MINUTES OF MEETING HELD MARCH 26, 1991
The meeting was called to order at 7:40 P.M. by Mayor
Salentine. Also present were Commissioners Dumke, Hilt,
Patterson, D. Sanders, H. Sanders, and Simmons, and City Clerk
Marenda. Commissioner Taube was absent. Also present were
Deputy Commissioners Flancher, Proeber and Pilak.
Simmons moved for approval of minutes of meeting held January
22, 1991 and the informational hearing held March 26, 1991, D.
Sanders seconded. The hearing minutes were corrected to note
the only representative of the DNR present was Mr. Neal
O'Reilly. Carried.
Commissioner Dumke presented an update on the Emerald Park
Landfill negotiations noting the public hearing has been held.
The agreement includes $60,000 put aside for cleaning the ditch
from the landfill to Big Muskego Lake. There is well protection
and property protection. People in area weren't happy with
siting of landfill but satisfied with agreement negotiated. In
response to a question from Deputy Commissioner Proeber, Dumke
noted at this time no sewers are in the immediate future for
this area.
On the status of the sewer facilities plan, Commissioner Simmons
stated the study has been completed and there is nothing else to
report at this time.
Mayor reported on the status of the transfer of the Big Muskego
Lake Dam. He advised he met with the DNR and they will take the
responsibility of obtaining property rights.
Deputy Commissioner Pilak reported on lake access. He advised
the DNR has sent a rough draft of a proposed agreement between
the City and Sam Klauser. He would like to meet with the City
to review several points in the agreement. He believed the
agreement can be worked out to have a launch site at Hunter's
Nest. Pilak was requested to set up a meeting date with Sam
Klauser and the Mayor and the Big Muskego Lake aldermen.
On the Wind Lake study, Deputy Commissioner Pilak presented a
brief overview of plans presented by SEWRPC and the DNR
regarding the killing of rough fish, and drawdown and dredging
channels. He presented a written statement stating that this is
not a suitable program because it would only be a temporary
fix. Deputy Commissioner Proeber stated other lakes have failed
with drawdown.
Mr. Robert Klenz, S79 W15979 Sandy Beach Drive, stated that back
in the late 1960's the City's sewage settling ponds were
installed. Those ponds did major irreversible damage to Big

Muskego Lake and he believed the City of Muskego has a legal and
financial responsibility towards cleanup of Big Muskego Lake and
felt it should be discussed in the future. The DNR and the Corp
of Engineers are looking to participate in the cleanup.
Deputy Commissioner Proeber felt that dredging the Lake and
making islands could be a solution.
Commissioner D. Sanders questioned what the people on the Lake
are interested in. Proeber responded "fishing," and Flancher
added "using boats and duck hunting." Pilak stated again the
drawdown would be temporary fix and would have to be done over
and over.
Commissioner Dumke stated he hoped the district can get some
grants. He said raw sewage was dumped in Big Muskego Lake and
Bass Bay and approved by the DNR.
Mr. Klenz stated he believed the City settlement with MMSD
permits using the Sandy Beach lift station as an outlet for
pumping raw sewage into the Lake and he would hope that the
Utilities Committee looks at alternatives for bypassing
elsewhere or building storage facilities. Mayor responded the
Utilities Committee has not decided the bypass areas. If the
DNR approves the flow restrictors, there would be computerized
control and it would still run to MMSD unless it was area -wide
storm.
Ms. Kathy Aron, president of the Wind Lake District, stated that
district was created in 1985 at a time when the Big Muskego Lake
District was not active. We knew there was an option to do a
drawdown; we were being pressured to sue the City and district
at that time. We felt we could do better by getting data and
finding out the problem. The problem in Wind Lake is 50% Big
Muskego Lake and problems with our own watershed. She was
disappointed at the approach the Big Muskego Lake District has
taken. She said she only heard that they did not like the
report, but did not hear what can be done. There are not, in
today's technology, ways that are cost-effective to deal with
nutrients in the bottom of Big Muskego Lake. We have
commitments from the State of Wisconsin to receive $700,000 with
$250,000 to be spent on Big Muskego Lake and I'm hearing today
you want to turn away. I will have a very difficult time going
back to Wind Lake without significant pressure to start legal
action. She noted cattails can be handled when they start to
happen, not after they are a problem. She received only two
calls from Big Muskego Lake people as to the findings of this
report.
Commissioner Pilak responded that they were given a proposal and
did not like it. They have not had time to talk to the DNR to
present their alternatives. They are willing to work with the
Wind Lake District and are in the process of re -contacting the
Big Muskego Lake/Bass Bay Protection
& Rehabilitation District Board of

DNR after this meeting and requested action be deferred at this
time.
Deputy Commissioner Proeber stated the Wind Lake District has
been preparing this plan for years. They need time to review
and propose alternatives. Up to now, the DNR wouldn't listen to
them because of their lake access problem.
Commissioner D. Sanders moved to defer decision on Wind Lake
request pending the Deputy Commissioners' review of options.
Commissioner Dumke seconded. Carried.
Patterson moved to approve payment of voucher in the amount of
$400 to Mr. Les Proeber for a boat to pull net to seine fish and
$16 to the City for topographical maps requested by Mr. L.
Pilak. Simmons seconded, carried.
Commissioner D. Sanders moved to adjourn at 8:05 P.M.
Commissioner H. Sanders seconded. Carried.
