BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON JUNE 28, 1990
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: - Chairman Gerald Fohr, Vice Chairman Terry O'Neil,
Thomas Berken, Bonnie Posbrig, Director Gerald Lee
ABSENT: - Lloyd Erno, Donald Pionek and Daryl Rowinski.
MINUTES:
Chairman Fohr requested that the name of the person
speaking for Ann Scheidler be inserted into the May 24, 1990
minutes. Mr. Lee said he would find out who the person was. Mr.
O'Neil made a motion to approve the Minutes of the May 24, 1990
meeting with that correction and Mr. Berken seconded. Upon a
roll call vote the motion to approve the minutes passed
unanimously.
APPEAL 14-90 - DEANNA LUEDTKE - Chairman Fohr read the
appeal for Deanna Luedtke, W188 S 3 Gold Drive requesting a 15'
setback variance and addition to a non -conforming structure. He
asked Mr. Lee to explain the RS-3 zoning. Mr. Lee stated the
honing is for single-family with a 40' setback from the base
setback line. The existing house is 10' from the base setback,
therefore, they need a 15' setback variance. Chairman Fohr
r@ quested Ms. Luedtke tell the Board what she would like to do
and her hardship. Ms. Luedtke responded she would tear part of
the building off and rebuild a bedroom suite, office and living
room with a full basement. There is a full basement under the
@xisting building. Mr. Lee questioned why she would need office
space in the home? Ms. Luedtke responded that she is not opening
a business out of her home -- the office is just for her use. A
comment was made that the addition is not in the way of the
well. She will match the simple white siding and roof line.
Chairman Fohr questioned where the missing house numbers were as
he had difficulty finding the correct address. It is an odd
shaped lot that following the old College Avenue. Mr. Berken
asked how many bedrooms? Ms. Luedtke responded after the
addition is finished there will be three with 2 1/2 baths. Her
hardship is providing housing for her adult son and possibly
grandson later. Chairman Fohr told Ms. Luedtke she could call
the Building Inspection office in the morning or wait for the
decision to be mailed to him within five days.
APPEAL 15-90 - RAY MARSH - Chairman Fohr read the appeal
for Ray Marsh,a Drive requesting a 7 foot offset
(w@stside) variance to construct an attached garage and storage
area. He asked Mr. Lee to explain the RCE zoning. Mr. Lee stated
that RCE zoning is rural country estates requiring a 40' offset
for a 250' wide lot. Chairman Fohr asked Mr. Marsh to state his

Mr. Ross said he needs a 10' variance because of the drainage in
the back of the yard which would require more concrete work. He
would have to build up the land -- he has a swale now. His
hardship is that the water runs away from Adrian Drive because it
is higher. Mrs. Posbrig asked Mr. Ross why he needs that size
garage? Mr. Ross responded that he works on cars -- he has 5
cars of his own. A neighbor, Dennis Krupa, S71 W19997 Tomar Lane
was present and stated he is happy Mr. Ross will maintain the 20'
setback especially since he will be working on cars. Mr. Berken
asked i there was any standing water on the lot? Mr. Ross said
there wasn't. There was more discussion about the cars to be
stored in the structure. Mr. Ross said he has 1 collector car, 1
boat, 2 relatives cars and 2 1967 cars. He doesn't intend to
store other people's cars. Chairman Fohr informed Mr. Ross he
could call the Building Inspection office in the morning or wait
for the decision to be mailed to him within five days.
APPEAL 19-90 - DAVE MICHLIG - Chairman Fohr read the
appeal for Dave Michlig, W 19 S7 2 Crowbar requesting a 278
square foot floor area variance to construct a new residence. He
said the Board was briefed on RCE zoning by Mr. Lee already and
he asked Mr. Michlig to state his intentions and hardship. Mr.
Michlig stated that the zoning is requiring him to overbuild in
the neighborhood. Mr. Michlig had Mr. Jeff Halbach, a design and
planning contractor prepare a letter listing homes in the area
which are under 1,800 square feet. (Mr. Halbach is also a
neighboring property owner) This letter was mailed to the BOA
members with their packets. Mr. Michlig stated that he will have
a small family living in the house. Mr. David Olson, W219 S7216
Crowbar Drive, a neighbor, said he had no problem with the house
being located in that spot. If he would add onto it, it would be
to the back. Mr. Michlig said his hardship is the size of the
existing homes in the area. Chairman Fohr informed Mr. Michlig
he could call the Building Inspection office in the morning or
gait for the decision to be mailed to him within five days.
The Board remained in Open Session.
APPEAL 14-90-LUEDTKE-After a brief discussion, Mr. Fohr
made a motion to grant the appeal as requested. The hardship
being the location of the existing house on the property. Mr.
O'Neil seconded. Upon a roll call vote the motion to adopt
passed unanimously.
APPEAL 15-90-MARSH-There was some discussion concerning the
large size of garage. The members felt that the old garage
and shed should be torn down within 6 months. Mr. Berken made a
motion to grant the appeal with the condition that the old garage
and shed be torn down within 6 months. The hardship being the
location of the existing house on the lot. Mrs. Posbrig
seconded. Upon a roll call vote the motion to adopt passed
unanimously.
