BOARD OF APPEAL
MINUTES OF MEETING HELD AUGUST 22, 1985
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Gerald Fohr, Vice Chairman Thomas Berken Estel
Ellery, Lloyd Erno, Carol Nievinski, Vincent Caporali, and Zoning
Officer Gerald Lee.
ABSENT: Linda Koester
MINUTES: Mr. Erno moved to approve the minutes of the previous
meeting of July 25, 1985. A correction changing Mr. Nievinski to
Mrs. Nievinski in the motion to adjourn was noted. Mr. Ellery
seconded and the motion carried.
APPEAL 85-7 - CARL GRATZEK - Mr. Gratzek appeared before the
Board to request a variance o 25' in setback to construct a 24'
x 24' garage. He felt his hardship is the topography of the lot,
and difficulty in snow removal. He has had no neighbor
objections. Zoning Officer Lee said this is an RS-3 OED
district, this property having an average setback of 65 feet, 40
feet from the center of the road. Mr. Gratzek said the
neighborhood is 50 to 60 years old, and any size home would have
been a problem on the lot, and rather than remove a 40' walnut
tree, he set the house back 7-8 feet, also taking into
consideration an 8 foot deck in the rear of the house. Mr.
Ellery pointed out that the Building Inspector was not notified
of the change in plan, and that the Board does not consider a
tree a hardship. There was discussion on having a smaller
garage. Zoning Officer Lee pointed out there are many different
styles of homes with garages that can be layed out on any sized
lots. Chairman Fohr said Mr. Gratzek should have advised the
Building Inspector of moving the house back, and he should have
come to the Board before the home was built, as Mr. Gratzek
created more of a hardship than was existing. Mr. Ellery said
the house could have set in another direction with an attached
garage, and the variance needed would have only been 3 feet.
APPEAL 85-8 - ZENITH OGRODZINSKI - Mr. Gilbert Spieler, a
neighbor, explained he was against the request for a one foot
variance in offset to construct an addition. The addition would
be toward his lot. Since Mr. Ogrodzinski was not present, Mr.
Berken moved to defer the appeal. Mr. Ellery seconded and upon a
voice vote, the motion carried.
Mr. Ellery moved the Board go into closed session pursuant to
Section 19.85 (1) (a) of the State Statutes for the purpose of
deliberating concerning cases which were the subject of a
quasijudicial hearing: said cases being the above listed
appeals. Mrs. Nievinski seconded the motion and the motion
carried.

The Board of Appeals reconvened into open session at 8:55 P.M.
APPEAL #85-7 - CARL GRATZEK - Mr. Ellery moved the appeal be
denied as submitted and granted that a garage attached to the
house must meet the offset from the lot line of the garage. Mr.
Erno seconded and the motion carried.
APPEAL #85-8 ZENITH OGRODZINSKI - Mr. Ogrodzinski, who was
delayed, appeared before the Board to request a one foot variance
in offset on the east lot line to construct a 12' x 32'
addition. He explained without the one foot variance there would
be plumbing problems, and he wouldn't be able to maintain the
same roof line. Zoning Officer Lee said this is an R3-OED
district, and this addition would be in line with the principle
building. Mrs. Nievinski moved to approve the appeal as
submitted, the hardship being the plumbing and lay of the home on
the existing lot. Chairman Fohr seconded, and the motion
carried.
ADJOURNMENT: Mrs. Nievinski moved to adjourn the meeting at 9:15
P.M. Mr. Ellery seconded and the motion carried.
