BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON JUNE 26, 1986
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Gerald Fohr, Thomas Berken, Carol Nievinski,
Vincent Caporali, Petter Passick
ABSENT: Vice Chairman Erno, Linda Koester
MINUTES: Mrs. Nievinski moved to adopt the minutes of the May
ZZ) 1986 meeting. Mr- Berken seconded and the motion carried.
APPEAL 13-86 - Dan Barker Mr. and Mrs. Dan Barker
appeared before the Board to request a variance of 148 square
feet minimum residential floor area for the purpose of
constructing a single family home. Mr. Barker stated that they
had purchased a 648 square foot home on this lot to remodel but
in the process discovered that the home was rotted beyond
saving. They wanted to build a two bedroom ranch home but being
located on an odd sized lot this plan would take up most of the
yard as zoning requirements state that they have to be 50 feet
from the channel. They could not construct the home sideways
because the well is in the center of the property. The Recording
Secretary read a memo from Zoning Officer Lee stating his
thoughts and opinions about the appeal. Chairman Fohr asked the
Barker's if they had contacted their neighbors regarding the
construction of the house. Mr. Barker stated that all the homes
in the neighborhood that abutted Jewel Crest were built on narrow
lots and most were below the minimum residential floor area
required.
The Board remained in open session.
Mrs. Nievinski moved to accept the appeal as submitted and wanted
the record to reflect that the Board felt that the applicants had
done an outstanding job in trying to utilize the space and
conditions of the lot to stay within the building regulations of
the zoning ordinance. The hardship is based on the position of
the well and the size of the lot. Mr. Berken seconded, and the
motion carried.
ADJOURNMENT -
Mr. Passick moved to adjourn the meeting at 7:50P.M. Mr. Berken
seconded and the motion carried.

were the subject of a quasi-judicial hearing; said cases being
the above listed appeals
The Board of Appeals will then reconvene into open session_
