CITY OF MUSKEGO BOARD OF REVIEW MINUTES July 27, 2017 5:00 PM Muskego City Hall, W182 S8200 Racine Avenue CALL TO ORDER Chairman Lynda Guhr called the meeting to order at 5:05 p.m. ROLL CALL Present: Board Members Gary Boisits, Lynda Guhr, Jeremy Keil, Henry Posbrig and Mara Spring. Also present: City Attorney Jeff Warchol, Deputy Clerk Jill Blenski and Assessor Mark Link from Tyler Technologies. STATEMENT OF PUBLIC NOTICE The Deputy Clerk stated that the meeting was noticed in accordance with the open meeting law. APPROVAL OF MINUTES - May 22, 2017 Gary Boisits made a motion to approve the minutes. Mara Spring seconded; motion carried. BUSINESS Board of Review Member Training Update The Deputy Clerk stated that since the May meeting, two additional Board members have completed training. This information was submitted to the Wisconsin Department of Revenue. Filing and Summary of Annual Assessment Report by Assessor's Office Mr. Link distributed the Annual Assessment Report to the Board. He reviewed the details of the Report, which is on file with the 2017 Board of Review documentation. Receipt of the Assessment Roll by the Deputy Clerk Assessor Mark Link presented the 2017 Assessment Roll to Deputy Clerk, Jill Blenski. The Assessor's Affidavit was completed and attached. If Necessary, Consider Changes to the Assessment Roll due to Amended Assessments Mr. Link noted that all changes made during the Open Book period have been incorporated into the Assessment Roll. Establish Procedures of Operation and Deliberations The Board determined it would deliberate after hearing an objection if time permitted. Otherwise, all testimony will be heard, with deliberations taking place at the end of the evening. Board of Review Minutes 2 July 27, 2017 Consider Waivers of Late Objectors Mr. Aaron Blazer (W130 S8478 Eagles Way) was present. He gave verbal notice of his intent to file an objection in person on July 10, 2017 at the Clerk’s office. Mr. Blazer stated he was told to appear at the Board on July 27. Mr. Keil moved to grant a waiver of the 48-hour notice. Mr. Boisits seconded; motion carried. Mr. Ryan Janssen (W182 S9230 Parker Drive) was present. He stated he was not aware that there is a process for property owners to object to their assessments. Mr. Boisits moved to grant a waiver of the 48-hour notice. Mr. Keil seconded; motion carried. Consider Request for Waiver for Board of Review Hearing and Request to Testify by Telephone or Submit Written Statement(s) Wal-Mart Real Estate Business Trust, W159 S6530 Moorland Road, Tax Key No. 2169.903 The agent for the property owner, Wal-Mart Real Estate Business Trust, has submitted a Request for Waiver of Board of Review Hearing. The basis for the request stated on the form is that the property owner intends to take matters directly to circuit court. Chairman Guhr requested to recuse herself and have Vice-Chairman Boisits assume the Chair. Ms. Guhr stated she is a retired Walmart employee. Chairman Boisits moved to grant the waiver. Mr. Posbrig seconded; motion carried. Hearings and Decisions on Objections to Property Assessments The Board heard the following objections: David and Bertha Brandt Tax Key No. 2170.992 S63 W17176 College Avenue Mr. Posbrig moved to sustain the Assessor’s valuation. Mr. Keil seconded. Motion carried 5 in favor. Kevin O’Leary Tax Key No. 2212.068 S83 W13004 Hawks Trail Ms. Spring moved that the Assessor’s valuation is incorrect and that the value of the property is: Land $151,200 Improvements $338,800 Total $490,000 Mr. Keil seconded. Motion carried 5 in favor. Samuel Erickson Tax Key No. 2191.043 S75 W20131 Ridge Road Mr. Keil moved that the Assessor’s valuation is incorrect and that the value of the property is: Land $ 62,900 Improvements $152,100 Total $215,000 Ms. Spring seconded. Motion carried 5 in favor. Jeffrey and Sandra Kubel Tax Key No. 2227.034 W198 S8506 Bendingbrae Drive Board of Review Minutes 3 July 27, 2017 Mr. Keil moved to sustain the Assessor’s valuation. Mr. Posbrig seconded. Motion carried 5 in favor. The Board took a brief recess. William and Carol Evers Tax Key No. 2258.038 S97 W13725 Stonebridge Way Mr. Keil moved to sustain the Assessor’s valuation. Ms. Spring seconded. Motion carried 5 in favor. Jared Aeschbach Tax Key No. 2167.048 S70 W14925 Dartmouth Circle Mr. Boisits moved that the Assessor’s valuation is incorrect and that the value of the property is: Land $ 51,100 Improvements $179,400 Total $230,500 Hear Any Other Motions and Waivers Authorized by Law There were none. Review the 2017 Assessment Roll and Perform Statutory Duties The Board stated it would do this at the next meeting.
