The Building Inspection Department also wishes to extend their apologies for the misinterpretation of the requested storage shed. The request for the second garage structure will be on the Plan Commission agenda of July 5, 1988. Thank you. Sincerely, BOARD OF APPEALS Lynne Sweet Recording Secretary /ls CC: Gerald Fohr CITY OF MUSKEGO BOARD OF APPEALS MINUTES OF BOARD OF APPEALS MEETING HELD ON June 23, 1988 Chairman Gerald Fohr called the meeting to order at 7:30 P.M. PRESENT: - Chairman Gerald Fohr, Vice Chairman Carol Nievinski, Linda Koester, Vincent Caporali, Lloyd Erno, Terry O'Neil and Zoning Officer Gerald Lee ABSENT: Thomas Berken MINUTES: Mrs. Nievinski moved to approve the minutes of May 26, 1988. Mr. Erno seconded and the motion carried. APPEAL 14-88 - WALTER CHRISMAN Mr. Chrisman appeared before the Board to request a o set variance to construct a basement beneath their home. They are planning to put plumbing in the cottage and feel the basement would provide added insulation for the dwelling. Zoning Officer Lee explained that the structure was legal non -conforming because it was only 1' 4" from the lot line in the northwest corner. The improvement would not exceed 50% of the value and therefore would be allowed under the ordinance. They were cautioned to check on soil erosion fencing and the removal and distribution of the fill. Mr. Chrisman submitted letters of approval from his neighbors. APPEAL 15-88 - CLAYTON LEVERENCE Mr. Leverence appeared before the Board to request a set ac variance and a 3' offset variance to construct a garage on his property. The garage would be 12' X 22' and placed on the present blacktop area. The property faces a cul de sac and the slope of the land would require that the garage be placed in this area. APPEAL 16-88 - ROBERT WOLLMAN Mr. Wollman appeared before the Board to request a variance to put his structure 3' from the lot line. His original request had been misinterpreted by the building inspection department and a requested variance had been for 120 square foot size variance and a 3' 11" height variance. Mr. Wollman is constructing a 12' X 20' storage structure and does maintain the 10' offset requirement. The Board of Appeals remained in open session. APPEAL 14-88 Mr. Erno moved to approve the appeal as submitted. The hardship is the size and shape of the lot. Mrs. Nievinski seconded and the motion carried. APPEAL 15-88 Mr. Erno moved to approve the appeal as submitted. The hardship is the configuration of the lot. Mr. O'Neil seconded. Upon a voice vote the motion to approve carried with Mr. Caporali casting a dissenting vote and Mr. Fohr abstaining. APPEAL 16-88 Mr. Fohr moved to refund the appeal fee to Mr. Wollman because a variance was not necessary. Mr. O'Neil seconded and the motion carried. ADJOURNMENT Mrs. Koester moved to adjourn at 8:22 P.M. Mr. Erno secon e and the motion carried.
