request for an 18 1/2 sq. ft. variance to erect a
flat wall sign was denied and an amended variance of
10', limiting the sign to 4'8" in height and 7710"
in width was approved at their rueeting held Thursday
evening, April 26, 1984.
Eiease obtain a building permit from, the Building
Inspection Departnent prior to installation.

MINUTES OF MEETING HELD APRIL 26, 1984
Chairman Harry Smet called the meeting to order at 7:30 P.M.
PRESENT: Chairman Harry Smet, Vice Chairman Gerald Fohr, Estel
E ery, First Alternate Thomas Ber ken, Second Alternate Carol
Nievinski, and Zoning Administrator Gerald P. Lee.
ABSENT: Whitney Grant and Lloyd Erno.
MINUTES: Mr. Fohr moved to approve the minutes of the previous
meeting of March 22, 1984. Mr. Ellery seconded the motion and
the motion carried.
APPEAL #84-5 - Mrs. Banich appeared before the Board
requesting a variance of 4.2' in offset and a variance of 192 sq.
ft. from the Zoning Ordinance which limists the size of garage tc
60% of the floor area of the principal building to construct a
detached garage.
Zoning Administrator Lee reported that this property is in a
RS-2 district with an OLS overlay which requires a 10' offset
on one side. This is a legal non -conforming lot with a 52'
average width which is 72% of the required amount. Taking 72% of
10' would be 7.2'. They propose to set it 3' from the lot line
leaving a variance needed of 4.2'. The size of the garage
exceeds the 60% requirement.
Mrs. Banich stated that they would like to put it where a
shed is presently located. It was noted that the sewer easement
is fairly close to the middle of the lot.
Mr. Fohr questioned Mrs. Banich regarding the present garage
at the entrance road to the property and Mrs. Banich stated that
it would be taken down and eventually the shed. The shed is
approximately 8' x 10'. Mr. George Grigg, a neighbor to the west
stated that he was opposed to both requested variances.
After further discussion, Mr. Fohr moved to defer the appeal
until Mr. Banich could be present and provide more information.
Mr Ellery seconded the motion and the motion carried.
APPEAL #84-6 - Mr. Wayne Bushberger appeared before the
Board requesting an 18 1/2 sq. ft. variance in order to erect a
flat wall sign on his business.
Zoning Administrator Lee explained that he is allowed to
have a sign no larger than 5% of the size of the wall. He is
proposing a 9.4' x 5' sign which is 47' sq. ft. and the allowable
for his wall would be 28.5%.
Mr. Bushberger explained that the sign was made to cover a
window that has been paneled over in the inside. The sign covers
the complete window. Mr. Ellery stated that the sign is in

Upon further discussion, Mr. Ber ken moved to deny the appeal
as submitted and to grant a variance which limits the sign not to
exceed 4'8" in height or 7'10" in width, which would be granting
a 10' variance. The hardship being the existing block window.
Mr. Fohr seconded the motion and the motion carried with Mr.
Ellery casting the only dissenting vote.
APPEAL #84-7 - Mr. Kien,zle did not appear at the meeting.
Mr. Smet moved to defer the appeal until Mr. Kienzle could appear
and requested that all neighbors be renotified of the meeting.
Mr. Ellery seconded the motion and the motion carried.
APPEAL #84-8 - Mr. Merfert appeared before the Board
requesting a t. variance in setback in addition to the
previously granted variance of 6' to permit the erection of a
freestanding sign.
Zoning Administrator Lee reviewed with the Board the
previous appeal and court action that has occurred since the
original appeal.
Mr. Herfert stated that he would like to mount it on the
large rock with two poles into the ground as stakes. Mr. Merfert
agreed that the sign on the east lot line will be removed at that
time.
After further discussion, Mr. Suet moved to grant the 6'
variance to allow the sign to be put on the rock, the hardship
being the location of the building and the traffic pattern in the
area. Mr. Fohr seconded the motion and the motion carried.
APPEAL #84-9 - Mr. and Mrs. Cavazos appeared before the
Board reqesting a 5.6' variance from existing garage to permit
construction of a 24' x 26' dwelling at W182 S6545 Muskego Drive,
along with their Agent, Mr. George M&ilewsnic.
Zoning Administrator Lee reported that this property is in
an RS-3(OLS) district. There is an existing garage and they
propose to construct a two-story dwelling. The size of the house
will be 26' x 24' with the proper offset off the southeast lot
line placing them too close to the existing detached garage. The
code requires 10' between the garage and the dwelling and the
Building Code requires 5' if there is a firewall. The proposed
plans would leave 4'4" between the buildings.
The present garage is in violation of the code, but is legal
nonconforming.
The Board questioned whether any thought had been given to
attaching the garage, thereby eliminating the need for the
variance. Mr. Milewsnic stated that they were not sure if there
was proper footing under the garage. After further discussion,
the Board felt that an investigation should be made to determine
whether the garage had adequate footing and whether it would be
feasible to attach the garage to the proposed residence, and also
to check and na ke sure that the well is adequate.
