MINUTES OF BOARD OF APPEALS MEETING HELD ON MARCH 25, 1993.
Vice -Chairman Don Pionek called the meeting to order at 7:30 p.m.

MINUTES: Mr. O'Neil made a motion to approve the minutes of the
February 25, 1993 meeting, with the correction of the
word "home" after nursing in Appeal #5-93. Mr. Vitt
seconded. Upon a voice vote, the motion to adopt the
minutes passed unanimously.
APPEAL #10-93 - Peggy L. Prokop, S70 W17495 Forest Dr., Muskego,
Wisconsin, 53150, appeared requesting a variance from 17:8.08(3)
to allow a 2'0" sideyard offset requiring a 7'-5" variance from
the requirement of 9'-5" and a variance from 17:8.08(5) requiring
an open space of 6300 square feet to allow 3,840 square feet of
open space or a variance of 2,360 square feet. Ms. Prokop is
requesting to build a deck over an existing concrete patio. The
existing concrete patio is presently 2' from the lot line. The
site is non -compliant even without the deck, being that the garage
and house are already over the open space requirement. Ms. Prokop
stated she is requesting this variance to replace an unsitely
concrete patio, as it is useless the way it is at the present
time. There will be a fence around deck - 3' lattice work and 3'
spindles (total of 61).
APPEAL #11-93 - Dimitrios Jifas, S75 W17358 Janesville Rd.,
Muskego, Wisconsin, 53150, appeared requesting a 17'5" setback
variance from 17:8.14(3) to allow construction 69' from centerline
of Janesville Rd. for an addition to an existing locational
non -conforming building. Existing building is 86.5' from
centerline, requirement being 100'. A planter will be constructed
in front of the building at sidewalk level and the canopy will be
removed. Jim Maho, Consulting Engineer, stated he was informed
that there was no proposed plan or time frame for the future width
of Hwy. L (Janesville Rd.). Mr. Jifas is requesting a variance to
square the building off in front to make it look like something.
Mr. Maho stated the drive-thru will have a traffic pattern to
alleviate a build-up on Janesville Rd. The changes will occur to
the west wall, north wall and part of front wall.with no
basement. New bathrooms will be installed and will be
handicap -accessible. Plan Commission has approved the operating
hours as 10:30 a.m. to 12:00 midnight. The old sign structure
will remain with a new signage inserted within. The fence on the
east side will be maintained. The building site and operation
plan was approved by Plan Commission.

APPEAL #12-93 - Rudolph Raab, 1516 S. West Ave., Waukesha,
Wisconsin, 53186, appeared requesting an 18' setback variance
from 17:8.15(3) to allow construction of a new building 32' from
the property line on an odd -shaped lot. Zoning deed restriction
requires a 50' setback from the road. Mr. Raab is requesting an
18' variance for a small corner of the building as the
construction will be placed on an angle. The building was moved
because of the drainage ditch with the front of the building
facing the apartment buildings. Mr. Raab stated he cannot
construct this building over the sewer easement. Mr. Dykstra
stated setback requirements are established to maintain some
uniformity. Hardship being the shape of the lot and the proximity
to the sewer. Mr. Raab is developing this structure to lease out
to tenants; no future tenants at this time. He would like to be
able to construct a building maximum size and yet have enough
parking capacity.
APPEAL #13-93 - Dennis Herdeman, S74 W21052 Field Dr., Muskego,
Wisconsin, 53150, appeared requesting a side lot variance of 11'
from 17:8.01(3) requirement of 40' to allow new building 29' from
west lot line, and a variance of 3' from 17:8.01(6) requirement of
15' max. bldg. height to allow an 18' high building, and a
variance of 330 sq. ft. from 17:8.01(7)B.2 requirement of max.
1614 sq. ft. of area to allow a 1944 sq. ft. building. Side lot
variance requested due to location of septic system as per
Waukesha County letter. Zoning RCE requires a 40' side lot. Mr.
Herdeman is requesting to place this structure 29' from the side
lot and 12' from the house, with a front setback of 751. The
septic system is behind the house. A firewall is being
installed. Mr. Kurt Fifer, a neighbor, was only concerned if the
building use would be commercial. Mr. Herdeman responded it
wouldn't. It would mainly be used for equipment to maintain his
orchard of over 100 trees and his other hobbies. His home is a
tri-level and he also needed more space for storage. At present
time, his boat and camper are in storage. Mr. & Mrs. Earl
Beilfuss', also neighbors, appeared in favor of the building.
APPEAL #5-93 - Gregory Wade, S77 W18512 Janesville Rd., Muskego,
Wisconsin, 53150, requesting a 17' variance from the 60' base
setback requirement from C/L Janesville Rd., to allow sign within
base setback area to move business sign as part of overall
landscape theme. Mr. Dykstra read Section 4e of Rules of
Procedure: Re -submission. No appeal which has been dismissed or
denied shell be considered again *within one year except (a) on a
motion to reconsider the vote made by a member voting with the
majority, or (b) on a request for a re -hearing. City Attorney
informed Mr. Dykstra, to handle this variance in one of two ways:
1) Board member could make a motion for a new hearing or 2)
Petitioner writes a request for a new hearing. Petitioner felt he
was being penalized because board members were absent at a
previous meeting. Mr. O'Neil made the motion to request a new
hearing, Mr. Vitt seconded. Mr. O'Neil made the motion to have
the re -hearing take place at this meeting, Mr. Vitt seconded.

A brief review of the variance was discussed. Mr. Wade is
requesting to move his existing sign further east and slightly
closer to the road. Mr. Wiedemann, a neighbor, was concerned
about the lights on the sign reflecting brightly to look like a
car was approaching. Mr. Wade stated he would be willing to
record deed restrictions so this sign could be removed if the road
is widened. Mr. Wade also stated the top section of the mailbox
will be cut down. In response to Mr. Wiedemann's concern, Mr.
Wade stated the lights on the sign will point down. Sign height
will be just above the picket fence height.
The meeting remained in open session.
APPEAL #1O-93 - Peggy L. Prokop, S70 W17495 Forest Drive,
Muskego, Wisconsin. Hardship being size and shape of existing lot.
Mr. Erno made a motion to approve this appeal as submitted.
Mr. Vitt seconded. Upon a voice vote, the motion passed
unanimously.
APPEAL #11-93 - Dimitrios Jifas (formerly Golden Chicken)
S75 W17358 Janesville Rd., Muskego, Wisconsin. Mr. O'Neil did not
understand why Mr. Jifas couldn't square the building off further
from the front setback. Hardship being that is a non -conforming
existing location building. Mr. Erno made a motion to approve
this appeal as submitted. Mr. Berken seconded. Upon a voice
vote, the motion passed 4 to 1.
APPEAL #12-93 - Rudolph Raab, 1516 S. West Ave., Waukesha,
Wisconsin. Mr. Raab purchased this land from the City. The
projections he made for this building on this site have changed.
He didn't receive an accurate survey from the City until two years
after the purchase. Hardship being topography of the land and
shape of lot. Mr. Vitt made the motion to approve this appeal as
submitted, provided he carries forth the landscaping plan. Mr.
O'Neil seconded. Upon a voice vote, the motion passed 4 to 1.
APPEAL #13-93 - Dennis Herdeman, 574 W21052 Field Dr., Muskego,
Wisconsin. Mr. O'Neil made a motion to approve this appeal as
submitted. Hardship being the location of the septic tank.
Mr. Vitt seconded. Upon a voice vote, the motion passed
unanimously.
APPEAL #5-93 - Gregory S. Wade, S77 W18512 Janesville Rd.,
Muskego, Wisconsin. Mr. Vitt made a motion to rehear this appeal
at this board meeting. Mr. O'Neil seconded. Mr. O'Neil stated he
found himself looking off the road to view sign at this time.
Mr. O'Neil made a motion to approve this appeal as submitted.
Hardship being trees have grown, obscuring visibility of existing
sign. Mr. Vitt seconded. Upon a voice vote, the motion passed
unanimously.

MISCELLANEOUS BUSINESS:
The Board decided they need more time to review the Board of
Appeals fee schedule and requirements. Board members were asked
to bring their input to the next meeting. It was suggested that
the structure of the Board of Appeals form be up -dated.

There being no further business, Mr. Vitt made a motion to adjourn
and Mr. O'Neil seconded. Upon a voice vote, the motion to adjourn

On Thursday, February 25th, my appeal for a variance
failed on a 3 to 1 vote in favor due to a technicality. I
feel that I have additional information that the Board
should have been made aware of in regards to the one
complaint against this appeal. As you know, there was an
objection to the possibility of a traffic view obstruction.
I don't think that was addressed properly and I feel that a
rehearing would show that there is, in fact, no traffic view
problem.
Therefore, I respectfully request that you allow a
rehearing at your next regularly scheduled meeting. Thank
you for your consideration.

DEAR COMMITTEE MEMBERS,
My wife and I have owned our home and operated a business from
it since 1983. During this time we have made numerous improvements
to the property and have been systematically adding to and
replacing all of the old landscaping. In the past we have sought
and received your approval to encroach into the road right of way
for various phases of our project. Each time you have approved
those encroachments by requiring us to place deed restrictions on
these projects.
As part of our overall landscape theme we are now preparing
to continue down the East side of the driveway and would like to
relocate the existing business sign outside of the fenced area and
place it just to the east of the driveway.
If we leave it at the present setback it would be virtually
invisible to the motoring public do to the positioning of
Janesville road in relation to this property, and due to existing
vegetation. We are also experiencing some difficulty with the
lighting coming from the apartment garages across the street and
if we put in the necessary trees and shrubs to block the lighting
it will also effectively destroy all visibility of the sign.
Therefore we respectfully request your approval of our sign
relocation request.

APPEAL #5-93 - Gregory S. Wade, S77 W18512 Janesville Rd.,
Muskego, Wisconsin, 53150, appeared requesting a 17' variance from
the 60' base setback requirement from C/L Janesville Rd., to allow
sign within base setback area to move business sign as part of
overall landscape theme. He has owned this property for the last
10 years and has taken many other permits out with the City. He
wishes to have the sign removed from front of yard and placed
along driveway to align up with trees, so the sign is easily
visible from the road. Mr. Wade stated he would sign a deed
restriction to move the sign in the event the road would be
widened in the future. Mr. Dykstra stated he may need approval
from the County, as Janesville Road is a County Highway. The
County may need to approve signs or even an extra entrance to the
Highway. Mr. Wade stated this sign would be next to the street
light. This sign would be the same sign as before but maybe
positioned a little lower.
Paul Wiedmann, neighbor to the West of Mr. Wade, stated there
was a slight hill and curve in front of Mr. Wade's property. He
was concerned about the obstruction of his view exiting his
driveway. Carol Giesegh, another neighbor, also stated she was
concerned about the sign being an obstruction of her visibility.
Mr. Wade stated this sign will be north of the fence which was
approved by the Plan Commission. This sign will still be 45 feet
from the center of the road, 5 feet north of existing fence. The
fence is 4 feet high.
Neighbors agreed they would be satisfied if the sign was
placed higher. Mr. Wade estimated the sign to be 23 sq. ft. and
11 ft. high. The sign is presently illuminated. Mr. Wade doesn't
feel it would be a traffic hazard, as both the nursing home and
church next door to him have signs closer to the road than this
one will be placed.
APPEAL #6-93 - Lynn Kurer, W143 S7989 Durham Dr., Muskego,
Wisconsin, appeared requesting a variance to requirement of
Municipal Code #32.02(2)(j) which requires the installation of a
firewall and/or fire sprinkler in a building to be used for garage
or commercial storage purposes. City water service is not
available in this area and no hazardous materials will be stored.

The size of this storage building is 40' x 200' and has been
approved by the Plan Commission. This building, with 5 bays
within, will be used to store vehicles and rental space.
Mr. Dykstra stated sprinklers or a firewall with a 4-hr. rating
are required for a commercial building this size. Mrs. Kurer
stated she was unaware of the fire code and felt it was not
feasible. Mrs. Kurer has her things in storage right now and has
renters awaiting to use her building. Plan Commission reviewed
this building for architectural appeal for the area, not for
building code.
Mrs. Kurer hired the contractor in September construct the
building and paid him $36 or $37,000 and felt he would take care
of everything, including the permits and building codes required.
Mr. Dykstra stated he explained the codes to Mrs. Kurer in
October when the plans were dropped off. In October when the
permit was approved, Mr. Dykstra listed one of the conditions
being a firewall or a sprinkler system.
Mr. Phil Dibb & Mr. Tom Kramer, Tess Corners Fire Department
Fire Code Administrators, appeared to explain why a firewall or
sprinkler system was beneficial. Mr. Dibb stated this situation
was not impossible, but could be costly. Variances shouldn't be
given to take away from the protection of the public. He
explained this situation could be hazardous to the Fire Department
trying to protect it from a fire.
Mrs. Kurer received a citation from the Building Department
for proceeding with construction of a new building without
obtaining a permit. The citation is issued to the owner rather
than the builder. Mrs. Kurer felt her hardship for this variance
was that everything is already bought.
Mr. O'Neil asked why the Plan Commission approved the plan
without the firewall or sprinkler. Mr. Dykstra explained the Plan
Commission does not look at the submittals for compliance with
building codes.
Mr. Dibb stated the firewall could be constructed without
changing the building. One wall has to be modified. Mr. Fohr
said the builder should have informed the buyer of the fire code.
APPEAL #7-93 - Lynn Kurer / Bushy's Pub, S67 W14831 Janesville
Rd., Muskego, Wisconsin, appeared requesting a 3.19 ft. setback
variance from the requirement of 75.15 ft. to allow the
construction of an addition onto the existing non -conforming
structure to expand the existing structure to the southwest.
If the value of this addition is 50% or more of the existing
structure, the existing building will have to be brought up to the
present code. This addition will be used for business not living
space. Mrs. Kurer stated she is actually enclosed the space now
being used as a patio/garden. Hardship being an increase in
business and a unique size lot.
APPEAL #8-93 - Craig Lawdanski, S68 W17951 Island Dr., Muskego,
Wisconsin, appeared requesting a 2" variance to the Municipal Code
#30.15(3)(a), which requires a minimum ceiling height of 6'10", to

without permits that did not comply with code. Mr. Dykstra stated
this home has gone through a few code compliances with previous
owners and this violation was not noticed. This home was
constructed in 1935. Previous owners had done some remodeling
without permits that lead the building inspector to inspect this
remodeling closer. Code Compliance is to insure home is up to
code and all existing work has permits and is done properly.
Permits cannot be issued for this work without receiving a
variance for the ceiling height. Hardship being the work was done
prior to the current owner's purchasing home.
The meeting remained in open session.
APPEAL #5-93 - Gregory S. Wade, S77 W18512 Janesville Rd.,
Muskego, Wisconsin. Chairman Fohr stated the reason for the
position of the signs for the church & nursing room was the paved
parking lots. Hardship being that the sign is being hidden by
trees. He stated he couldn't see a hardship for this sign. Mr.
O'Neil stated moving the sign actually takes your eyes off of the
road. He said he has no problem; it would be a more feasible
sign. Mr. Vitt made a motion to approve this appeal as submitted
stating that trees weren't this size 10 years ago and in this new
location it would attract business. The existing height would be
maintained. Mr. O'Neil seconded. Upon a roll call vote, the vote
was 3 members voting yes and 1 member voting no. Since less than
four persons voted to approve the variance, the motion failed.
APPEAL #6-93 - Lynn Kurer, W143 57989 Durham Dr., Muskego,
Wisconsin. Hardship cannot be financial or ignorance of the
building codes in Muskego. The Board advised a firewall be
installed in this commercial building. Mr. O'Neil made a motion
to deny this appeal for lack of a hardship. Chairman Fohr
seconded. Upon a voice vote, the motion passed unanimously

Rd., Muskego, Wisconsin, 53150. Mr. Vitt made a motion to approve
this appeal as submitted. Hardship being existing location of
original structure and lot size. Chairman Fohr seconded. Upon a
voice vote, the motion passed unanimously.
APPEAL #8-93 - Craig Lawdanski, S68 W17951 Island Dr., Muskego,
Wisconsin, 53150. Mr. O'Neil made a motion to approve this appeal
as submitted. Hardship being work being done by pre-existing
owners. Mr. Vitt seconded. Upon a voice vote, the motion passed
unanimously.

MISCELLANEOUS BUSINESS:
It was decided that Board Members review Don Pionek's suggestions
on survey requirements before the next meeting and discuss them at
that time. Chairman Fohr asked that the fees also be voted on
next month. A survey of surrounding community fees was taken and
results from them will be sent out to the board members before the
next meeting.
ELECTION OF OFFICER:
Mr. O'Neil nominated Don Pionek as the Board's new Vice -Chairman.
Mr. Vitt seconded. Upon voice vote, the motion was unanimous.
ADJOURNMENT•
There being no further business, Chairman Fohr made a motion to
adjourn and Mr. Vitt seconded. Upon voice vote, the motion to
adjourn passed unanimously. The meeting was adjourned at 9:45 p.m.

NOTICE OF CLOSED SESSION:
PLEASE TAKE NOTICE that the Board of Appeals of the City of
Muskego will convene, upon passage of the proper motion, into
closed session pursuant to Section 19.85 (1) (a) of the State
Statutes for the purpose of deliberating concerning cases which
were the subject of a quasi-judicial hearing; said cases being the
above listed appeals.
The Board of Appeals will then reconvene into open session.
