BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON September 25, 1986.
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Gerald Fohr, Thomas Berken, Carol Nievinski,
Vice Chairman Lloyd Erno, Adm. Assistant, Gene Kovacs
ABSENT: Linda Koester, Peter Passick, Vincent Caporali, Zoning
Obi e Lee
MINUTES: Mrs. Nievinski moved to adopte the minutes of the
August 28, 1986 meeting. Mr. Berken seconded and the motion
carried.
APPEAL 17-86 - LAWRENCE J. KNIPPEL JR. Mr. Knippel
appeared before the Board to request a 41 side offset variance to
construct a family room addition and two car garage. Mr. Kovacs
explained that RS2 zoning requires a minimum of 151offset and the
Knippel's have an existing offset of 20' from the building to the
lot line. The addition/garage would extend out to within 11' of
the lot line to line up with the existing driveway. The neighbor
whose property the side variance would affect, Mr. Gene Hass, was
present and stated he had no problem with the addition being
constructed.
APPEAL 18-86 - SUSAN STOECKMAN/AGATHA L. MILLER Ms.
Miller and Ms. Stoeckman appeared with r. au aram a to
request a 4' offset variance (north), 44 112' lake offset
variance and a 4' variance on distance between the house and
garage to construct a garage. They stated they had purchased the
house through the real estate agent who had explained that a
future variance had been granted to the O'Neil family to
construct a garage. Mr. Kovacs stated that zoning required the
side setbacks to be from 5' to 7'and the distance from the lake
to the building structure to be 50'. This request as submitted
would put the garage within 1' of the lot line and closer to the
neighboring house than the petitioner's house.
APPEAL 19-86 - GARY HARTSON Mr. Kovacs explained that a
55' setback was required for the zoning district regulation and
that the petitioner was requesting a variance of 20' to establish
a 35' setback. Mr. Hartson would be 20' from the porch of his
house to the newly constructed garage because of the location of
the utility pole. His request was made due to the cost of the
relocation of the utility pole and to conform with the garages in
the neighborhood.
The Board remained in open session.
APPEAL 19-86 - HARTSON Mr. Erno moved to defer action on
the appeal as submitted. Mr. Berken seconded and the motion
carried. It was requested that Mr. Hartson appear before the
Board with a written estimate from the utility company of the
cost involved in moving the utility pole.
APPEAL 17-86 - KNIPPEL Mrs. Nievinski moved to approve
the appeal as submitted. r. rno seconded and the motion
carried. The hardship is the position of the house on the lot.
The addition would be an improvement to the neighborhood.
APPEAL 18-86 -STOECKMAN/MILLER Mr. Erno moved to deny
the appeal as submitted and approve e appeal with the following
changes. Maintain a 5' offset from the north lot line thereby
removing the request for this variance from the appeal.
Construct the garage with a maximum width of 20' thereby
maintaining a 4' distance between the house and garage, and movk,
the garage over 1' to the east lot line and align it to the rear
of the house. The house and garage should be the same distance
from the lake. The hardship is the location of the home on the
lot and the shape of the lot. Mrs. Nievinski seconded and the
motion carried.
ADJOURNMENT: Mr. Berken moved to adjourn the meeting at
:37P.M. Mr. Erno seconded and the motion carried.

The Board of Appeals wishes to adivse you that your appeal
as submitted was denied but would be approved with the following
changes:
Maintain a minimum of 5' offset from the north lot line
which removes the variance requested of 4' from north lot line.
The garage width shall be a maximum of twenty feet in width.
Relocate the garage to be in line with the rear of the house
which means the garage must be 1' closer to east lot line making
both the house and garage of equal distance to the lake on the
west side.
