Mr. Gary Januszewski
S66 W18125 Muskego Drive
Muskego, WI 53150
Dear Mr. Januszewski:
The Board of Appeals wishes to advise you that your appeal
for a variance of 15 feet to construct a 20' x 22' garage has
been delayed for one month until May 22, 1986. This appeal was
delayed so that the Board of Appeals members could view the site
and respond at the next meeting. Also we will instruct the
Safety Committee to give us a report regarding the safety and
traffic situation on Hardtke Drive and Muskego Drive to determine
the appeal.
Thank you.
Sincerely,
BOARD OF APPEALS

BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON April 24, 1986
Chairman Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Gerald Fohr, Vice Chairman Erno, Carol
Nievinski, Linda Koester, Peter Passick, and Zoning Officer
Gerald Lee.
ABSENT: Vincent Caporali and Thomas Berken
MINUTES: Mrs. Nievinski moved to adopt the minutes of the
February 27, 1986 meeting. Mr. Passick seconded and the motion
carried.
NEW BUSINESS:
APPEAL 4-86 - G. JANUSZEWSKI GARAGE Mr. Rick Kuckkahn
was present to represent Mr. Januszews i s request for a 20 foot
variance to construct a 22 foot by 20 foot garage. This variance
was corrected to actually request a 15 foot variance as clarified
by Zoning Officer Lee. Mr. Kuckkahn's report summarized that due
to the unusual lot size, safety conditions, soils, view from
primary living space,(light and air effect) and access to Hardtke
Drive that he felt Mr. Januszewski was keeping within the spirit
of the ordinance and felt the hardship should be granted. He
indicated that placing the garage on the lake side of the home
was considered but felt it was not a good idea because of the
high water table in this area. and would also block view of the
lake area. The garage is 20 feet from the Hardtke Drive and 15
feet from Muskego Drive and does not access on to Muskego
Drive. Chairman Fohr inquired whether Mr. Januszewski would be
in favor of eliminating two feet off of the breezeway and two
feet off of the garage and requesting an 11 foot variance instead
of a 15 foot variance. Mr. Kuckkahn stated he could not answer
this at this time. Vice Chairman moved to delay this appeal for
one month and that a request be made to have the Public Safety
Committee state their opinions in a report to be returned by the
next Board of Appeals meeting regarding their opinion of the
safety conditions of access on to Hardtke Drive versus Muskego
Drive and also that all Board of Appeal members are to view this
property and any/all visible accesses regarding fences, parking
and general considerations before the next meeting. Mr. Passick
seconded and the motion carried.
APPEAL 5-86 - EGG PRODUCTS Mr. Alton Boldt, Mr. Dan
Christiansen and Mr. Arnold appeared before the Board of Appeals
to request a 20 foot variance for a front setback for the purpose
of constructing an addition to an existing building within the
area of an existing column supported canopy. Mr.Christiansen
Board of Appeals
April 24, 1986
explained that this addition would only encroach at two points of
the already existing canopy. He also explained that the new
front would be the new entrance and reception area and the intent
is to remove the rear entry on the north side of the building and
maximize the space already in the building. The front would then
be able to accept stairs for a second story which will later be
built to include a laboratory. Mrs. Nievinski asked whether
their was any intention of retail sales with the new entrance
being added. Mr. Boldt replied no. Mr. Erno moved to approve
the hardship as submitted based on the present location of the
existing building on the lot. Mrs. Nievinski seconded and the
motion carried.
APPEAL 6-86 - MUSKEGO FIRE COMPANY #1 Mr. Mack appeared
before the Board of Appeals to represent Muskego Fire Co. #1. to
request a variance of 20 feet in offset to place a sign within
the setback area. He stated that the sign was already in place
and that by their oversight had thought it was approved when they
came before the Board of Appeals for the siren variance. Mr.
Mack inquired whether the letter sent to Mr. Masterson stating
any objection to the fire siren being constructed had been
signed. A follow up letter will be sent. Mr. Passick moved to
approve the hardship as submitted with the exception that if
Highway 24 is widened or any other construction project should
occur the sign will have to be removed at the owner's expense.
Linda Koester seconded and the motion carried.
ADJOURNMENT: Mrs.Nievinski moved to adjourn the meeting at 9:50
P.M. Mrs. Koester seconded and the motion carried.
Respectfully Submitted,
Lynne Sweet
