BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON May 26, 1988
Chairman Gerald Fohr called the meeting to order at 7:35 P.M.
PRESENT: - Chairman Gerald Fohr, Vice Chairman Carol Nievinski,
Thomas Berken, Vincent Caporali, Terry O'Neil and Gene Kovacs
ABSENT: Linda Koester, Lloyd Erno
MINUTES: Mrs. Nievinski moved to approve the minutes of April 28,
1988. Mr. Caporalli seconded and the motion carried.
APPEAL 9-88 RALPH HEACOX Mr. Heacox appeared before the
Board to request a setback variance to construct a
detached garage. He would remove the existing non -conforming
garage situated 6' from the edge of the road. The zoning
requires that the garage be placed 19' from the lot line and 10'
from the house.
APPEAL 10-88 JOHN/DEANNA GNAS Mrs. Gnas appeared before
the Board to request a 6 1 o set variance to construct a new
garage/storage structure 24' X 40' (10 foot storage area). The
lot is 50' wide and they are requesting to put the garage to
within 1 foot of the lot line. The zoning would require an
offset of 7 1/2 feet from the lot line. They would use Denoon
Point Road as the access to the garage and not the drive on their
property.
APPEAL 11-88 RANDY WEGENER Mr. Wegener appeared before
the Board to request an 1 offset variance to allow an existing
home to be relocated at 1.4162 S7913 Bay Lane.
APPEAL 12-88 JILL'S CLEANERS Mr. Fitzgerald appeared
before the Board with an amended site plan for a proposed
addition of approximately 857 square feet which would require the
10' offset variance but would not require the 23' setback
variance requested. Mr. Claude Miller stated that this addition
would be 20' from his home. Discussion followed with regard to
what businesses would come in and the demand a particular
business would have for parking area. The applicant stated that
the requirement for parking spaces could be met in part by using
the portion of parking which is designated for Damaske
Electric. Mr. Damaske now has a reduced demand for parking
because of a reduction in his retail service area.
APPEAL 13-88 JAMES WIESNER Mr. Wiesner appeared before
the Board to request a 15 setback variance to construct a new
garage. Mr. Wiesner's new garage would be less than 30' from the
center of the road due to the sharp decline in the lot.

Mr. O'Neil moved to go into Closed Session pursuant to Section
19.85 (1) (a) of the State Statues for the purpose of
deliberating concerning cases which were the subject of
aquasidudicial hearing: said cases being the above listed
appeals. Mr. Berken seconded and the motion carried.
The Board of Appeals reconvened into open session at 9:40 P.M.
APPEAL 11-88 Mr. Fohr moved to deny the appeal as
submitted but grant the appeal for an 11" setback variance from
the north side of Bay Lane. The hardship is the house which is
already constructed and being relocated. Mr. Berken seconded and
the motion carried.
APPEAL 9-88 Mrs. Nievinski moved to approve the appeal
as submitted. The hardship is the position of the house on the
lot and the configuration of the lot. The old garage is to be
taken down within six months of the date of this appeal. Mr.
Berken seconded and the motion carried.
APPEAL 10-88 Mr. O'Neil moved to approve the appeal as
submitted upon c ari ication as to whether the required setback
from Denoon Point Road is met and if they can use this road for
entrance to their property. If a setback from Denoon Point Road
is required the appeal will have to be resubmitted. The Board
has also requested that the outhouses on this road be checked
out. Mrs. Nievinski seconded and the motion carried.
APPEAL 12-88 Mrs. Nievinski moved to deny the appeal as
submitted. Mr. Berken seconded and the motion carried.
APPEAL 13-88 Mr. Berken moved to approve the appeal as
submitted. The hardship is the slope of the land and elevation
of the property. Mr. O'Neil seconded and the motion carried.
ADJOURNMENT Mrs. Nievinski moved to adjourn at 9:55 P.M. sir.
Berken seconded and the motion carried.
