BOARD OF COMMISSIONERS
MINUTES OF QUARTERLY MEETING HELD THURSDAY, MARCH 30, 1995
The meeting was called to order at 7:05 P.M. by Mayor De
Angelis. Also present were Commissioners Patterson, Misko,
Sanders, Taube (arr. 7:15 P.M.) and Woodard, City Clerk
Marenda, and Deputy Commissioners Pilak and Herda.
Commissioners D'Acquisto and Dumke were absent.
City Clerk reported that the meeting was noticed in accordance
with the Open Meeting Law.
Commissioner Patterson moved for approval of minutes of the
January 30, 1995 meeting. Seconded by Commissioner Sanders,
motion carried.
Deputy Commissioner Leonard Pilak stated he had given a report
on the status of the Priority Lake Watershed Program at the
January meeting. The next quarterly meeting of the group will
be next week. Educational programs with the schools are
continuing. They would like to get back into stenciling of the
sewer system program. Boy Scout and Girl Scout troops are doing
that project. Mayor noted that a Wind Lake group wants to
create about 500 acres of additional wetlands adjacent to Big
Muskego Lake, with entry and exit points bypassing Big Muskego
Lake Dam. Deputy Commissioner Pilak stated this is a private
plan, not part of the Priority Lakes Watershed. Mayor noted he
had questions on how they will control water flow and level of
the lake. It seems their philosophy is 80% of their phosphorus
loading comes from Big Muskego Lake and they hope this plan
would filter the water.
On the status of the Southeast Sewer Service Area, Mayor stated
the City has let the bids for the forcemain this week. We have
one more easement to procure before we can proceed with the
notice to proceed. The Hwy. 36 lift station bid should be let
in the next three weeks. Still looking at an October date for
the forcemain and March 1996 lift station completion. The
Boxhorn Ryan Groveway sewer project should start in June or July
with a proposed completion date yet this year.
Deputy Commissioner Pilak reported on the status of the Lake
Management Plan. He stated that Governor Thompson's budget
bill has slashed the DNR budget for the proposed restoration
program. However, there are other funding possibilities.
Papers have been filled out and sent in to these various
agencies, one being the North American Wetlands Conservation
Act. This group is interested in lake restoration, especially
long term commitments. If you commit yourself in a letter
stating you are going to do X work at X dollars, those dollars
can be put toward the cost sharing program. Those projects
already completed and paid for by the district will qualify.

r" We are looking to acquire $165,000 from this program. The
application date is April 4 and we should hear in 30 days after
that date. We are very hopeful this program will be approved
for a grant. If the grant gets approved the basic plan that we
presented in March 1994 will continue to be the plan used only
the scheduling will change. The Rotenone treatment was the most
expensive portion. We would draw down the lake as planned. We
would hope for a good winter and spot Rotenone Bass Bay, let the
Big Lake freeze out for the winter and possibly hire a company
to seine or net carp. We will have a year to get another grant
for the poison before we refill the lake the following fall. We
can still do an effective draw down program this fall. The
extent of the project will be dependent on the money available.
Mr. Dale Galten expressed concern that this plan was altered
from that presented at the annual meeting, now that we are not
going to poison and not do as planned. He did not think you
could just draw down the lake and not poison, it's a whole new
ballgame.
Deputy Commissioner Pilak stated the Lake District voted on a
proposed plan with a time table which was not set in stone.
You are dealing with mother nature as to scheduling, however,
it is a good point.
Commissioner Taube arrived at 7:15 P.M.
Commissioner Misko asked if the Deputies were in communication
with the Little Muskego Lake District. Deputy Commissioner
Pilak said we understand they're asking for another foot of draw
down this year and thought we would have to allow room for the
extra foot and would then have to start in August instead of
September. We have also met with the Little Muskego Lake
Anglers group.
Deputy Commissioner Sanders asked, "Then this proposed funding
will allow you to continue with the program?" Pilak responded
that nothing basically will change with this funding. Draw down
doesn't basically cost anything. There is some funding for
pumping if required. The way we had it set up the time table
won't change.
Mayor De Angelis noted there is about 1.3 million dollars of
grants specifically designated for wetland enhancement of Wind
Lake. If they remove that, would that jeopardize our program?
What if they get that project approved and the City of Muskego
and the District find it is not in our best interest? Can we
tell them not to touch our lake, because we don't like their
plan? Deputy Commissioner stated it is his understanding that
if any part of this plan is nixed, it would not affect the other
parts. Mayor felt that the City would have some say as far as
diverting water out of our lake away from our dam. He has
discussed it with Mr. Sturtevant of the DNR. They have not
talked about it as part of water management at all.

Mark Paulet reported on the status of the public boating access
and parking area. He advised the DNR has requested a signed
resolution stating that the City has the money in an account to
cover our share of the ramp and overflow parking area.
Apparently the grant application was submitted without that
resolution. It will be placed on the April llth Council agenda.
He stated that there are eleven more days until our 30 days
expires for comments to be submitted to the DNR on our
application for disturbing an area of 10,000 feet or greater.
He added that he will be working with Mr. Thomas who is the
property owner between the access site and the parking lot to
keep people off his property. Commissioner Taube asked, "Do you
think the gentleman might be receptive to selling a piece of his
property where the three parcels meet?" Deputy Commissioner
Pilak felt he was more concerned about people being in his front
yard and various options have been discussed with him.
Commissioner Taube questioned the dredging of the canal. Pilak
reported it is in the works with the DNR.
Discussion on the status of the purchase of land from Wisconsin
Electric Power Company (WEPCO) for parking access was removed
from the agenda as that property is now owned by the City and
has been rezoned.
The City Clerk reported the following vouchers had been issued
