BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON April 23, 1987
Vice Chairman Berken called the meeting to order at 7:30 P.M.
PRESENT: Vice Chairman Thomas Berken, Lloyd Erno, Carol
Nievinski, Linda Koester, Vincent Caporali, Peter Passick, and
Zoning Officer Gerald Lee.
ABSENT Chairman Gerald Fohr
MINUTES Mr. Erno moved to approve the minutes of the March 26,
19 7 meeting. Mr. Caporali seconded and the motion carried.
APPEAL #8-87 - JEFFREY BRENDEMIHL Mr. Brendemihl
appeared before the Board to request a 7' separation variance
between his house and detached garage. The building code
requires a 5' separation variance with a fire wall. He would
need a zoning variance of 10' between the garage and house and
the area between house and garage is currently 3' therefore his
request for a 7' variance. During discussion Mr. Brendemihl
stated he could move his garage back and still maintain the
required offset of 7 1121. At this point he would have to
firewall and maintain 5' between the house and garage to be in
conformance with the building code. Mr. Brendemihl indicated he
would move the garage back in order to comply with the 7 112'
offset.
APPEAL #9-87 - INSTRUMATICS A representative of
Mainstream Signs appeared before the Board to request a variance
of 19 112 square feet for a flat wall sign. The building is 17'
high and 50' long and the maximum space allowable for a sign in
this I-1 district was about 21 square feet. The sign is already
on the building. The maximum allowable in the I-1 district is 3%
of the wall area upon which the sign is placed. Zoning Officer
Lee stated that he had proposed an amendment to change the
regulations for signage to 5% (the same as in the B-2
district). The Plan Commission approved and the public hearing
is set for May 12. If this change is made, the Board of Appeals
will not have to address this appeal. Mr. Erno motioned to defer
the appeal for one month. Mr. Passick seconded and the motion
carried.
APPEAL #10-87 - JEFF MUETZELBURG Mr. Muetzelburg
appeared before the Board to request a 4' offset variance to
allow an existing storage structure to be located 6' from the
side lot line. Mr. Muetzelburg had requested a permit for a 10'
X 12' shed. Structures under 120 square feet are allowable up to

3' from the lot line. Mr. Muetzelburg constructed a log shed
with the logs being 1' or more in diameter which made the
constructed shed larger than allowed. The shed now becomes a
second garage structure and has to maintain the offsets and
setbacks of the RSA/OPD zoning district which requires 10' from
the lot line.
The Board remained in open session.
APPEAL #10-87 Mr. Berken moved to approve the appeal as
submitted. Mrs. Nievinski seconded and the motion carried. The
hardship is the misunderstanding in the type of materials used in
construction.
APPEAL #8-87 Mr. Passick moved to deny the appeal as
submitted but to grant the variance of 51to satisfy the zoning
ordinance requirement and move the building back to comply with
the offset of 7 112' to satisfy the building code requirement of
5' between the garage and house and satisfy the code pertaining
to fireproofing the garage. The hardship is the location of the
existing building.
ADJOURNMENT: Mr. Passick moved to adjourn at 8:12 P.M. Mr. Erno
seconded and the motion carried.
