BMLM19950828BIG MUSKEGO LAKE/BASS BAY PROTECTION AND REHABILITATION DISTRICT MINUTES OF ANNUAL I~EETING HELD AUGUST 28, 1995 The meeting was called to order at 7:10 PM by Chairman David De Angells. Also present were Commissioners Misko, Patterson, Rasmussen, Sanders and Suhr, Deputy Commissioners Pilak, Klenrz:, Kreiser, Sorenson and Herda, and City Clerk Marenda. Commissioners D'Acquisto and Salentine were absent. The Clerk reported this meeting ~ias noticed in accordance with the Open Meeting Law. Commissioner Misko moved for approval of the minutes of the previous annual meeting on August 29, 1994. Commlssioner Sanders seconded, motion carrled. Deputy Commissioner Pilak reported on the Priority v~atershed Project. Project started in 1991 to run 8-10 years with a possible expenditure of one mlliion dollars per year. MaIn purpose 1S to eliminate non-point pollution. Projects in process were explained, including stencilling and educat1on, clean up of Trees on the Move property, Freedom Square ponds and W1nd Lake strlp mall. A tour of these different facilities will take place on Saturday, September 16th. - Deputy Commissioner P1lak reported on the Bass Bay Sportsmen's Club Property which was donated to the Lake D1str1ct. The use of th1S property will be a public boat access The property has been surveyed and cleared. The only bid for the concrete boat ramp was rejected due to only one received, and $13,000 was included for de-~iater1ng ~ihich might be avoided if done durinq the dra~\rdmm. Deputy Commissioner P1lak reported on the add1"tional parking for the boat access. An additional parking lot to the south of the slte has been de-vegetated. Tim Kantak objected to parking lot being in his backyard. Pllak stated there was only 11mited space at the ramp site and in order to qualify for state funds addit1onal spaces are required. DNR representative Jim Jackley stated 43 spaces are requlred. P1lak stated the District has been look1ng for property for years. The boat access site was donated and the parking area purchased for $1,000. Gary Stewart felt there was potential for a safety problem w1th people walking along the shoulder of Durham Dr. to get from the parking lot to the access site. Mayor stated extending the shoulder 1S being looked at. Pilak also stated potential for having speed I imi t lm.rered by Safety COmml"ttee. - Sam Klauser stated years ago the DNR approached h1m and after much discussion said they could PU"t a launch on hlS property" There is one there nml with room for 50 cars ~ITithtra1lers. He required several things, a light, outside waste receptacles, a Big Muskego Lake/Bass Bay Protection and Rehabilltatlon District Minutes of Annual Meeting - PAGE 2 -- porta-potty and help to maintain the property. Pilak responded the DNR does require those items but won't pay for them. Your requirement that the ramp be shut down certain times durlng the year is not acceptable to the DNR. Mark Paulet, City Grant Administrator reported on the status of grants. The Lake District is now involved in three Lake Plann~ng Grants, one Lake Protect1on Grant; and, three Boating Facil1ties Grants which are cost-shared 50% DNR and 50% Operation Comeback donation. The boat access site will be maintained by the City's Parks Department" Regarding the Plannlng Grants, the Limno Corral study and the USGS Water Quality monitoring report should be forthcoming. The Lake Protection Grant covers the dlagnostic feasibllity study of the drawdown of B1g Muskego Lake and lts far-reaching effects, and how lakes in the future can better handle the problems the lake has gone through 1n the last 100 years. No Dlstrlct funds are required. The USGS, DNR and Army Corps are involved. Riqht now the Dlstr1ct 1S involved 1n the hydraulic analysis of the drawdown at a cost of $13,200, with a $9,900 DNR grant and $3,300 District share. ~ Keith Jahns, Groveway Lane, questloned hmi much funding is available" Mark paulat reported potentially there is a great deal more money to ask for in these grants. As to the boat ramp, we have to wait for bids to come in, Mr. Jahns asked how much will the whole project cost each property owner? Mr. Pllak responded that at this time we don' t ~IMnt to raise the assessments at all if all the grants come in that we have applied for. Lakefront property will continue at $80 per year, and $35 for back lots Pllak reported the grant for the drawdown proJect was approved at 100% funding for $335,000 when the Governor signed the budget last week. Deputy Commiss ioner Pllak reVle~ied the proposed budget for 1996. Gary Stewart questioned why the expenditure for the drawdown wasn't included. Mayor De Angelis stated the DNR will adminlster the grant and the funds will not be received, nor expenditures made by the District. Mr. Tom Repischak asked if the Big Lake alone is gett~ng the $335,000. DNR Water Resources Supervlsor Sharon Gayan stated that included ~n the 1995-96 budget is $193,100 and in 1996-97 there is $141,900, for a total of $335,000 which has been earmarked totally for the Big Muskego project. It will be admin1stered through the DNR through an integrated resource management plan to complete the drawdown. Collette Klenz moved to approve the budget as submitted. Sue Sorenson seconded. Motion carried by d show of hands, 50 in favor, 3 opposed. - The 1996 quarterly meeting dates were selected: Monday, January 29, 1996; Tuesday, March 26, 1996; Tuesday, June 25, 1996; and, Big Muskego Lake/Bass Bay ProtectIon and Rehabil1tat1on District Minutes of Annual Meeting - PAGE 3 - Monday, October 28, 1996. Monday, August 26, 1996. The annual meeting date will be The 1994 Audit was revie~,'ed. Fund balance was $29,945. Commissioner Pilak reported there has been some interest In the possibility of absentee balloting. There are pros and cons. He sUI~Jges ted the ne~i7ly elected Deputy Commiss ioners research the legal aspects and report back to the membersh1p. Gary Stewart advised at the time the D~strlct was created, the State Statutes call for voting at an annual meetlng and makes no provision for absentee ballots. Pilat thought If By-Laws drawn up there may be abllity to provide for absentee ballots. Regarding the Boat Access and parking, Collette Klenz asked 1f consideration can be given to using the Klauser slte for overflow parklng If approved by the DNR, to avoid havlng the parking on one side of Mr. Kantak's property, and the access slte on the other side. Collette Klenz moved to conslder acquisition of lease for additional parking on Mr. Klauser's property. Seconded by Ed Herda. Mark paulat reported the overflow parking area must be within a reasonable distance of the ramp. If you want the parking area on Mr. Klauser's property, you'd have to prov1de a ramp at that site. Ms. Klenz clarified her mot1on to state that if the Klauser parking site approved, the WEPCO slte would be retaIned but not improved at thIs time. Agreed by second. MotIon carrIed. - D1Scussion on future Lake Management Plan. Mr. Tom Repischak quest1oned a news art1cle where it was reported that the Corps of Engineers was going to dredge and build islands. His research sho~'ed there is no project, and no intention of fundIng such project. Mr. Repischak subm1tted a petitIon which he stated had 77 signatures opposed to a lake drawdown and asking the project be stopped. Mayor De Angelis stated that a previous vote of the members voted in favor of the drawdown, and it is appropriate at an annual meet1ng to accept motIons from the floor Mr. Repischak moved to dispand the idea for a drawdown. Mr. Ian McNutt seconded. Mrs. Bing felt a special meeting should be called to vote on this lssue. Comm1ssioners Patterson and M1Sko felt it was appropr1ate to take the vote at this meeting. Gary Stewart asked 1f a 2/3 maJority vote was necessary to reverse a pr1or motion. Mayor stated Roberts Rules would require a 2/3 major1ty vote to resc1nd, unless someone has a challenge to that interpretation. -- Mr. P1lak asked if the signatures on the petition should be checked. Mayor stated that the petit1on 1S for a certain action. The action that ~vill be taken will be taken by the membership who are present and live in the lake d1strlct. If a vote 15 taken on this issue it will be by ballot vote. Mr. P1lak felt that a vote of this magnitude would be unfair to be taken up at this meetlng since it's not specifically on the agenda. RespondIng to a question on which part of the project should be stopped, Mr. Repischak stated the lake is clearing up, just leave the lake alone - no drawdown. The restocklng lS a different issue. A gentlemen stated Mr. Repischak sald the lake lS clearIng up and the USGS says it's get ting worse. Deputy CommissHmer :Klenz stated the DNR says the quality could be better. Mr. Jim Jackley of the DNR stated he 15 not a water quality expert 50 doesn't know the detalls but has a background knowledge. He stated the vote to drawdmm was approved ln Ma.rch of .1994. The DNR wlll not force the project if the District doesn't want It. Wlth both federal and state budget constraints, if thlS wasn't a good proJect the money wouldn't have been approved. It's not an experlment, it's the right thlng to do. In order to have clean water you have to have vegetation. In order to have wildlife and flSh you have to have vegetation, call them weeds if you wlil. There are two phases to a shallow water lake. It's a turbid ~IITater, algae domlnated system you have now. The only way you can shift it back to a clear water, weed dominated system is to draw it down, get rid of the raw fish and start over. The clarity you may have seen this year could be a lack of ralD and less carp than other years, and a lot of eurasian mllfoll which has stopped some of the wave action, but is one plant we'd like to get rid of with the drawdown to freeze it out to get more of the native plants. Dlana Replschak stated that people have been made a lot of promises about how the lake would be and think now that's not all true. Recently a DNR rep said the plans were to make It an aquatlc lake, a weedy lake. Granted there would be a lot of flSh and ducks. Two years ago the lake was 50 Ii1Teedy people couldn't get through to our slde of the lake with boats. Weed cutters cost $120,000 each and the District people would have to pay for them. Fishing and duck hunting has been gettlng better. We were told the lake would be drained, the alr would hit it, the 511 t ~'TOuld dry up, blow a~iTay and ~iTe' d have a couple feet more. The money has been unofficially committed from Ducks Unlimited for the island construction. Also all staff time, mileage, etc. for the drawdown proJect 15 not being charged agalnst the $335,000 grant - that is for the bricks and mortar of the project. A petition has been brought forward on something beinq discussed and in the \iorks for 2 years. People already settled this. Don't feel it's fair to come ln at 11th hour and say stop everythlng. Have these names on the petltion been verifled? Mayor stated it was just presented thlS eveninq, but lt appears many of the addresses are withln the lake district. Mrs. Bing felt that any vote on the drawdown should be taken at another meetlng because people were not aware thlS vote might be taken again. Mayor said that if you want to bring this Issue back to a special meeting, you would need to move to table to a subsequent meeting. Mrs. Bing moved to Table to a subsequent meetlng to vote on the drawdown. Sue Sorenson seconded. Motion carrled by a show of hands w~th 45 Yes and 31 No. Comm~ssioner Misko expressed 5urpr-ise and felt the vote should have been taken tonlght on the drawdown. - Collette Klenz moved to hold a Special Meeting on Friday, September 8th at 7:00 PM. John Wiederhold seconded the mot~on. Motlon carrled unanlmously. It was noted the postcard notification of the meeting should indicate you must be present to vote. Mayor will clarify prlor to meeting who is ellgible to vote. Mr. Replschak asked that the discussion item on agenda regarding compensation for loss of business be taken up at the Special Meeting.
