BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON March 26, 1987
Vice Chairman Berken called the meeting to order at 7:30 P.M.
PRESENT: Vice Chairman Berken, Carol Nievinski, Vincent
Caporali, Lloyd Erno and Administrative Asst. Gene Kovacs.
ABSENT Chairman Gerald Fohr, Linda Koester, Peter Passick and
Zoning Officer Lee.
MINUTES Mrs. Nievinski moved to approve the minutes of the
February 26, 1987 meeting. Mr. Erno seconded and the motion
carried.
APPEAL 5-87 - Mark Koenig Mr. Mark Koenig appeared
before the Board of Appeals to request an 8' offset variance from
the east lot line to construct an addition to an existing storage
structure. Mr. Koenig had received a permit for the existing
storage structure in 1985 and decided to fence the east side and
extend a sloping roof to shield wood, etc. from the weather
creating a carport affect. He had constructed the roof
approximately one month age. The deputy inspector noticed this
and informed Mr. Koenig he would have to appeal for a variance
because he was too close to the lot line. The other side of the
building has windows and if enclosed could not be utilized. The
existing structure is used for the applicant's hobby of wood
workings. The addition would be for storage of wood, tires, etc.
APPEAL 6-87 - Paul Brody Mr. Paul Brody appeared before
the Board of Appeals to request a 4" north side offset variance
and a 1' south side offset variance to construct a principal
residential dwelling on the property. Mr. Brody is the builder;
the owner is in Florida. Mr. Kovacs explained that the dwelling
would have to be 3' from one lot line and 5' from another lot
line on this non -conforming lot. All new construction is
required to maintain the zone district offsets. Mr. Bagley, the
neighbor to the north expressed concern regarding drainage from
the house onto his property and the correct lot line stakes
fronting the road on the properties in the neighborhood. He
requested the drainage be diverted to the lake. Alderman Harold
Sanders was present and stated no one had approached him with any
objections to the dwelling.
APPEAL 7-87 - Phillip Dibb Mr. Dibb appeared before
the Board of Appeals to request a 5' 10" south setback variance
to construct a building addition to the front of his home
(bedroom area). Mr. Kovacs explained the home was on a corner

lot requiring a 40' setback from each street. The addition would
be 7' to'the bedrooms along 28' of the home. The roof would be
extended and a full basement added with the addition to match the
existing brick and stucco. The appellant could not add a second
story because of subdivision deed restrictions.
The Board remained in open session.
APPEAL 5-87 Mrs. Nievinski moved to approve the appeal
as submitted. r. Erno seconded and the motion carried. The
hardship is the location of the existing shed on property.
APPEAL 6-87 Mrs. Nievinski moved to approve the appeal
as submitted. Mr. Berken seconded and the motion carried. The
hardship is the size and shape of the existing non -conforming
lot.
APPEAL 7-87 Mr. Berken moved to approve the appeal as
submitted. Mr. Erno seconded and the motion carried. The
hardsh_p is the location of dwei-Ling and that there is no other
alternative direction for construction of the addition.
ADJOURNMENT: Mr. Berken moved to adjourn the meeting at 3:30
P.M. Mr. Caporali seconded and the motion carried.

residence, W149 S7594 Dorothy Drive.
In order to obtain a variance of 6 feet, from the City's
Building Code, all local neighbors must show no objection to
such a change.
Therefore, we are asking you to sign this petition, on our
behalf, if you have no objection to the granting of the 6
foot variance.
