BOARD OF APPEALS
MINUTES OF MEETING HELD JUNE 27, 1985
Chairman Gerald Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Gerald Fohr, Estel Ellery, Lloyd Erno, Thomas
Berken, First Alternate Carol Nievinski, Zoning Administrator
Gerald Lee.
ABSENT: Vincent Caporali, and Second Alternate Linda Koester
MINUTES: Mr. Ellery moved to adopt the minutes of the March 28,
1985 meeting. Mrs. Nievinski seconded and the motion carried.
APPEAL 85-4 - MARK KOSOBUCKI -Mr. Kosobucki appeared
before the Board to explain he is asking for 30' in offset to
construct a house and garage. Bay Lane is proposed to be 60'
wide, and for Mr. Kosobucki to conform, his structure would be
40' into his lot, 30' from the center of the road and a 25'
setback in this RS-3 OLS district. The 60' is questionable
because in this older area, should Bay Lane become 60' wide, none
of the houses would conform. Zoning Officer Lee explained there
is no present plan to widen Bay Lane, and the average setback
would be measured on the same side of the road. Mr. Brent
Martins appeared before the Board. He is a neighbor of Mr.
Kosobucki, and although he will lose his view of the lake, he
does not oppose the construction.
APPEAL 85-5 - MICHAEL KREUZER - Mr. Kruezer appeared
before the Board to request a 19.5 variance in setback to
enlarge an existing legal non -conforming structure. Mr. Erno
pointed out the structure within is being enlarged, not the size
of the building. Mr. Kruezer would like to raise the sagging
porch and enlarge the basement under the crawl space. This is an
OLS district not OED, and Zoning Officer Lee explained OLS is not
a mapped district; it is any district that abuts the lake and it
gives greater flexibilty in the setback and offset requirements
by 2/3. Mr. Lloyd Pic kart, Mr. Kruezer's neighbor directly
southwest appeared before the Board, saying he favors the plan.
Mr. Kruezer, in answer to Mrs. Nievinski's question, explained
new drain tile would stop any water run-off.
Mr. Erno said this can only be an improvement of the property.
Mr. Ellery moved the Board go into closed session pursuant to
Section 19.85 (1) (a) of the State Statutes for the purpose of
deliberating concerning cases which were the subject of a
quasijudicial hearing: said cases being the above listed
appeals. Mrs. Nievinski seconded the motion and the motion
carried.
The Board of Appeals reconvened into open session.

APPEAL #85-4 - MARK KOSOBUCKI - Mr. Berken moved the
appeal be granted as submitted due to the special conditions of
the lot location, size and surrounding houses in the
neighborhood. Mr. Erno seconded and the motion carried.
APPEAL 85-5 - MICHAEL KRUEZER - Mr. Ellery moved the
appeal be granted as submitted due to the existing conditions of
the structure and the lay of the land and flow of the water.
Mrs. Nievinski seconded and the motion carried.
DISCUSSION:
The Board members expressed interest in the status of the
alternate members when a new member is appointed. Chairman Fohr
said he would speak to the Mayor.
ADJOURNMENT Mr. Ellery moved to adjourn the meeting at 8:30
P.M. Mr. Erno seconded and the motion carried.

Muskego will convene, upon passage of the proper motion, into
closed session pursuant to Section 19.85 (1)(a) of the State
Statutes for the purpose of deliberating concerning cases which
