MINUTES OF SPECIAL MEETING HELD FEBRUARY 28, 1994
The meeting was called to order at 7:07 P.M. by Mayor De
Angelis. Also present were Commissioners Patterson, Dumke,
Misko, Sanders, Taube and Woodard, City Clerk Marenda and Deputy
Commissioners Pilak, Herda, Kreiser and Sorenson. Commissioner
Schneider and Deputy Commissioner Klenz were absent.
Also present were Jim Jackley, Dan Helsel, Sharon Gayan and Jim
D'Antuono of the DNR.
Commissioner Misko moved for approval of minutes of Quarterly
Meeting held January 25, 1994. Commissioner Sanders seconded,
carried.
Mayor De Angelis reported on the status of the transfer of dam
ownership. He stated the DNR still has some items to clarify.
He hopes that within the next 30 days everything will be all
signed. With regard to the Public Access Site, he is meeting
with the City Engineer and City Attorney due to a problem with
the survey in that the legal description does not close. It is
not known exactly what the property boundaries are. The most
economical way to resolve is through an Assessor's Plat. Also,
'^ this property does not directly abut Big Muskego Lake. There is
property between this parcel and the lake which is under the
water 50% of the time, but is shown as above the high water
mark. There is no owner of record and it is not on the tax
roll. Trying to determine if the channel that goes to the lake
is an access point. Apparently it does and would still meet our
needs. The survey with wetland delineation indicates space for
parking two cars on the property. Some property exchange might
allow 5-6 cars. Also, the channel has to be dredged. Still
proceeding at this point. What are your feelings on proceeding
with the process?
Commissioner Taube stated the Little Muskego Lake District has
done some dredging projects in the winter and used a contractor
doing this type of work. Suggest looking at that time frame for
excavating the soils to lessen the cost of the dredging.
Commissioner Misko questioned the cost. Mayor De Angelis
responded looking at about $5,000 unless someone protests the
Assessor's Plat. Commissioner Misko asked if we are still
looking at other parking places. Deputy Pilak stated we would
like to see more spaces available. Haven't yet contacted WEPCO.
Taube asked how much above high water mark do you have to be for
parking. How far below the standard is the property? Deputy
Pilak stated he hasn't seen the survey yet. Mr. Dan Helsel of
the DNR stated they are looking for non -wetland area rather than
considering the high water mark. Taube asked if the material

�-- from the dredging could be used to increase the parking area.
Mr. Helsel stated the minimum standard for parking spaces is
closer to 30. We'll eventually have to look for offsite parking
someplace. Looking for a start to provide public access.
Mayor De Angelis added that the channel doesn't go all the way
to the open water. Does that present a problem in creating a
channel where one doesn't exist? Mr. Helsel said it shouldn't
be a problem because historically we can show it did exist at
one time.
Deputy Pilak stated another group has requested public access at
Boxhorn. They have some desire in obtaining help from the State
in putting an access in. Mayor asked if we should just consider
pursuing this site. Deputy Pilak responded he didn't know if we
could get all required parking at this time.
Mr. Jim D'Antuono, SED Water Resource, Planning Unit Leader
(DNR), discussed the Muskego-Wind Lake Priority Watershed
Project. The plan has been prepared for a cost effective way to
deal with contributions of rainfall and runoff. This program in
conjunction with In -Lake Management would bring plan full
circle. The plan is now operational. Implementation will be by
City staff. The project is for 8 years, with $5.3 million State
funds available. The Freedom Square ponds are one of the
projects. The City is in the process of hiring a staff person.
Commissioner Misko stated he felt there should be a holding pond
across the street (from Freedom Ponds), which was not addressed
by R. A. Smith. He asked if anybody looked upstream on the
creeks leading into these ponds. Mr. D'Antuono reported they
looked at all sources. Misko asked to be included in all
technical meetings.
Commissioner Taube questioned if anything had been done about
reviewing the Westpoint development in New Berlin. Mr.
D'Antuono stated you need to address storm water management
options with the City of New Berlin.
Mr. Jim Jackley, SED Water Resources, Project Manager (DNR),
stated $8,000,000 may be spent throughout the total boundary
area. Without in -lake management, you wouldn't see any
improvement in current quality. This plan is in conjunction
with the priority lakes projects. Mr. Jackley reviewed the
Objectives of the Lakes Restoration Project and the Project
Components as presented in his handout. He advised the district
has applied for a Lake Planning Grant. A study should occur
this summer, with funding to be determined soon.
Ms. Sharon Gayan, SED Water Resources Supervisor (DNR),
reviewed a handout on the Proposed Project Funding and DNR
Commitment. She indicated that after the March 21st BML
District meeting, the DNR needs clear direction as to the way to
go. They will need the full support from the City and the

public. The City share of the cost over the eight year program
is $1.2 million.
Deputy Commissioner Pilak advised the Deputies took polls of
Lake District members to determine what they wanted from the
lake. Responses included boating/fishing, aesthetics, winter
use, hunting. The Deputies put together the plan with the DNR
for formal presentation to the District members.
Commissioner Dumke stated he felt a two-year drawdown would be
more beneficial.
Commissioner Sanders asked how much will the landowners have to
pay. Deputy Pilak said they would be looking at increasing the
assessments, but no estimate is available at this time. Sanders
also felt it was important to make people aware that "boating"
wouldn't include speed boats for water skiing. He also
questioned if the fishery would be sustainable, or would there
be freeze outs.
Mr. Dan Helsel stated the goal is to maximize fishing system and
protect Bass Bay. Sanders asked if there was any thought to
creating a deep hole in Big Lake to sustain fishery. Mr. Helsel
stated there would have to be many deep holes in the Big Lake to
provide the dissolved oxygen necessary.
Ellen from Senator Adelman's office encouraged the proceeding
with these projects.
Commissioner Patterson moved to adjourn at 9:05 PM.
Commissioner Taube seconded, carried.
