal for the Galtens
requesting a 4' height variance for a 10' x 12' storage shed.
Zoning: RS-2. Mr. Dykstra reported to the Board that a shed of
120 square feet in area and no more than 8 feet in height would be
allowed. The shed is located 69' from the lot line. Mr. Dykstra
has allowed slight height variances for storage sheds. Mr. Erno
questioned Mr. Dykstra about the legality of this shed since it
would be the only structure on the property. Mr. Dykstra
responded that it would be legal for Mr. and Mrs. Galten to have
the shed on the property. Mr. and Mrs. Galten appeared before the
Board. They previously had a cottage on the property that burned
down mysteriously. He did take out a building permit for a
storage shed when Gerald Lee was the director, however, that
permit has expired. When he contacted the Building Department, he
was informed that the time for the original permit had elapsed.
He was instructed to apply for another permit: When his wife
attempted to do so, she was informed that the 12' height requested
for the storage shed would require a variance from the Board of
Appeals. Mrs. Galten presented the Board with a letter from the
neighbors, The Reinkes, stating that they have no objection to the
requested height for the structure. The Galtens stated to the
Board that they want to put this structure up for the storage and
protection of their belongings. They have had items stolen in the
past. The additional height would allow for loft storage. The
Galtens presented the Board with a photograph showing the inside
of the shed.
APPEAL 20-91-
Carl Prusinski, S75 W13913 Bluhm
Muskego, Wisconsin. This appeal was dismissed as no one appeared
before the Board and the Building Department was informed by Mr.
Prusinski that he would not request the variance after all.
The Board remained in Open Session.

Mr. Erno made a motion to grant the variance with the hardship
being the lack of storage space on the property. Mr. O'Neil
seconded. Upon a roll call vote, the motion to grant the 4'
height variance passed unanimously.
The ordinance regarding the height of storage sheds was
discussed. Director Dykstra informed the Board that the height
restriction for a 120 square foot storage shed is 8'. He has
allowed up to 9' so as to avoid having numerous cases go before
the Board of Appeals. Mr. Dykstra asked the Board how they feel
about his continuing this practice. Mr. Erno questioned why the
ordinance is not changed. The Board told Mr. Dykstra that his
allowing slight variances over the 8' height is fine with them but
they would like to see the ordinance eventually changed through
the proper channels. Director Dykstra is going to work on various
ordinance changes as well as other matters such as the definition
of a "boathouse."
MISCELLANEOUS DISCUSSION:
A copy of a letter sent to Muskego Marine was presented to the
Board members giving Mr. Langfeldt 15 days to relocate the shed on
the property.
The lot at the Irish Springhouse has been asphalted.
ADJOURNMENT:
There being no further business, Mrs. Posbrig made a motion to
adjourn and Mr. Pionek seconded. Upon a voice vote, the motion to
adjourn passed unanimously. The meeting was adjourned at 8:00 P.M.

NOTE TO MR. FOHR - BOARD OF APPEALS MEETING
JULY 25, 1991
1. Mr. Rowinski called and will not attend
meeting. He is on vacation.
2. Our office has been informed that Mr. Prusinski
will not proceed with Appeal 20-91. He has
redrawn plans for his house and submitted
these plans to the Building Department to
obtain a building permit.
3. Re: Appeal 19-91 -
Our office received a phone call from Mr. Mc Nutt
stating he had no objection and from Mr. Reinke
stating he also had no objection to the request
for the 4' height variance requested by the Galtens.
4. Irish Spring House - parking lot asphalted.
5. Mr. Berken called today. He will not attend meeting.

re: request for height variance on shed/boat house
property located at S83 W15249 Mystic Drive
July 8, 1991
To Whom It May Concern:
In 1987, my cottage, located on Mystic Drive, was mysteriously
burned down, leaving me without any structure for storage on the
property.
Due to the secluded location of my lot and the circumstances of
my case, the building inspector, Mr. Gerald Lee, granted me
permission to build what he called a boat-house/shed which could
house my yard equipment, boats and recreational vehicles (please
see pictures of proposed shed, enclosed).
Back in May of 1988, Mr. Lee approved a 10' x 12' storage
structure with an approximate height of 12 ft.
My wife and I currently live in a West Allis apartment,but we
spend most of our free time at our Muskego property, boating,
fishing, and keeping up the yard. In the past few years my
financial priorities have delayed the planned work on this shed.
At this time, it is my hope that the board will renew my building
permit with the 12 ft. height variance, sighting my need for
additional overhead storage and in view of the unique
circumstances involved here.
