BOARD OF APPEALS
MINUTES OF BOARD OF APPEALS MEETING HELD ON February 27, 1986
Chairman Fohr called the meeting to order at 7:30 P.M.
PRESENT: Chairman Gerald Fohr, Vice -Chairman Erno, Thomas
Berken, Carol Nievinski, Vincent Caporali, Peter Passick and
Zoning Officer Gerald Lee.
ABSENT: Linda Koester
MINUTES: Mr. Erno moved to adopt the minutes of the January 23,
1986 meeting. Mrs. Nievinski seconded and the motion carried.
APPEAL 1-86 - JAMES AND NANCY WIER - This appeal was
withdrawn. The Wiers' did not receive architectural approval
from the Lake Lore subdivision, and therefore will not be
requesting a variance for the construction of a new home.
APPEAL 2-86 - MUSKEGO VOLUNTEER FIRE COMPANY - The Fire
Company is requesting a variance in o set or the purpose of
constructing a fire tower. Mr. Carl Mack appeared before the
Board to explain that Mr. John Spitzner objected to moving the
fire tower to the west side of the fire company building, which
would put it next to his floral shop. However, if the offsets in
this RS-3 OIP district are complied with the tower would be in
the middle of the parking lot. Therefore, the purpose of the
request is to allow it to be placed in the northwest corner of
the property. Mr. Masterson, owner of the adjacent property told
Chief Ludwig he had no objection to the tower being located on
the lot line.
APPEAL 3-86 - JOHN AND JEAN MARENDA - Mr. and Mrs. Marenda
appeared before the Board to exp ain t eir request for a 4'
variance in setback from Little Muskego Lake for the purpose of
constructing a deck and screen porch. Zoning Officer Lee
explained that this is an OLS district requiring that no building
be constructed closer than 50' from the shoreline. Mr. Marenda
stated the neighbors have no objection to the variance, and noted
the view of the lake will not be blocked.
The Board remained in open session
Chairman Fohr advised the Board that the court ruled in
favor of the City in the Januszewki case, and congratulated
Zoning Officer Lee on a job well done in helping obtain that
ruling.
APPEAL 2-86 - MUSKEGO VOLUNTEER FIRE COMPANY - Mr. Erno
moved to approve t e request as submitted subject to a letter
from Mr. Willard Masterson stating he has no objection to the
location of the tower. The hardship is based on the close

proximity to the residence.

house on the lot. Mr. Erno seconded and the motion carried.

Mrs. Nievienski moved to adjourn the meeting at 8:00 P.M. Mr.
Berken seconded and the motion carried.
