PRESENT: - Chairman Gerald Fohr, Vice Chairman Carol Nievinski, Thomas Berken, Lloyd Erno, and Zoning Officer Gerald Lee ABSENT: Linda Koester, Peter Passick, Vincent Caporali MINUTES: Mr. Berken moved to approve the minutes of February 25, 1988. Mr. Erno seconded and the motion carried. APPEAL 4-88 - DUAINE LANGFELDT Mr. Langfeldt appeared before the—B-o—a-r7 to request an o set variance to construct a commercial building. The original request was for a 1' offset variance but Mr. Langfeldt stated he wished to change the requested variance and wanted to place the building within 3' of the lot line which would require a 7' offset variance. The requested building would now be 78' X 120'. The required zoning requires an offset of 10'. The present power pole on the property requires a 6' easement. Discussion followed with regard to the possible removal of the pole with underground wiring installed. The Board remained in open session. APPEAL 4-88 Mrs. Nievinski moved to defer for one month. The surrounding neighbors will be notifed of the new requested variance of 7'from the lot line. Mr. Langfeldt needs to provide the Board with written permission from the electric company for the change to underground wiring and removal of the pole and cost figures involved. Originally I had intended to asphalt the storage yard this year, after which it would have been relatively easy to move the shed. However, due to another year of drastically reduced sales, Muskego Marine is unable to afford the asphalt this year. We expect to be able to asphalt next spring.- By waiting to move the shed until after the asphalting is done it will save us a great many man-hours and therefore money, something we simply can not afford at this time. Posbrig asked Mr. Dyer if the stakes he had out last month wore still in the same place? He stated they were. He plans to install a new driveway. He stated there wouldn't be any living quarters above the shed. Mr. Lee asked Mr. Dyer if there was a spring to the east of the property? Mr. Dyer responded there was and that was the reason for not moving it further east. Mr. Purdy said the previous owner and Mr. Dyer had wanted to buy a 100' strip of land belonging to Mr. Purdy just north of where this shed is to be built, but they couldn't come to terms. Vice Chairman O'Neil told Mr. Dyer he could call the Building Inspection office in the morning or wait for the response to be mailed to him within five (5) days. MUStEGO MARINE'S REQUEST FOR ONE YEAR EXTENSION - Mr. Lee stated that he had received correspondence copies distributed to Board members) from Duaine H. Langfeldt stating business is poor and he requests another year to remove the shed. He intends to asphalt. Vice -Chairman O'Neil asked Mr. Lee if they can act on this request tonight? He responded that they could since it was a matter of voting on overriding a decision not the zoning code. Mr. Erno asked Mr. Lee if it is near the fence and whether the Fire Department has a problem with the location? Mr. Lee responded that he had not heard any complaints and sees no problem with the location. Mrs. Posbrig made a motion to grant an extension to remove the shed until June 1, 1991 and Mr. O'Neil seconded. Upon a roll call vote the motion to grant the extension passed unanimously. The Board remained in Open Session. APPEAL 16-90, DYER - There was some discussion concerning the locationo the house, water and future development in the area nearby. Mr. Erno made a motion to grant the appeal as requested. The hardship being the location of the existing ponds, driveway and house. Mrs. Posbrig seconded. Upon a roll call vote the motion to adopt passed unanimously. ADJOURNMENT: Mrs. Posbrig made a motion to adjourn at 8:05 P.M. and Mr. Erno seconded. We have written permission from the body shop to do this. The small area involved is useless for anything else. The shed is near our sevice shop, and is used for storage df parts, motors and carpet that is used for the January boat show. We painted the shed to match the service building and to make it even less noticeable. The shed can not be seen by any of our neighbors around our yard. Moving it out into our yard would make it considerably more noticeable. There are very many eyesores around Muskego, our "hidden" shed is certainly not one of these. Please stop and look. DISCUSSION: Muskego Marine- The Board directed Chuck Dykstra to follow up on the removal of the shed as previously determined by the Board. Irish Spring House- Mr. Dykstra and Mr. Kovacs informed the Board of the status of the asphalting on this property. A 20' strip was to be asphalted and to this date, only a 12' 6" strip has been done. Letters were sent to Mr. Boyce with no response. Mr. Kovacs did state that Mr. Boyce contacted him by phone that day. The Board directed Mr. Dykstra to do what was needed to attain compliance. Mrs. Posbrig made a motion to adjourn and Chairman Fohr seconded. Upon a voice vote, the motion to adjourn passed unanimously. The meeting was adjourned at 11:15 P.M. Looking back in your file, I noticed that the Board of Appeals had been involved with this matter for some time. Therefore, I decided to present this request to the Board under miscellaneous discussion at the June 27 meeting. The Board stated that the shed must be removed. There will be no additional extensions granted nor will any further requests to leave this shed in its present location be considered. Therefore, by this letter, you are hereby given 15 days to relocate this shed to its previously designated area on the south corner of your 40 x 80 addition. No permit will be required to move this shed and an inspection will be made on July 30 to verify that this shed has been relocated. Failure to comply will result in a citation being issued. Location: S73 W16511 Janesville Road Defendant: Muskego Marine Address: Same as Above COURT DATE: September 14, 1991 HISTORY On January 30, 1989, the Board of Appeals denied a reuest for a 9' offset variance for an existing storage shed located at S73 W16511 Janesville Road, Muskego, Wisconsin. They did, however, grant a six month variance to find an alternate location for the building. (See Exhibit #1) On July 17, 1990, a letter was sent to Mr. Langfeldt informing him that the six month variance had expired and that unless the shed was moved within 10 days, a citation would be issued. (See Exhibit #2) On July 20, Mr. Langfeldt forwarded a letter to this department requesting an extension of the variance. (See Exhibit #3) On July 26, 1990, the Board of Appeals met and granted an extension to June 1, 1991. (See Exhibit #4) On June 4, 1991, the Building Department again received a request to leave this shed on the property. (See Exhibit #5) The Board of Appeals was presented with this latest request on June 27, 1991. Building Director Chuck Dykstra presented the letter of June 1991 to the board members in miscellanous discussion. (See Exhibit #6) The Board asked the building director to assure removal of building. (See Exhibit #7) On July 15, 1991, the building department sent Mr. Langfeldt a letter informing him that the Board of Appeals stated the building is to be moved and that he would be given until July 30, 1991 to relocate this shed. He was informed that failure to relocate the shed by July 30, 1991 would result in a citation being issued. (See Exhibit #8) Mr. Langfeldt did not move the shed by July 30, 1991 and so a citation is being issued. I would like to request a forfeiture in this matter to cover costs to this department as well as any other costs as set by court.
