Zoning Board of Appeals- - Minutes 03/28/1985CITY OF MUSKEGO BOARD OF APPEALS MINUTES OF MEETING IiP.1,1) MARCH 28, 1985 Chairman Gerald Fohr called the meeting to order at 7:30 P.M. PRESENT: Chairman Gerald Fohr, Whitney Grant, Estel Ellery, First Alternate Carol Nievinski, Second Alternate Lina Koester, and Zoning Administrator Gerald Lee. AWiENT _ Lloyd Erno and Thomas Berken MINUTES: Mr. Grant moved to approve the minutes of the previous meeting of December 13, 1984. Mrs. Nievinski seconded and the motion carried. APPEAL #84-28 - LARRY FISCHER - Mr. Lee gave a report on his inspection of the property, and suggested an energy audit which can be done by the Gas and/or Electric Company, this is advised not a requirement. An appeal was granted in 1978, for five years to remove the house; with a one year extension. Mr. Ellery asked if the house was in reasonable condition, and that the repairs should not go over 50% of the fair inar_ket value. Mr. Lee explained that Mr. Fischer was willing to have the audit, that the rescue platforms need to he reinforced, weatherstripping is needed, and there are missing storm windows. There is lack of open space for laundry, playground, etc., and a lack of parking. The residence is occupied by two single males, and the property has no abuse, no children, no cars and no great de'nand on it. Craig and Clark Fischer, sons of Larry Fischer appeared before the Board to explain the repairs would cost between $1,000.00 and $2,000.00, and they would be willing to meet the requirements of the code, if they would be given enough time. Clark Fischer that they would like the variance because there is not an overabundance of rental properties in Muskego, and the present renters appreciai.e i.he low rent payment. Mr. Ken Kralin, the tenriat in the lower unit said he was willing to work on the repairs. APPEAL #85-1 - E.J. SALENTINE - Chairman Fohr turned the meeting over to Mr. Grant as he a personal interest in this appeal. Mr. Lee explained that the sign ordinance regaLres r_liat flat wall signs can be up to 5% of the wall area. In this case, 5% of 900 square feet is 45 square feet. The proposed sign is 88 square feet, needing a 39 square foot variance. Mr. Salentine appeared before the Board to explain that he would be willing to remove the existing 3' x 4', double faced, free standing sign. Mr. Ellery pointed out that the proposed sign would be 120 feet from the roadway. APPEAL #85-2 - GA_RY_ZETTEL - Mr. Zettle appeared before the Board to explain that the old garage is disintegrating, and he would like to switch the driveway to the west. Mr. Lee explained Page 2 Board of Appeals March 28, 1985 that Mr. Zettle needs a 55' Setback from the center of the road, 6' offset to the north. Mr. Zettle explained he would tear down the existing garage and put up a new 22' x 24' one. Mr. Fohr said the neighboring garage is close to the Zettle's with 8-10 feet between garages. Mr. Ellery said they could have the garage off to the side eliminating backing out to the roadway making it safer. Also, there is eleven feet between house and garage, and the garage can be moved back one more foot to give more room on Lincoln Drive side. APPEAL #85-3 - EUGENE STRZOK - Mr. Strzok appeared before the Boar�� ro ex�an die wouLc�-�i�ce to attach a garage to his house and leave the existing asphalt driveway for ad(IL Loral parking. Alderman Gaetzke spoke on behalf of Mr. Strzok saying he is doing a good job of completely remodeling his house, and a favorable consideration would be an asset to the area. Mr. Lee said that moving it off the lot line and attaching it to the house would add to the appearance of the house. Mr. Strzok is requesting 10' in setback, the existing garage is 25' from the house. Mr. Ellery poirlr_ed out that Mr. Strzok would need a one hour fire wall. CLOSED --SESSION: Mr. Ellery moved to go into Closed Session pursuant to Section 19.85 (1) (a) of the State Statutes for the purpose of deliberating concerning cases which were the subject of a quasijudicial hearing: said cases being the above listed appeals. Mrs. Nievinski seconded the motion and the motion carried. The Board of Appeals reconvened into open session. APPEAL_ #84-28 - LAR_RY F_ISCHE__R - Mr. Ellery moved the appeal be granted an extension for five �5) years at which time it will be reviewed, and the repairs to the house are to be completed within one (1) year. Mr. Grant seconded and the motion carried. APPEAL #85-1 - E.J.
