Zoning Board of Appeals- - Minutes 09/26/1985CITY OF MUSKEGO BOARD OF APPEAL MINUTES OF MEETING HELD SEPTEMBER 26, 1985. Chairman Fohr called the meeting to order at 7:30 P.M. PRESENT: Chairman Gerald Fohr, Lloyd Erno, Thomas Berken, Carol Nievinski, Vincent Caporali, and Deputy Inspector Donald Simon. ABSENT: Estel Ellery and Linda Koester MINUTES: Mrs. Nievinski moved to approve the minutes of the previous meeting of August 22, 1985. Mr. Erno seconded and the motion carried. APPEAL 85-9 - MARCELLA RANSON - Mrs. Hanson appeared before the Board to request a 25 variance in setback for the purpose of constructing a house with an attached garage. The hardship is that she cannot build in a flood plain area. Mr. Simon reported the proposed dwelling, located in an RS-3 OED district, requires a 40 foot setback from the base setback line located 30 feet from the center line of Jewel Crest. The dwelling is proposed to be 15 feet from the base setback line. Also, with the area being in the flood fringe, the basement floor should be at or above the flood elevation, which is 796. Mr. Fred Bauer and Mr. Dick Foster, neighbors, spoke in favor of the new construction saying they felt it to be an improvement. Mrs. Hanson said she has lived on the property for 29 years, and has never had a flooding problem, even when the Linnie Lac dam broke. Mr. Erno said the house could be moved 8-10 feet closer to the channel, off the road and have a larger driveway. Mr. Berken pointed out that Mrs. Hanson might consider another design or placement of the house on the lot, because the amount of fill needed could be quite costly. Mr. David Fetter, an adjoing neighbor, said he had no objection to the fill being placed on his side of Mrs. Hanson's lot because his slope is just as steep. The Board remained in open session APPEAL #85-9 - Chairman Fohr moved to deny the appeal as submitted, but to grant a 15 foot variance in setback for the purpose of constructing a house. The hardship due to the slope of the lot. Mr. Erno seconded and the motion carried. ADJOURNMENT: Mrs. Nievinski moved to adjourn the meeting at 8:30 P.M. Mr. Berken seconded and the motion carried.
