BOARD OF APPEAL
MINUTES OF MEETING ON JULY 25, 1985
Chaiman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Fohr, Lloyd Erno, Vincent Caporali, Estel
Eery, Linda Koester, Carol Nievinski, and Zoning Administrator
Gerald Lee
ABSENT: Vice Chairman Thomas Berken
MINUTES: Mr. Ellery moved to adopt the minutes of the previous
meeting of June 27, 1985. Mrs. Nievinski seconded and the motion
carried.
Chairman Fohr introduced the Board's new member, Vincent
Caporali, and gave a brief summary of the Board's functions, and
responsibilities.
APPEAL #85-6 - Gary Januszewski - Mr. Januszewski appeared
before the Board to explain his hardship is the size of his
corner lot on Muskego and Hardtke Drives, which is non-
conforming. The proposed placement of the garage, facing Muskego
Drive, would provide sufficient parking, and easier access as
backing onto Muskego Drive is hazardous. Zoning Officer Lee
explained this is an RS-3 (OLS) District requiring a 25' setback
or 55' from the center of Muskego Drive. Mr. Januszewski needs a
20.5' setback, 2' in offset from the northwest lot line, and 3'
from the principle structure to build a detached 22' x 22'
garage. Neighbors, Mr. Terry Asti and Mr. Paul Ciardo, spoke in
favor of the garage in this location. Mr. Erno spoke to another
neighbor, Mr. Spieler, who although was not in favor of the
garage, would agree to it, to be a good neighbor. Mr. Erno also
said the driveway is already squared off as though the garage is
going to be placed in the location as proposed. Mr. Fohr pointed
out there was a denial of a previous appeal in 1983, for a 22' x
22' detached garage, but the Board did grant a variance of 5' in
setback, and that there would be no access to Hardtke Drive.
Zoning Administrator Lee said, there can be access to any City
street. Upon questioning by Mr. Ellery, Mr. Januszewski said he
did not plan for the garage when the driveway was put in, but
planned the driveway so he would not have to back out onto
Muskego Drive. Alderman Hilt appeared before the Board to
explain he spoke to Mr. Spieler, who said he was concerned that
Mr. Januszewski would complete the garage and then sell the
house.

APPEAL #85-6 - GARY JANUSZEWSKI - Chairman Fohr moved the
appeal be denied as submitted, iase3 on the present location of
the lot and the narrow lot, but granted the following conditions.
A. Approve the previous decision of 1983
B. Put the garage 'between the house and channel with the
entrance of the garage on Hardtke Drive to alleviate
traffic on Muskego Drive, and grant a variance no closer
to Hardtke than the existing home.
ADJOURNMENT: MrS Nievinski moved to adjourn the meeting at
8:40 P.M.- l rs pester seconded and the motion carried.

(3) 6. that a public hearing will be held at the Muskego City
Hall, W182 S8200 Racine Avenue, at 7:30 P.M., Thursday, July 25,
1985 to consider the following appeals:

Requesting a variance of 20.5' in setback, 2'
in offset from the northwest lot line, and 3'
from the principle building for the purpose of
constructing a 22' x 22' garage.
OTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that the Board of Appeals of the City of
Muskego will convene, upon passage of the proper motion, into
closed session pursuant to Section 19.85 (1) (a) of the State
Statutes for the purpose of deliberating concerning cases which
were the subject of a quasi-judicial hearing; said cases being
the above listed appeals
The Board of Appeals will then reconvene into open session.
Detailed descriptions are available for public inspection at the
Clerk's office. All interested parties will be given an
opportunity to be heard.
