BOARD OF COMMISSIONERS
MINUTES OF SPECIAL MEETING HELD TUESDAY, DECEMBER 10, 1996
The meeting was called to order at 7:50 P.M. by Mayor De
Angelis. Also present were Commissioners D'Acquisto, Patterson,
Pionek, Rasmussen, Salentine, Sanders, and Suhr, City Attorney
Molter, Deputy Clerk Blenski, and Deputy Commissioners Pilak,
Slocomb and Kreiser.
The Deputy Clerk reported that the meeting was noticed in
accordance with the Open Meeting Law on December 6.
Reso. #BML 4-96 - Resolution to Retain Special Counsel to
Represent the Big Muskego Lake/Bass Bay Protection &
Rehabilitation District (Schober & Schober). Commissioner
D'Acquisto moved for adoption. Commissioner Rasmussen seconded.
Mayor De Angelis stated that separate counsel was required to
represent the lake district in this matter and that Schober &
Schober have represented the Big Muskego Lake District in the
past. Deputy Commissioner Pilak requested information about
what transpired. Mayor responded the City and Big Muskego Lake
District have received Notice of Claim. The Mayor has had
contact with the DNR, who are mentioned in the Claim but not a
named party. He has not been contacted by the Wind Lake
Management District. The City is proceeding upon advice of
counsel in the matter. Commissioner D'Acquisto asked what Wind
Lake is alleging in the Notice of Claim. Attorney Molter
responded by paraphrasing the language contained in the claim
documentation. Motion carried.
Commissioner Suhr moved to approve entering into the Joint
Funding Agreement with the U.S. Geological Survey, U.S.
Department of the Interior. Commissioner Salentine seconded,
carried.
Under communications and any other miscellaneous business,
Deputy Commissioner Slocomb presented a brief update on the lake
level and the island construction project.
Commissioner Salentine moved to adjourn at 8:05 P.M.
Commissioner Sanders seconded, carried.
