Zoning Board of Appeals- - Minutes 04/28/1988CITY OF MUSKEGO BOARD OF APPEALS MINUTES OF BOARD OF APPEALS MEETING HELD ON April 28, 1988 Chairman Gerald Fohr called the meeting to order at 7:30 P.M. PRESENT: - Chairman Gerald Fohr, Vice Chairman Carol Nievinski Linda Koester, Vincent Caporali, Llovd Erno, Terry O'Neil and Zoning Officer Gerald Lee ABSENT: Thomas Berken MINUTES: Mr. Erno moved to approve the minutes of March 24, 1988. Mrs. Nievinski seconded and the motion carried. APPEAL 5-88 DAVID HUNT fir. & Mrs. Hunt appeared before the Board to request an offset variance of 5' to construct a detached garage. The Hunt's were provided with a letter sent in by Mr. & Mrs. Ogrodzinski, their neighbors. The Hunt's explained that the garage placed within 10' of the property line would line up with the driveway and they would not be blocking off the view of their dining room windows. They will be using the 22' X 26' garage for storage. They do not have an attached garage. APPEAL 6-88 GREGG BOEHM Pamela Boehm Rieder and Gary Boehm appeared before the Board to request an offset variance of 5' to allow a new home to be built on a lot_ in Meadow Green Subdivision. The propective owner wants to construct a home that would measure 80' in Length and would need a five foot variance using a 46' setback. APPEAL 7-88 RICHARD KNUDSEN Mr. Knudsen appeared before the Board to request a 4 offset variance to construct a storage structure with a playhouse on the top. He explained that he had an irregular shaped lot that drops very abruptly downhill which makes a large portion of the lot unuseable. Mr. Lemke, a neighbor questioned whether a variance would need to be reapplied for should 'fr. Knudsen decide to expand the structure. He was assured that a variance would need to be reapplied for if the shed was taken down and a new structure put up. Mr. Knudsen indicated he would not be willing to turn the structure around and thereby not require a variance due to the fact that the railroad ties were already arranged. APPEAL 3-88 `dICHAEL MEHRING Mr. & Mrs. 'tehring appeared before the Boar( to request a oTTset variance to construct a detached 30' X 24' garage. They stated a patio would have to he removed and replaced and an apron needed to be attached if the garage were placed behind the dwelling. They would use the structure for cars and storage for themselves and their tenant. They have a 90' driveway where the cars are now parked. APPEAL 4-88-MUSKEGO MARINE It was clarified that Mr. Langfeldt had withdrawn his request for a 7' variance. APPEAL 5-88 DAVID HUNT Mrs. Nievinski moved to deny the appeal as submitted. Mr. 6-Neil seconded and the motion carried. It was suggested that the garage could be situated further back on the property and thereby placed within the offsets required of this zone district and that a hardship had not been established. APPEAL 6-88 GREGG BOEHM Mr. Erno moved to deny the appeal as submitted. Mrs. Koester seconded and the motion carried. It was suggested that the architectural control committee allowed the developer to control the sizing of the houses on individual lots before construction. No hardship had been established due to the fact that the home is not constructed as yet. APPEAL 7-88 RICHARD KNUDSEN Mrs. Nievinski moved to deny the appeal as submitted. Mrs. Koester seconded and the motion carried. It was suggested that Mr. Knudsen could construct the structure without having to request a variance if placed differently on the lot. APPEAL 8-88 MICHAEL MEHRING itr. Fohr moved to deny the appeal as submitted. Mr. apora i seconded and the motion carried. It was suggested that the large amount of unused back vard would allow ample room to put up a garage further to the rear. ADJOURNMENT: Mrs. Nievinski moved to adjourn at 9:40 P.M. Mrs. Koester seconded and the motion carried. We are planning to build a 30'x 24' garage for our vehicles, house & lawn mainten- ance equipment, and a vehicle stall for our tenants. When evaluating our survey with required offsets, we discovered it will be nearly impossible to maneuver our vehicles into the garage. We are therefore requesting your assistance in granting us a small variance on our lot line offset. For reasonable acessibility to our garage with respect to our lot configuration we are requesting a variance to build 10 feet from the lot line. (Please see plot survey at this time). As illus- trated on the survey, the area in question reduces to a point of compliance with the required offset. The affected area would be only 43 square feet. Ile have listed below several factors in support of our appeal. 1'�'e hope that you will consider these factors not just as single issues, but as an entire group when making your decision. -Removal of existing concrete patio. -Replacement of patio. -Minimum addition of 18' x30' apron. -Addition of a retaining wall. -Double the amount of fill needed for construction. -Increases driveway length from 90' to 108'. -General structure placement aesthetics -Reduced openness of yard & greatly deminished view out into the vard from inside the house. We trust that you will understand how we are trying to best serve the existing situation by utilizing our property most efficiently.
