BOARD OF COMMISSIONERS
MINUTES OF MEETING HELD JUNE 14, 1983
The meeting was called to order by Chairman Salentine at 8:12 P.M.
Also present were Commissioners Penovich, Colburn, DeAngelis,
Dumke, Nilsson and Tomczyk, City Clerk Stewart and City Attorney
Molter. Commissioner Gaetzke was absent.
Commissioner Tomczyk moved for approval of the minutes of the
March 22, 1983 meeting. Seconded by Commissioner DeAngelis,
motion carried.
Deputy Commissioner Estel Ellery reported on the status of the
Scott Krause litigation. lie advised that Atty. O'Connor had
informed him that Mr. Krause had failed to file a brief, and
that Judge Nettesheim set a date for approximately June 27th for
a final disposition of these proceedings.
A letter to Mr. Ellery from Atty. O'Connor dated March 11, 1983,
was read by the Clerk.
Commissioner Nilsson moved to set the date for the Annual Meeting
for August 22, 1983. Seconded by Commissioner Penovich, motion
carried.
Commissioner Dumke moved for payment of vouchers in the amount
of $303.80 to O'Connor Law Offices. Seconded by Commissioner
Tomczyk, motion carried unanimously.
Since it was originally determined that legal fees for litigation
of the Krause matter would not exceed $1,000, Commissioner Nilsson
moved to pay additional vouchers to a limit of $1,000 for legal
expenses in the Krause matter. Commissioner Tomczyk seconded the
motion. The Commissioners noted that out-of-pocket expenses would
be excepted from this limit. Commissioner Nilsson requested
that a letter be sent to Atty. O'Connor at the time the check is
transmitted, to inform him of the limit set for legal fees. Upon
roll call vote on the motion, the motion carried unanimously.
The Commissioners reviewed the audit of the Big Muskego Lake/Bass
Bay Protection and Rehabilitation District.
Commissioner DeAngelis questioned the status of a petition for
changing the structure of the District. Deputy Commissioner Ellery
advised that he would attempt to locate the petitions and obtain
the signatures.
Commissioner Penovich moved to adjourn at 8:27 P.M. Seconded by
Commissioner Dumke, motion carried.
