COMMITTEE OF THE WHOLE – CITY OF MUSKEGO Approved
MINUTES OF MEETING HELD TUESDAY, AUGUST 12, 2008
Mayor Johnson called the meeting to order at 7:10 p.m. and led those present in the
Pledge of Allegiance.

Mayor Johnson, Ald. Snead, Pavelko, Borgman, Werner, Schneider, Schaefer, Fiedler,
and Deputy Clerk Blenski,
STATEMENT OF PUBLIC NOTICE
Deputy Clerk Blenski stated that the meeting had been noticed in accordance with the
Open Meeting Law.
APPROVAL OF AGENDA
There were no issues with the agenda.
APPROVAL OF MINUTES
Ald. Fiedler moved to approve minutes of the June 10, 2008 meeting. Ald.
Schneider seconded; motion carried.
NEW BUSINESS
Mayor Johnson stated that some surrounding communities have enacted a Sex Offender
Registry Ordinance. He wanted the committee to discuss the issue and determine if the
City should proceed to have the research done to create an ordinance. City Attorney
Molter has some concerns regarding the constitutionality of a Sex Offender Registry
Ordinance. The City of Franklin’s ordinance was recently challenged, and the
municipality won in Milwaukee Circuit Court. The Mayor said the City of Milwaukee has
tabled the issue for now. The reason is that Wisconsin Probation and Parole personnel
believe locating all the offenders in one area is seen as undesirable vs. having them
reside among the general population.
The Plan Department prepared a “Sex Offender Residency Restriction Properties” map,
which the Mayor and committee reviewed. The map does not depict the new, proposed
school property in District 7. Ald. Schaefer stated she would like to look at areas outside
the City boundaries. The Mayor stated that if the City had an ordinance in place it would
only affect Muskego. There was concern that an ordinance in place in an adjacent
community could force an offender into Muskego. The consensus of the committee was
to move forward to create an ordinance. Ald. Pavelko identified some of the other
communities that have a sex offender registry ordinance in place in addition to Franklin:
Waukesha, Vernon, Big Bend, and Menomonee Falls.
Ald. Werner stated that he would like to have representatives from Wisconsin Probation
and Parole as well as the individual who drafted the ordinance for Franklin at a future
meeting. Mayor Johnson stated he would put a presentation together for a future COW

meeting. He stated the City needs to do this the correct way so it does not have to
defend it in court.

Ald. Snead moved to adjourn at 7:28 p.m. Seconded by Ald. Fiedler, motion carried
unanimously.
