BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON August 25, 1988.
Chairman Gerald Fohr called the meeting to order at 7:30 P.I.
PRESENT: - Chairman Gerald Fohr, Thomas Berken, Lloyd Erno, Terry O'Neil
and Director Gerald Lee.
ABSENT: - Vice Chairman Carol Nievinski, Linda Koester and Vincent
Caporali.
MINUTES: Mr. O'Neil moved to approve the minutes of July 28, 1988. Mr.
Erno seconded and the motion carried.
APPEAL 17-88 - BRIAN PRIEM Mr. & Mrs. Priem appeared before the
Board. This matter had been deferred from the July 28th meeting when
they requested an 11' offset variance to construct a 26'x29' attached
garage. Mr. Priem had a revised sketch to show the board indicating a
change in the way the garage would be located on the lot. He is now
requesting a 21'x26' attached garage that will need a 3' offset
variance. His reasons for hardship being the water drainage flowing
toward his residence could be alleviated with the construction of this
garage and the proposed paving of the area. He would also he able :o
keep his cars off the street and provide needed storage for his
Lawnmowers, etc. It was suggested that Mr. Priem make the garage even
with the side of the house and to reexcavate and pitch the asphalt drive
to direct the water toward the manhole.
APPEAL 18-88 - MR. ROMERO appeared before the Board to request
a 20' setback variance to build an attached garage Mr. Lee stated that
RS3/OLS zoning requires a 25' setback vs. a 40' setback in most other
districts. Oak Grove is a narrow road with the proposed garage 35' from
the center of the road requiring a 20' variance. Mr. Romero stated t`?at
he needs the storage for lawnmowers, garden tools, car and tools, etc.
and would be satisfied with a 2-car attached garage with a little
storage. He showed the board members where a well pit approximately
7'to 8' long and 4' across covered with concrete is located on his
property. He said that several mature hickory trees would have to be
cut to enter the garage from the west.
APPEAL 19-88 - KENNETH/CLINT CHRISTENSEN appeared before the
Board to request a 16 offset variance to construct an addition to an
existing commercial structure. Mr. Lee stated that the tavern was in B2
zoning and that the Planning Commission would have to approve the
expanded use at their September 6th meeting. Mr. Christensen stated
that he would like to construct the 24'x20' addition to provide space
for two pool tables since their business was growing. Mr. Christensen
was asked if he intended to improve the exterior of the rest of the
building since some siding is off and it looks a mess. Mr. Christensen
said that he intended to upgrade the rest of the property and fix the
roof also. Mr. Dave Westlund, W195 S10258 a neighbor voiced his
concerns: 1) how many windows were facing north? 2) is the addition
going to be air-conditioned?(when windows are open it is noisy? 3) what
about the sewers - tanks pumped twice a month now. 4) there is a well
on the lot now and another community well shared by 3 establishments (2
duplexes) 5) what about the amount of parking available since now
people are parking on both sides of the road? 6) noise level is ok,
but was bad 1 year ago. Lois Perelli, S102 W19504 Kelsey Drive , a
neighbor voiced her concerns 1) with the expanded bar more patrons
would be outside playing horseshoes, baseball with music playing loudly
from a speaker on a truck. 2) tapping into well on Racine Avenue
side. 3) wants a noise buffer -- wooden fence. 4) an asphalt
driveway (snowblower goes on her driveway now.) 5) some verbal abuse
-- worse last year. 6) outside lighting. Mr. Lee addressed her concern
regarding the parking. He said one space is needed for every 100 square
feet of floor area -- amended building space plan. He stated that a
preliminary site evaluation for the septic would have to go before
Waukesha County Health Department, who sizes and checks the system and
no permit would be issued if not ok. They would have to go before the
Plan Commission September 5th. Mr. Christensen replied that the
community well is on his property and does not plan to use it unless
necessary. He proposes using 2'x4' windows with air-conditioning, would
provide a fence for a barrier, only has horseshoe tournaments once a
week. Mr. Berken asked if he planned on having live entertainment or
food and Mr. Christensen said no.
The Board took a 10 minute recess at 8:35 P.M.
The Board of Appeals remained in open session.
APPEAL 17-88 Mr. Fohr moved to deny the appeal as submitted but
grant a 1---variance for a 21'x26' garage and asphalt the access to the
garage within 6 months of completion. The hardship is the location of
the house on the property and the water problem. Mr. Erno seconded and
the motion carried.
APPEAL 18-88 Mr. O'Neil moved to deny the appeal as submitted
but grant a 2 variance. The hardship is the location of the house on
the lot. Mr. Berken seconded and the motion carried.
APPEAL 19-88 Mr. Berken moved to approve the appeal as
submitted. The hardship is that it is a growing business and they need
space. Mr. O'Neil seconded and the motion carried.
ADJOURNMENT: Mr. Berken moved to adjourn at 9:40 P.M. Mr. Erno
seconded and the motion carried.
