MINUTES OF MEETING HELD MAY 22/ 1995
The Board of Review of t~he City of IMuskeqo was calle,! to order
by City Clerk Jean Marenda at 10:00 A.M. Also preselt were
board members Lynda Guhr, Michael Hanrahan, Thomas K.ntis,
Eugene Gaetzke and Henry Posbring, and City Assessor Laura
Mecha.
Clerk Marenda reported t.his meE!tinçr was noticed in a, :cordance
with the Open Meeting LalW on :May 4/ 1995j, and subseq'lent
amendment was also noticed.
Clerk Marenda gave Oath of Office to all Board membe~s.
Clerk Marenda requested nominations for Chairman. M~. Gaetzke
nominated Lynda Guhr. JYlr. Kint:is sleconded. As ther'~ were no
other nominations, Ms. Guhr 'W'as elE!cted Chairman.
Chairman Guhr requested nominations for Vice Chairma:l. Mr.
Gaetzke nominated Mike Hanrahan. M~. Hanrahan decliled. Ms.
Guhr nominated Gene Gaetzke. Mr. Kintis seconded. .\s there
were no other nominations, Mr. Gaetzke was elected V.ce
Chairman.
Assessor Mecha presented her report. 1995 Valuation is at
$973,815,870 which is an approximate $40,000,000 inc;ease over
1994, excluding manufact.uring. A number of 1994 cas'~s are
coming back to the Board from Circlli t Court. 'We neel! to have a
cleaner and clearer record th.is year. Assessor Mech.l explained
the process of reviewinçr the roll. The roll is estinated at
96% of fair market value.
Clerk Marenda reported t.hat three t.axpaYE~rs have fil,~d
objections. Two of the appoLnt:ment::s are scheduled f,>r this
evening. One of those objectors, Mr. Mahoney is pre;ent. Mr.
Mahoney asked if his objection could be heard at thi; time.
The Board agreed to hear the objection.
Clerk Marenda read the objection of John Mahoney, Sl)6 W20503
North Shore Drive, Key No. 2281.991. Total property assessment
is $186,700. The property owner's opinion of the faLr market
value as of January 1st is $125,000. Clerk Marenda 3wore in
John Mahoney and Assessor Mecha.
Mr. Mahoney presented his case which included the following
information. He said that LakE~ Denoon is shallow. '['he south
and ease shores are excellent, the west is conservatLon and the
north shore where his property is located is swampy lnd weedy.
Neighbors put in retaining walls to improve their pr>perties,
but his was left in the natural state. A land divisLon has

Parcel 1. He didn't believe all the properties shouLd be at
$1,600 per ft. because it's not fair. This is not p~ime
property. The view and location are nice, frontage las
something to be desired. HOU.SE~ built .in 1920 as a bo)athouse
and gradually updated. Believe house value is okay. Disagree
with value on frontage. Property has 112 ft. of froltage.
Mr. Mahoney responded to several qUiestlons by Board J lembers .
Assessor Mecha presented a cert:ifiE!d survey map, mar~ed by
Clerk as Exhibit 1 and al sales comparaJbIE~ sheet mark, ~d as
Exhibit 2. Record shows this property was built in L917 and is
a duplex with 2,228 sq. ft. Visited property on May 15 and did
walk shore line along north shore. Th~a certified sU.~vey map
shmvs the property was s:plit in 1994. Parcel 2 was ,;old for
$320,000. New assessed value for Parcel 2 is $307,9 )0. She
did not see any evidence of conservancy land as she 'Talked the
shore line with no lilypads or catt:ails and no diffe.~ence in
shore line except for seawalls. The $1,600 per fron: foot is
used as a base model. 'I'here are adjus"tmEmts made A' e: ;pecially
in this case for excessive depth and the road coming in, and
how close the dwelling 1s to the shore line. 'rhe ra :ing on the
comp sheet is poor taking into account the condition of the
property overall because of its age. The only three
comparables of duplexes are shown on the comp sheet.
Cross examination occurred. :Mr. Mélhonlay had to leav, ~ at this
time. Chairman Guhr declared t:estimony closed and a;ked when
Board wished to deliberate. Mr. Gaetzke moved to de.iberate at
this time. Mr. Kintis seconded, motion carried.
The Board deliberated. Mr. Gaetzke felt no testimoITr was
presented that disputed the assessor's value, and ba;ed on the
recent sale of Parcel 2, Mr. Gaetzke moved to sustail the
AssE~ssor' s value. Mr. Posbrig seconded based on no ,:oncrete
evidence to do otherwisE~. Ot,hE~r rE!,asons stated were the
comparables presented by the City and .thE~ Parcel 2 s' l1e.
Carried 5-0.
The 6:30 PM evening appointment with Mr. Mahoney was cancelled
as he had already appeared. Due to a death in the flmily, the
Lud\vïg/Strampe hearing \\ras changed from 7:: 00 PM toniJht to
Thursday at 7:45 PM. An objection was filed by Rogilske and
the appointment set for 7:15 PM Thursday, 5/25/95.
At this time the Board went off the record to review the
AssE~ssment Roll. The Board v'llil br,eak a1: noon and r'~sume
reviewing the roll at 1:00 PM.
Clerk Marenda reported t~hat a,t 3: 00 PM, ~1r. Nickels, Ippeared to
ObjE~ct to his personal property asslessment. The Ass.~ssor
explained that personal property is a self-reporting form due
March 1st. If not submitted by April 15th, a doomag.!

if he can do so and have the records corrected. The Board
sta1:ed they would set an appointmen-t to hear his objqction at
6:45 PM on Thursday, 5/25/95 in the Wisconsin Room. Mr.
Nickels agreed to time and date.
The Board continued reviewing the roll.
Back on the record at 4:00 PM, Chairman Guhr noted t:1at Board
Member Posbrig left the meeti:nçJ at2: 30 PM, but a quo)rum
remains.
Cha:Lrman Guhr reported t-hat t.hE! Brauch ob:iection fill!d in 1994
and appealed to Circuit Court has Ì>ieen rE~manded to t: 1e Board
for a new hearing. The heari:nçr was se-t for Friday, ,rune 23,
19 9 !5 at 6: 30 PM.
Cha:Lrman Guhr asked if t-he Board wished to hear any I)bjections
filed after adjournment today. The Board determined that the
Clerk could accept a motion for a late hearing which would be
scheduled for Thursday night, and if reasons were lelJitimate
the objection could be heard at that time, if the 48 hour
notice was waived.
Mr. Kintis moved to approve the Assessment Roll for L995 with
the exception of objections filed by David Lud'wig and Judy
Stnlmpe, Charles and Arlene Roçrinske, and Kenneth Ni, :h01s for
personal property, with no further objections to be ~eceived
without permission of the Board, and fur1:her moved t,) adjourn
to ~rhursday, May 25, 1995 at 6:45 P.M. to hear the a)ove
objections. Mr. Gaetzke seconded, carried 4-0.
