BMLCommM19810324BIG MUSKGEGO LAKE/BASS BAY PROTECTION AND REHABILITATION DISTRICT BOARD OF COMMISSIONERS MEETI:JG HELD MARCH 24, 1981 Chairman Gottfried called the meeting to order --it 7.1.0 P M. Also present were Commissioners Steinberg, Weed, Radtke, Van Lanen, Knudsen, Salentine and Dumke and City Clerk Stewart. Chairman Gottfried advised those present the purpose of this meeting is to con6ider the request of several of the individuals living within the district to be der ached from the district. The matter had been referred to the Deputy Commissioners and he then requested Deputy Commissioner Chairman Estel Ellery to report on the findings of the Deputy Commissioners. Mr. Silery advised the recommendation of his committee is that the boundaries of the district remain the same. Mr. Orlo Zlensky expressed concern there had not been a quorum at the last meeting of Mr. Ellery's committee, however, Mr. Ellery advised a telephone poll had been taken of all of the members of the committee and it was a unanimous consensusthe boundaries not be changed. Also , th e re was no physical or financial hardship on any of the property owners presently in the district. He.further stated that several of the property owners were quoted as saying thev did not use the lake and that they were farther from the lake than some of the property owners that had been removed from the district in 1980. Commissioner Salentine moved that the two parcels of land in the 6th District, the Schriebers and the Rae property, be acted on separately. Motion was seconded by Commissioner Knudsen. Discussion took place during which Mr. Ellery advised that in his discussions with Mr. Schreiber, Mr. Schreiber was not concerned as to why he was in the district but why property owners across the street were not in the district. Further discussion took place regarding the distance of certain property owners in the district from the lake. Commissioners Dumke and Knudsen expressed concern over the number of people who want out of the district, however, at the annual meeting there was an overwhelming vote not to dissolve the district. Mrs. Frances Fleece, S94 W13272 Ryan Drive, expressed concern that her request for detachment had not been acted on since she had presented same to the Board of Commissioners on August 26, 1980 and the request at that time was immediately turned over to the Deputy Commissioners for recommendation. Commissioner Radtke advised that there a r e other requests the Deputy Commissioners will be giving a recommendation on. Commissioner Salentine again expressed concern over the fact that property owners on Heinrich Drive and Thode Drive live again as far from the lake as the two he is requesting detachment for. Mr. Ellery advised that his ccmmittee was elected at the annual meetirs of the district, they have all lived on the lake 30 years or more and they have tried to be as fair as possible. Upon a roll call on Commissioner Salentine's motion, Commissioner, Knudsen, Salentine and Van Lanen voted "aye". Commissioners Dumke, �► Radtke, Steinberg and Weed voted "no". Commissioner Salentine's motia did not carry. Page 2. 3/24/81 Commissioner Salentine moved to accept the request f,r detachment from the Big Muskego Lake/Bass Bay Protection and Rehabilitation District from Mr. and Mrs. John Kelly. Seconded by Commissioner Knudsen. Mr. Zlensky advised that he had also requested to be detached from the district in August of 1980 and he felt he would like an answer at this meeting. Mr. Ellery advised that his committe'l had studied all of the requests for detachment and the recommendation was those people should remain in the district. Upon a roll call vote on the motion to have Mr. and Mrs. John Kelly detached from the district, the commissioners unanimously voted "no". i"he motion did not carry. Commissioner Radtke moved that all current requests before the Deputy Commissioners be denied their request to detach from the district. Seconded by Commissioner Weed. Commissioner Knudsen moved to defer action until the next meeting of the commissioners when all of the names of the people who have petitioned to be detached from the district would be submitted. Seconded by Commis- sioner Steinberg. In answer to a question from Commissioner Steinberg as to what amount of assessment is being discussed, Chairman Gottfried advised there is no assessment, however, Commissioner Salentine advised when propert- lies within a lake district there is always a potentia of assessment. even though there is none at this tire. Upon a roll call vote on the motion to defer action until the next meeting of the commissioners when all of the names of the people requesting detachment sould be available, Commissioners Steinberg, '.feted, Van Lanen, Knudsen and Dumke voted "aye". Cortnissioners Radtke and Salentine voted "no". The motion to defer carried. In answer to a question from Commissioner Van Lanen as to the st:,tu.5 of the access on Frig I'lu:,kego Lake Lake, Chairman Gottfried advi:.mod the DNR would like to see an access on Bass Bay and they are ready to spend money for property, appraisals and acquisitions.
