BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON May 25, 1989.
Vice Chairman Thomas Berken called the meeting to order at 7:30
P.M.
PRESENT: - Vice Chairman Thomas Berken, Terry O'Neil, Donald
Pionek and Director Gerald Lee
ABSENT: - Chairman Gerald Fohr, Lloyd Erno, Darryl Rowinski, and
Linda Koester.
MINUTES: Ruth White, S99 W12953 Loomis Road was present and
objected to the minutes of 12/8/88 and 4/27/89 as inaccurate.
She stated that she didn't come to reappeal at the 4/27/89
meeting. She requested answers from the Board of Appeals. She
requested a copy of the letter written by Mr. White referred to
in the 12/8/88 minutes. She again stated that she felt there was
no hardship in the Ronald Peuse Appeal 23-88
Vice Chairman Berken made a motion that the 4/27/89 minutes would
not be approved until this matter could be resolved. Upon a
voice vote the motion passed unanimously.
APPEAL 11-89 - DAVID R. BEIERLE - Mr. Beierle appeared
before the Board to request a offset variance to construct a
second story residential addition at W180 S7695 Pioneer Drive.
Mr. Lee stated that 5' is required and he is going within 1' of
the lot line with a 2' overhang. Mr. Vern Eders owns property
directly south and questioned how good the building is. He
detailed several structural concerns. Mr. O'Neil asked if the
whole building would have have meet the present code
requirements? Mr. Lee responded that the structure would have to
be brought up to code. Mr. Beierle stated that his hardship is
that the building cannot be sold as it is without improvements
and the location of the building on the lot.
APPEAL 12-89 - RAYMOND ZANGERLE - Mr. Ben Zangerle,
Mr. Zanger e s son who lives next door, was present to request a
5.6' offset variance to attach a new garage and breezeway at W192
S7586 Racine Avenue. Mr. Lee discussed the common driveway. The
Zangerle family owns all three lots. Mr. Zangerle stated that
his hardship was that he would like to provide a sufficient size
garage.
The Board took a five minute recess.

Mr. O'Neil moved to go into Closed Session pursuant to
Section 19.85 (1)(a) of the State Statutes for the purpose of
deliberating concerning cases which were the subject of
aquasidudicial hearing: said cases being the above listed
appeals. Mr. Berken seconded and the motion carried upon a voice
vote.
The Board of Appeals reconvened into open session at
9:20 P.M.
APPEAL 11-89 There was some discussion concerning the
condition of the building. Mr. O'Neil moved to approve the
appeal as submitted. The hardship is the limited land space and
the position of the structure on the lot. Mr. Pionek seconded
and the motion carried unanimously.
APPEAL 12-89 After some discussion Mr. O'Neil moved to
deny the appeal as submitted, as Mr. Zangerle was unable to
establish a hardship. Mr. Berken seconded and the motion carried
unanimously.
