Vice -Chairman Lloyd Erno called the meeting to order at 7:30 P.M. PRESENT: Vice Chairman Lloyd Erno, Carol Nievinski, Linda Koester, Peter Passick and Administrative Assistant Gene Kovacs ABSENT: Chairman Gerald Fohr, Vincent Caporali, Thomas Berken an ooing Officer Lee MINUTES: Mrs. Nievinski moved to adopt the minutes of the July 24, 19$67meeting. Mrs. Koester seconded and the motion carried. APPEAL 15-86 - WILLIAM SCHEARS Administrative Assistant Gene Kovacs explained the requirement for a 50' setback for any structure on a lot which abuts the lake. The proposed deck would be 37' from the water line and Mr. Schears is requesting a 13' variance. Mr. Schears had started construction on the deck when he was notified by the Building Inspection Department that he needed a permit. The proposed deck is approximately 24' X 34' and is approximately 20' above the water line. Mr. Schears stated that the lot is deep and sloping and for safety purposes it would be best to build a deck going down to the lake. APPEAL 15-86 - RAYMOND JESSMON Administrative Assistant Gene Kovacs explained that Mr. Jessmon was requesting a 16' setback variance for the east lot line as Mr. Jessmon's home was located on a corner lot which required 40' setback from both lot lines to construct a garage. Mr. Erno noted that there were no stop signs on Bristlecone Lane or Kipling Drive where the Jessmon home was located and that a garage could block the view from the traffice approaching this intersection. Mr. Jessmon mentioned that there was a yield sign on Bristlecone Lane. He also stated that he had previously gone before the Plan Commission to receive approval to build the garage in the northwest corner of his lot but was advised by the power company that this location was over a power company underground lateral and the accessibility of the power company to get to this lateral should the cable fail could be quite costly in repairs to the garage. Mr. Kovacs stated that the garage would not encroach upon the vision corner and that Plan Commission approval was contingent upon the Board of Appeals granting the variance. The Board remained in open session. Appeal 14-86-SCHEARS Mr. Erno moved to approve the appeal as submitted. Mrs-7-7-nester seconded and the motion carried. The hardship is the physical characteristics of the lot and the deep slope of the grade. Appeal 15-86-JESSMON Mrs. Nievinski moved to approve the appeal as submitted. Mr. Passick seconded and the motion carried. The hardship is the inability to locate garage on the power company easement. ADJOURNMENT: Mrs. Nievinski moved to adjourn the meeting at 7:58 P.M.
