COMMITTEE OF THE WHOLE - MINUTES - 9/26/2005 COMMITTEE OF THE WHOLE – CITY OF MUSKEGO Approved 10/6/05 MINUTES OF MEETING HELD SEPTEMBER 26, 2005 Audio recording available Ald. Melcher chaired the meeting and called it to order at 6:08 PM. Those present recited the Pledge of Allegiance. ROLL CALL Present: Mayor Damaske, Ald. Melcher, Ald. Patterson (leaving at 7:00 PM to attend Conservation Commission Committee Meeting), Ald. Borgman, Ald. Buckmaster (arrived at 6:20 PM), Ald. Salentine, Ald. Schroeder, Ald. Madden, Interim Finance Director Mueller, Engineering/Building Inspection Director Sean McMullen, and representatives from the Muskego Fire Dept and Tess Corners Volunteer Fire Department (see attached sheet). STATEMENT OF PUBLIC NOTICE Chairman Ald. Melcher stated that the meeting was noticed in accordance with the opening meeting law. REVIEW MINUTES OF PREVIOUS MEETING Ald. Borgman moved for approval of the September 22, 2005 minutes. Ald. Schroeder seconded. Motion carried 6 – 0. APPROVAL OF AGENDA In regard to the change in date and time of the Committee of the Whole meeting, Ald. Patterson asked that the Committee review rules as to how a meeting is called and who has the authority to call the meeting. Ald. Patterson felt that the Committee of the Whole should be polled. Ald. Melcher stated the rule should be that he be contacted; he in turn will contact all Committee members to verify if they can make the meeting. Ald. Melcher will then determine if the meeting should be held. A meeting will be held only under these conditions. This will be communicated to staff. UNFINISHED BUSINESS 1. Engineering/Building Department 2006 Budget – Continued Discussion Engineering/Building Inspection Director Sean McMullen appeared before the Committee regarding the Tess Corners Box Culvert/Bridge project. This is to replace the existing bridge structure on Tess Corners Drive south of Janesville Road. McMullen distributed the October 22, 2001 Public Works Minutes highlighting the following: Janesville Road Reconstruction Project – Project is on track with design phase. Land acquisition starting in 2003 with construction starting with 2004. Waukesha County will be paying for reconstruction of box culverts and the bridge on Tess Corners Drive between Open Pantry and the Tess Corners Volunteer Fire Department. McMullen explained that in early 2004 Waukesha County applied for a DNR Permit to replace the Janesville Road and Tess Corners bridges. Waukesha County shortened up the road section by approximately sixty feet to get away from box culvert on Tess Corners Drive and did not proceed with plan mentioned in the October 22, 2001 minutes. This was strictly a monetary issue. McMullen reviewed the Wisconsin Department of Transportation Culvert and Tunnel Inspection Report dated October 2003. Inspections take place every two years. The next inspection by will be November 2005. The current status of the bridge was explained and discussed. McMullen stated he knows he will have to put a mandatory two-ton weight limit on the road after the inspection in November. Emergency vehicles are exempt. McMullen stated his recommendation is the Engineering expenditure, $50,000.00 in 2006 and construction, $200,000.00 in 2007. Ald. Schroeder moved to approve $50,000.00, Engineering expenditure, in the 2006 Capital Budget. Seconded by Ald. Salentine. McMullen thought Committee of the Whole Page 2 September 26, 2005 Engineering/Building Department 2006 Budget - Continued there might be enough money in the existing bridge capital account, from the last two bridges, to fund this project. Construction funds would come from grant or partially out of road program and partially out of capital improvement. Motion carried. McMullen asked the Committee if they had any questions in regard to the 2006 road program approved at the August 25, 2005 Committee of the Whole meeting? Roads will be picked after the budget is adopted. Some of the roads being considered are: Hillendale Drive, East and West Racine Ave, Tans Drive, section of Crowbar Road, and last piece of Muskego Dam Road. Reducing the Road Program budget would affect the 2006 funding for the Industrial Park by reducing the formula with Department of Transportation. The two different programs the City applies for are general transportation aid and MSIP (applied for Industrial Park). There is an Industrial Park fund that approximately $80,000.00 would come from. Out of the road program if Common Council decided would be approximately $20,000.00 to meet the full match. A road program budget reduction would not affect the Industrial Park funding too much as a result but would affect transportation aid. 2. Muskego Fire Department, Inc 2006 Budget – Continued Discussion Discussion pertained to the 2006 Operating Budget. Muskego Fire Department reincorporated in January of 2005 and is now known as Muskego Fire Department, Inc. They are in the process of reorganization the Company under 501(3)(c) and working on issues the City Attorney said needed clarifying including disbanding/restructuring. The Muskego Fire Department’s goal is to be completed with 501(3)(c) by the end of 2005. In regard to training, one of the differences is that for the last four or five years some of the infrastructures were not in place at Muskego or not in place as long as Tess Corners Fire Department’s infrastructures were. Domonic D’Acquisto spoke about the grant received for breathing apparatus with Federal requirements for training. Also, as part of the grant they have to have physical exams to show a person is medically able to wear apparatus (OSHA standard), written response plans, written operating procedures, and a alcohol and drug testing program in place. Approximately $24,000.00 of the budget is for physical exams & drug testing. Muskego is in the process of doing the National Institute of Management System (NIMS) training. This training will continue into 2006. Muskego is required to have rapid intervention teams. Muskego needs a state certified training officer. Muskego can’t have members who took training come back and train others because Muskego does not have a state certified training officer. When a training officer can be used was discussed. An accounting of training costs for Firemen II and Officer 1 and II was requested. Using a State certified training officer between the two fire departments was discussed. Ald. Patterson was excused to attend the Conservation Commission Committee meeting. Hydrant rental maintenance compared to fire department budgets was discussed. It was requested that the Mayor and Fire Departments copy the Aldermen on some of their discussions so the Aldermen know what the priorities are. It was noted that the Fire Department has the authority to move money between accounts if short in one account before they come back to committee. The Aldermen requested that in future years the Fire Departments Operating Budget line item breakdowns continue to be presented to the Committee. Ald. Schroeder moved to approve $289,122.00 for the 2006 Muskego Fire Department Operating Budget. This is $8,000.00 less then administrations recommendation and comparable to their 2005 Operation Budget. Seconded by Ald. Buckmaster. Discussion continued on motion including discrepancy between the two departments budgets, moving forward with training and physicals on a two year plan, spending more time with surrounding communities and Tess Corners, tax freeze, training seminars, vehicle gas and oil, clothing, and Committee of the Whole Page 3 September 26, 2005 Muskego Fire Department, Inc 2006 Budget Continued fire inspector office supplies. The question was asked if time should be spend tonight breaking down where the $8,000.00 in cuts could be made. Ald. Salentine called for the question. Roll call vote was 4 – 2. Ald. Melcher and Ald. Salentine voting no. Motion passed 4 – 2. Ald. Melcher and Ald. Salentine voting no. 3. Tess Corners Volunteer Fire Department 2006 Budget – Continued Discussion The 2006 training budget of Tess Corners was discussed. They distinguish at their level, when going through budget process, between what laws, statues, or ordinances require (requirement being something that has to be done) and what the internal organization wants. There are no deficiencies as to Tess Corners meeting Federal, State, City of Muskego, and Waukesha County training requirements. Tess Corners is currently working on NIMS training. There are courses that offer trainer to trainee, one person is sent for training and he/she comes back and trains the other members. Tess Corners has members on their volunteer department that are full time fire fighters elsewhere and took the trainer to trainee class at their departments. When asked why Muskego did not use the trainers at Tess Corners it was noted Muskego Fire Department did the NIMS training before Tess Corners. Tess Corners addressed with prior administration (prior to Mayor Slocomb) what they would do to offer training at their station and inviting Muskego Fire Department, Public Works, Utility Department, and others to join them. The Police Department is receiving their NIMS training as part of their in-service requirements. Funding for NIMS training was pulled so Tess Corners had to wait until after July to reapply for funding so there would be no cost to the City or the Department. Training for NIMS was not included in the 2006 Operating Budget. Muskego Fire Department should know that in-house training is available. A small fee could be paid to the Tess Corners Department for training. Ald. Schroeder moved to reinstate 2005 budget of $157,575.00 as the Tess Corners Volunteer Fire Department’s 2006 Operating Budget. This is $3,825.00 higher than administration’s recommendation. This can be put back into the budget as the fire department determines, except for one line item. Mayor will speak to the fire department in regard to this. Seconded by Ald. Buckmaster. Motion carried. There will be no meeting on Thursday, September 29, 2005. ADJOURNMENT Ald. Buckmaster moved to adjourn at 8:47 PM. Ald. Madden seconded; motion carried.
