Chief reported an off-duty policy was established previously. Currently an employee has his own company and he hires some of our police officers and others for security at school activities. A recent seminar indicated some Worker's Comp. The purpose today is to notify the City there liability might be incurred by the City, especially relating to is a potential of liability, and ask that you acknowledge the decision to allow officers to work in the one capacity as something worth doing and a gamble worth taking. Mr. Rammer stated he appreciates the relationship they have with the City and Police Department. The School District previously used Waukesha County deputies, which didn't work very effectively. The district then contracted with J & B Associates, who employees off-duty City of Muskego officers for sports events, tournaments, dances, etc., with a dramatic improvement in the climate of these events. There are benefits with the off-duty officers. He encouraged continuation of this for students, officers and citizens by personal interaction process. Chief Johnson explained the worker's comp liability could become an issue when the line is not clear if an injury would occur and a determination would have to be made if the off-duty officer was acting strictly as a security guard, or if criminal activity occurred and the off-duty officer then acted as a police officer. Atty. Jon Swain, who was present for another matter, stated that clearly to the extent they're not doing police work, the direct employer, J & B is not covered, the School District City . security people for the school district. Chief felt it is i whoever is employing them is responsible for worker's comp. If -a is responsible because of their contract with J & 9, then the Committee of the Whole Minutes April 22, 1996 - Page 2 !he City and District for the contractor to have worker's comp Mayor De Angelis stated it seems it is in the best interest of insurance coverage. Mayor De Angelis stated the Agendas will continue to be the responsibility of his office. Follow-up could be the department that did the minutes. Ald. D'Acquisto stated each department head should be responsible for implementing the policies set by a particular committee. Example, Public Works Committee asks people to be invited to a meeting, then the DPW secretary should send the letter inviting them. Ald.
