ZBA-Minutes 05221986CITY OF MUSKEGO BOARD OF APPEALS MINUTES OF BOARD OF APPEALS MEETING HELD ON May 22, 1986 Chairman Gerald Fohr called the meeting to order at 7:30 P.M. PRESENT: Chairman Gerald Fohr, Vice Chairman Lloyd Erno, Thomas Berken, Carol Nievinski, Linda Koester, Vincent Caporali, Peter Passick and Administrative Assistant Gene Kovacs MINUTES: Mr. Erno moved to adopt the minutes of the April 24, 1986 meeting. Mr. Berken seconded and the motion carried. APPEAL 4-86 - GARY JANUSZEWSKI - Mr. Rick Kuckkahn appeared before the Board represen ing _r. Januszewski. He explained that he had been present at the Safety Committee meeting regarding this case and knew that the Safety Committee had stated that the driveway exiting onto Hardtke was not considered a hazard. Chairman Fohr explained that the Board members had viewed the site and questioned whether Mr. Januszewski would be willing to eliminate the concrete driveway already existing which exited on to Muskego Drive and if Mr. Januszewski would be in favor of cutting down the breezeway by two feet thereby requesting a 13 foot variance. Mr. Kuckkahn indicated that Mr. Januszewski would be in favor of the smaller breezeway and would not use the Muskego Drive exit. APPEAL 7-86 - LUTHERAN BROTHERHOOD Mr. Ron Walsh appeared before the Board of Appeals requesting a 11 3/4' setback variance to position a sign on his property. He explained that his clientele came from the surrounding areas of Brookfield, Waukesha, etc. and he would need a sign which could be seen from the road as his place of business was a nor. -conforming structure and was set back and could not readily be seen from the road. The sign would be free standing, non -illuminated, and plastic coated. He submitted a 4' x 6' sign and it was noted by Administrative Assistant Gene Kovacs that he would they: need a 9 square foot variance as the property was zoned B-3. Mr. Walsh stated he would be willing to put up a 3' x 5' sign so therefore would not need the additional 9 square foot variance. APPEAL 8-86 - SELMER & DIANE KJRS Mr. and Mrs. Kjrs appeared before the Board and requested a variance of 38 'front setback. They are located on a non -conforming lot and cannot put their driveway off of Jewel Crest Drive. They will maintain a 15'distance between the house and garage. The ratio of the garage to the house is in conformance with city code. If the garage was located in any other part of the lot they would not be visually able to see the traffic coming around the curve on Jewel Crest. APPEAL 9-86 - DAVID A. STRANDBERG Mr. and Mrs. Strandberg appeared before the Board requesting a 2'4" variance from the north lot line and a 3.53' offset variance from the south lot line to build an 8' second story addition on to their house. The house is a legal non conforming structure with the lot being very narrow. The addition would not infringe any more over the lot line than the house presently does. The Strandberg's have discussed this addition with their neighbors who were in favor of the addition. APPEAL 10-86 - ROBERT KLENZ Mr. Klenz appeared before the Board requesting a 201 fronY­s­e`Eback variance to permit a business sign to be located in the setback area. He explained that he would now be located in the old Wisconsin telephone company building and they did not allow signs to be placed on the face of the building. The sign requested was 3' x 5' and would be routed and wood carved with perhaps a canopy with spot lighting effect. An attorney and insurance agent would also be tenants in this building and their names would be added to the sign. eventually. He needs to be located near the road so that patrons can view the sign coming from both the east and west as other signs already positioned on Janesville Road would obstruct vision. APPEAL 11-86 - RIC REIMER Mr. and Mrs. Reimer appeared before the Board requesting a 13' variance in setback to construct a 20' x 20' addition to their home. The great room as they called it would be a recreation/family room. Mr. Kovacs mentioned that this non -conforming structure was in the flood plain and would require the Reimer's to follow any regulations stated by the DNR. Chairman Fohr stated that we would also need a variance for the lake setback. He questioned that Reimer's as to whether they would be able to build the addition approximately two feet smaller in order to have the addition in line with the house. The Reimer's indicated they could do this. APPEAL 12-86 - JEFF GOTTFRIED Mr. Gottfried appeared before the Board to request a 1' o set variance and a 66 square foot floor area ratio variance to construct a 20' x 36' garage for storage. He is requesting to locate the garage sideways on the property in order to have a turnaround in the driveway. The location of the garage or, a sideways angle would enable the Gottfried's to see traffic coming on to the property. Chairman Fohr asked Mr. Gottfried whether the shed already on the property could be torn down. Mr. Gottfried replied that his intention was to tear down the shed and build the garage. Mr. Berken moved to go into Closed Session pursuant to Section 19.85 (1) (a) of the State Statues for the purpose of deliberating concerning cases which were the subject of a quasijudicial hearing: said cases being the above listed appeals. Mr. Caporali seconded and the motion carried. The Board of Appeals reconvened into open session. APPEAL 4-86 - GARY JANUSZEWSKI Mr. Passick moved to deny the appeal as submitted. Mrs. Koester seconded and the motion carried. APPEAL 7-86 - LUTHERAN BROTHERHOOD Mr. Berken moved to deny the appeal as submitted but grant the appeal for an 11 3/4' variance contingent upon the petitioner positioning a 3' x 5' sign on his property. The hardship being the location of the business on the lot. Mr. Erno seconded and the motion carried. APPEAL 8-86 - SELMER & DIANE KJOS Mr. Erno moved to approve the appeal as submitted. Mr. Caporali seconded and the motion carried. The hardship is the shape of the lot and the location of the non -conforming structure on the lot. APPEAL 9-86 - DAVID A STRANDBERG Mrs. Koester moved to approve the appeal as submitted. Mr. Erno seconded and the motion carried. The hardship is the narrow shape of the lot and the existing first floor of the non -conforming structure. APPEAL 10-86 - ROBERT KLENZ Mrs. Nievinski moved to approve t e appeal as submitted. rs. Koester seconded and the motion carried. The hardship is due to the setback of the existing building and a sign is needed closer to the road for business purposes. APPEAL 11-86 - RIC REIMER Mr. Fohr moved to deny the appeal as submitted u o grant e variance of 13 feet in setback and a 30 foot variance from the lake contingent upon building the addition flush with the side of the house already built and in accordance with any DNR regulations. Mr. Passick seconded and the motion carried. The hardship is due to the fact of the narrow lot and the location of the home on the lot. APPEAL 12-86 - JEFF GOTTFRIED Mr. Fohr moved to approve the appeal as submitted contingent upon the metal shed being removed upon completion of the garage. Mr. Caporali seconded and the motion carried. The hardship is due to the narrow width of the lot and the size of the home. ADJOURNMENT Mr. Erno moved to adjourn at 9:50 P.M.
