BOARD OF REVIEW Minutes 051399 BOARD OF REVIEW CITY OF MUSKEGO MINUTES OF MEETING HELD MAY 13, 1999 The Board of Review of the City of Muskego was called to order by Chairman Lynda Guhr at 4:35 PM. Also present were Board Members Collette Klenz, Tom Kintis, Henry Posbrig (arrived 4:45 PM), and William Jasinski (arrived 5:30 PM), Atty. John Macy representing the Board, Assessor Laura Mecha, Court Reporter Gayle Pruefert and Clerk-Treasurer Jean Marenda. Clerk-Treasurer Marenda stated the meeting was noticed on May 11, 1999 in accordance with the open meeting law. Clerk-Treasurer Marenda called the case of St. Luke’s Medical Center, Tax Key No. 2198.985, S74 W16775 Janesville Road. Assessed value $321,300 land and $1,054,000 improvements for a total of $1,375,300. Property owners opinion of fair market value $1,260,300. Clerk Treasurer Marenda swore in the taxpayer’s representative Mr. Steven Hader of Irgens Development and Assessor Mecha. The Board hear testimony from Mr. Hader and Assessor Mecha. Board member Posbrig arrived during testimony. Mrs. Klenz moved to sustain the Assessor’s valuation. Mr. Kintis seconded. Motion carried 3-0 with Mr. Posbrig abstaining as he was not present when the testimony began. Board Member Jasinski arrived at 5:30 PM. Atty. Macy advised the Board that the next four objections filed would have separate records, but the opening and closing statements by both counsel can be included in the record of all four cases. Testimony given in the first case can be stipulated to be entered into each of these cases. The Board agreed. Clerk-Treasurer Marenda called the case of Arthur D. Dyer, Tax Key No. 2233.996.003, W208 S8901-03 Hillendale Drive. Assessed valuation $67,700 land and $517,800 improvements for a total of $585,500. Property owners opinion of fair market value $0.00-no value. Clerk-Treasurer Marenda swore in Arthur Dyer and his witnesses Dr. Pratop Singh, Dilip Singh and Peter Moegenburg, Anthony Vitrano and Thomas Vitrano, and Assessor Mecha. Opening statements were made by Atty. Dick Frederick, present to represent Arthur Dyer, Anthony Vitrano and Thomas Vitrano, and Atty. Mike Schober representing Assessor Mecha. The Board heard testimony from Arthur Dyer, Dr. Singh, Mr. Singh, Mr. Moegenburg and Assessor Mecha. The Board determined they would hear the cases of Anthony Vitrano, Thomas Vitrano and Arthur Dyer (vacant parcel) before rendering a decision. Clerk-Treasurer Marenda called the case of Anthony and Betty Vitrano, Tax Key. No. 2233.996, W208 S8861 Hillendale Drive. Assessed valuation of land $39,300 and improvements $139,300 for a total of $178,600. Property owners opinion of fair market value $0.00-no value. The Board heard testimony from Anthony Vitrano and Assessor Mecha, who were previously sworn. The Board agreed that the prior testimony and cross examination in the Arthur Dyer case be applied to this case. Board of Review Page 2 May 13, 1999 Clerk-Treasurer Marenda called the case of Thomas A. Vitrano, Tax Key. No. 2233.998, W207 S8710 Hillendale Drive. Assessed valuation of land $34,100 and improvements of $97,900 for a total of $132,000. Property owners opinion of fair market value $0.00-no value. The Board heard testimony from Thomas Vitrano and Assessor Mecha, who were previously sworn. The Board agreed that the prior testimony and cross examination in the Arthur Dyer case be applied to this case. Clerk-Treasurer Marenda called the case of Arthur D. Dyer, Tax Key No. 2233.997, vacant parcel in Pt NE ¼ Sec 19. Assessed valuation of land $41,300. Property owners opinion of fair market value $0.00-no value. The Board heard testimony from Arthur Dyer and Assessor Mecha, who were previously sworn. The Board agreed that the prior testimony and cross examination in the Arthur Dyer case be applied to this case. Closing statements were made by Atty. Frederick and Atty. Schober. Upon completion of deliberations, in the case of Arthur D. Dyer, Tax Key No. 2233.996.003, Mrs. Klenz moved to sustain the Assessor’s valuation. Mr. Jasinski seconded. Motion carried 4-1 with Mr. Kintis casting the dissenting vote. In the case of Anthony Vitrano, Tax Key. No. 2233.996, Mrs. Klenz moved to sustain the Assessor’s value as corrected during testimony of $36,300 land and $139,300 improvements for a total of $175,600. Mr. Jasinski seconded. Motion carried 4-1 with Mr. Kintis casting the dissenting vote. In the case of Thomas Vitrano, Tax Key No. 2233.998, Mrs. Klenz moved to sustain the Assessor’s value as corrected during testimony of $24,100 land and $97,900 improvements for a total of $122,000. Mr. Posbrig seconded. Motion carried 4-1 with Mr. Kintis casting the dissenting vote. In the case of Arthur Dyer, Tax Key No. 2233.997, Mrs. Klenz moved to sustain the Assessor’s valuation. Mr. Jasinski seconded. Motion carried 4-1 with Mr. Kintis casting the dissenting vote. Mrs. Klenz moved that the 1999 Board of Review hereby approves the final assessment roll as amended by these decisions, having performed all of its statutory duties and completed all of its work that came before the Board, the Board of Review adjourns sine die, subject to the Clerk fulfilling the Clerk’s statutory duties.
