Board of Appeals Meeting
MINUTES OF BOARD OF APPEALS MEETING HELD ON THURSDAY,
MAY 24, 1990.
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: - Chairman Gerald Fohr, Lloyd Erno, Donald Pionek,
Bonnie Posbrig and Director Gerald Lee.
ABSENT: Vice -Chairman Terry O'Neil and Thomas Berken and Daryl
Rowinski.
MINUTES:
Mrs. Posbrig made a motion to adopt the Minutes of the April 26,
1990 meeting and Mr. Pionek seconded. Upon a voice vote the
motion passed unanimously.
APPEAL 11-90, HELEN ANDERSEN - Chairman Fohr read the
appeal for Helen Andersen of S79 W 6087 Bay Lane Place requesting
a 4 1/2' northside offset variance, a 1' westside offset
variance, a 1/2' eastside offset variance, a 52' setback variance
to allow construction of a garage prior to erection of a
principle structure [Sec. 8.01 (7) B 1] in this RS-3/OED
District. He asked Mr. Lee to explain what RS-3/OED zoning
involves. He requested Mrs. Andersen explain her intentions and
hardship. Mrs. Andersen's son-in-law spoke in Mrs. Anderson's
behalf. She would like to build closer to the street with area
for storage in a one car garage. They have met with her new
neighbor to discuss this construction and would like to install a
culvert on Mrs. Anderson's property. Mr. Lee and Mr. Erno
discussed the possibility of providing a swale to control
water. Mr. Lee stated that there is a 15' easement to the
channel. Mr. Erno commented on the large 24' x 24' garage
size. Mrs. Andersen stated she will store a 12' boat in there.
Mr. Fohr said his main concern is the drainage problem. Mr. Lee
responded that they could put gutters on the garage and direct
the water to certain areas. Mr. Lee stated that this variance is
being requested because there is no principle building on the lot
now. There being no further discussion, the public hearing ended
at 9:00 P.M. Chairman Fohr told Mrs. Andersen she could call the
Building Inspection Office in the morning or wait for the
decision to be mailed to her within five days.
APPEAL 12-90, SCOTT J. SALENTINE - Chairman Fohr read
the appeal for Scott J. Salentine requesting a 2 1/2' northside
offset variance and a 45' setback variance from Bay Lane Place
and a variance to allow construction of a garage prior to
erection of a principle building in the RS-3/OED zoning. He
commented that Mr. Lee will not have to read the zoning
requirements since this request is near the first appeal. He

asked Mr. Salentine to state his intention and hardship.
Mr. Salentine stated that this was one lot but the road goes
through now creating two lots. He would like to build a long
garage on the extreme east end of the lot, so as not to block the
lake view of his neighbor. He will use this garage for
storage. It will have one overhead door on the front and another
on the side for access. Mr. Walter A. Heckendorf expressed
concern about the neighbor's view being blocked and showed
pictures of the site to the Board members. He felt there was
plenty of room on the other side of the road near the house.
Chairman Fohr commented that this area is tightly developed and
Mr. Salentine appears to be trying to improve his property so as
not to block the lake view. Ann Scheidler was present and
expressed concern about losing her lake view. There being no
further discussion the public hearing ended at 8:30 P.M.
Chairman Fohr told Mr. Salentine he could call the Building
Inspection office in the morning or wait for the decision to be
mailed to him within five days.
APPEAL 13-90, FRANK SWITALA - Chairman Fohr read the
appeal for Frank Switala requesting a 37' setback variance and a
variance for an addition to a non -conforming structure to
construct a residential addition including a porch. He asked Mr.
Switala to state his intention and hardship. Mr. Switala stated
that the "porch" would really be an open deck construction. They
are trying to save some trees and take the well location into
consideration. Chairman Fohr commented that it would be an
improvement to the neighborhood. There being no further
discussion the public hearing ended at 8:45 P.M. Chairman Fohr
told Mr. Switala he could call the Building Inspection office in
the morning or wait for the decision to be mailed to him within
five days.
The Board remained in Open Session.
APPEAL 11-90, HELEN ANDERSEN - Mr. Erno and Mr. Pionek
discussed the size of the property. Chairman Fohr discussed the
letter each Board member received from Mercedes Schaumberg
expressing her opinion that the appeal be denied. Chairman Fohr
made a motion to grant the appeal as requested. The hardship
being the road cuts off property to the small unbuildable lot.
Mrs. Posbrig seconded. Upon a roll call vote the motion to adopt
passed unanimously.
APPEAL 12-90, SCOTT J. SALENTINE - There was some
discussion about the garage door height being too high. Mr. Erno
felt they could dig into the ground and construct an 8' stud.
Mr. Erno made a motion to grant the appeal with the condition
that the elevation from the grade level be lowered to an 8' eve
height above the grade at the north side of the lot. The
hardship being the location and division of the land with the

road running between the properties. Chairman Fohr seconded.
Upon a roll call vote the motion to adopt passed unanimously.
APPEAL 13-90, FRANK SWITALA - There was a brief
discussion concerning the property. Mr. Pionek made a motion to
grant the appeal as requested. The hardship being the existing
building is a non -conforming structure and the location of the
well. Mrs. Posbrig seconded. Upon a roll call vote the motion to
adopt passed unanimously.
Misc. Discussion:
Mr. Lee reported that Mr. Larry Fischer has taken a permit out to
tear down the property before October 1990. It is still occupied
by tenants.
ADJOURNMENT:
Mr. Pionek made a motion to adjourn the meeting at 9:30 P.M. and
Mrs. Posbrig seconded. Upon a voice vote the motion to adjourn
passed unanimously.
