MINUTES OF MEETING HELD OCTOBJI1:Ft 14, 1994
The Board of Review of the Ci.ty of MuskeÇJo was called to order by
Chairman Lynda Guhr at 5: 30 P .þI[. Board members presnnt were
Mer1:on Bowyer, Gene Gaet.zke, and HE~nry Posbrig (arri"ed at 6:20).
Also present were Cole Layer Trumble (CLT) Representiltives Larry
Langowski and Mark Link, City Assessor Laura Mecha, (:ity Attorney
John Macy, and City Clerk Jean Maranda.
Attorney George Rice presented testimony on a motion on the
integrity of the process, supplementing his original Motion to
Quash. Mr. Larry Langowski presented rebuttal to At-~orney Rice's
tes1:imony. Mr. Gaetzke moved t~o dEmy mot:ion. Bowye:: seconded.
Carried 3-0.
The Board heard objections for the following:
Michael and Patti Backus
MarJLon Bently
Ted Tabbert (Did not appear)
Dennis Bartz
Leonard Wozniak
The Board made Determinations on ttll3 abovE~ objlection:;
On October 4, 1994, the Board. of Rmriel,ý' moved to sUS' :ain the City
assessment with regard t.O the objec.tions filed by Ha:~riet Rice
and Joyce Miles and dirE!ctedthe Ci.ty At1:orney to pr'~pare written
decisions. Mr. Gaetzke moved to adopt the Findings .)f Fact and
DetHrmination as drafted by Cit:y Attorney for the Ri,:e property
(Tax Key No. 2287.009). Mr. Bowyer seconded. Carri,~d 3-0. Mr.
Gaetzke moved to adopt the Findings of Fact and Dete~mination as
drafted by City Attorney for the Miles property (Tax Key Nos.
2287.015 and 2287.015.0(1). Mr. Bm.,yer seconded. Clrried 3-0.
Mr. Posbrig did not vote since he had not been preselt at the
October 4, 1994 meeting.
A Motion to File Late Objection to Board of Review WiS submitted
by Paul and Anna Stankevich. Mr. Posbrig moved to h!ar
objection. Mr. Gaetzke seconded, carried. The Boari heard and
made their Determination on the Stankevich objection.
A Motion to File Late Objection to Board of Review WiS submitted
by Donald and Nora Schneider. Mr. Gaetzke moved to 1ear
objection. Mr. Posbrig seconded, carried. The Boari heard and
made their Determination on the Schneider objection.
A Motion to File Late Objection to Board of Review WiS submitted
by Attorney Guy Charlton for the Eugene Slmmonis pro;>erty. Mr.
Gaetzke moved to hear objection. Mr. Posbrig second!d, carried.
The Board heard and madE~ their DetE!rmination on the Hmmonis
obj'3ction.
Assessor Laura Mecha presented October 14, 1994 lett!r to the
Board of Review listing Open Book Changes not posted. Mr.
Gaetzke moved to accept 1, 2, 3 and 5 of changes asking Assessor
to attempt to obtain stipulation. Mr. Posbrig seconjed. Carried
4-0. Issue No.4 will be reviewed at October 15 Board of Review.
Mr. Gaetzke moved to adjourn to 9:00 A.M. on Saturda{, October
15, 1994. Mr. Bowyer seconded. Carried 4-0.
