BMLM19940829- - - BIG MUSKEGO LAKE/BASS BAY PROTECTION & REHABILITATION DISTRICT ANNUAL MEETING MINUTES - AUGUST 29, 1994 The meeting was called to order at 7:10 PM by Mayor De Angelis. Also present were Commissioners Dumke, Misko, Sanders, Taube, Woodard and D'Acquisto (arr. 8:35 PM), Deputy Commissioners Pilak and Klenz, and City Clerk Marenda. Commissioner Misko múved to approve the minutes of the Big Muskego Lake/Bass Bay Protection & Rehabilitation District Annual meeting held August 30, 1993. Seconded by Commissioner Sanders, motion carried. UNFINISHED BUSINESS Deputy Commissioner Pilak presented an update on the Priority Lakes Watershed Projects in process. He explained that this program is approximately an eight (8) year project with expenditures of approximately $1,000,000. a year addressing nonpoint source pollution run-off that has infiltrated our lakes. Freedom Square existing ponds are in the process of being rejuvenated as a collection source for future run-off of silt and erosion material. "Trees On The Move" is also in a restoration project as far as shoring up the stream banks for less erosion and installation of filtration strips, plantings, etc. There is also a Wind Lake Plaza project that involves a huge parking lot installed next to the lake and they have incorporated a system to contain all the oil run-off and debris so that it does not enter the lake. There are also plans for tours for the City Officials and interested parties of these projects and future projects. A lot of time and effort is put into preparation of the tours with hiring of buses, food, invitations, etc. Posters are being distributed at all establishments where motor oil can be purchased explaining where the oil can be disposed of for recycling. Education is the key to prevention. Deputy Commissioner Pilak displayed a large document which is a summary of the Wisconsin Department of Natural Resources which entails what they think should be done such as contour parking, terraces, grassing waterways, pesticide run-off control, etc. Mayor De Angelis advised that the City took ownership of the dam on August 12, 1994. Mayor also reported on the status of the Bass Bay Sportsmen's Club Property. The Bass Bay Sportsmen's Club, along with "Operation Comeback", donated $37,000.00 to the District about three and one-half months ago primarily for the use of development of the Bass Bay Sportsmen's Club property a lake access site. The City now owns the Bass Bay Sportsmen's Club property; we took title sometime in June of 1994. We have a facility plan that has been worked on by the DNR to help us outline and design that particular boat launch. That plan will be going to the DNR soon as part of the review for the Waterway ~ ~ ~ Big Muskego Lake/Bass Bay Protection & Rehabilitation District Annual Meeting of August 29, 1994 - Page 2 Grant and we are hoping to have it in place possibly this Fall or definitely next Spring, with the channel dredging being done at the time of the drawdown. We will have the launch in prior to the channel being dredged to at least allow access for flat bottom canoes. DNR representative Jim Jackley discussed future lake management plans and funding available from the State and EPA and presented a graph that outlines the projects and the components. The main thing being worked on right now is funding from several sources. The first and major source is with the State. A submittal has been made of a biennial project proposal for over $400,000.00 which has gone through the Department and is now at the Natural Resources Board which is appointed by the Governor. They have to approve everything that the Department does. It will go to them on September 29, 1994. It has gone through many hurdles and after the Resources Board approves it, it goes into the Governor's Budget (which is a year process). The other source is EPA funding which is on hold right now; all applications have been submitted but no assurances because of funding cuts. There are other non-point funding sources that can be applied for such as protection grant monies, etc. The next step, after funding, is the actual planning. Right now an environmental assessment is being drafted that will be approximately 60 or 70 pages which will entail a public 30 day review; probably in February or March, which includes the details of the drawdown. The next step will then be the hydraulic analysis. The lakes drain into Wind Lake and because of the narrow channel connecting them, there has to be an analysis. Wind Lake will have to draw down one foot in order to draw down Big Muskego Lake. After funding is secured and an environmental assessment has been approved, there will be meetings and handouts available to educate landowners on ripraping, shoreline enhancements, piers, channel dredgings, etc. The next step will be the project; the drawdown, carp eradication, restocking, etc., and then the long term management commitment which will include stocking. Commissioner Taube questioned whether or not the anticipated drawdown of Little Muskego Lake could be coordinated with the drawdown of Big Muskego Lake? Mr. Jackley advised that it would not be possible because of the approval steps involved. NEW BUSINESS Deputy Commissioner Klenz reviewed the boundary map and noted there are errors in the list of properties included within the boundary. She stated the Deputies recommended not to back-bill those who had been excluded and not to give refunds to those charged in error. Commissioner Taube moved to approve the inclusion and exclusion of properties as reviewed by Ms. Klenz. Commissioner Dumke seconded. Commissioner Sanders moved to amend the motion to add there would be no refunds and no back-billing. Commissioner Taube seconded, motion to amend carried. Motion as amended carried. Big Muskego Lake/Bass Bay Protection & Rehabilitation District Annual Meeting of August 29, 1994 - Page 3 .,-. Deputy Commissioner Klenz reported on the two-tier system for charging on-lake and off-lake properties which is proposed at $80.00 for on-lake and $35.00 for off-lake. Paper ballots were distributed for a vote on the two-tier system. The Clerk tallied the results, with 19 "Yes", 3 "No", and 2 "blank". Mayor De Angelis announced that the two-tier system will go into effect. Deputy Commissioner Pilak spoke about the acquisition of WEPCO property for additional parking for the boat access site. The Deputy Commissioners have been in contact with Waukesha County, who own property near this site, and Wisconsin Electric Power Company who own approximately an acre near the site to discuss future acquisition as there is a need for additional parking in order to meet funding requirements. WEPCO has been contacted and informed that there is an interest in purchasing the property. Deputy Commissioner Pilak advised that they would like approval to spend up to $1,000. to acquire the WEPCO property. Commissioner Taube moved to acquire property at a cost not to exceed $1,000. Commissioner Sanders seconded, motion carried. - Proposed dredging projects were discussed with information presented by Deputy Commissioner Klenz and Dan Hussel of the DNR. The three main dredging areas would be the channel coming off of Woods Road & Lannon Drive, the channel at Bass Bay (Sandy Beach); these being the two main pollutants to the lake), and the public access off of Durham Drive. A lengthy decision process by the Deputy Commissioners have determined that the District will not be involved in dredging projects for individual properties, but will assist all in securing the required information on how to proceed. Mr. Hussel explained some of the requirements as far as setbacks, etc. for the dredging. There will be meetings held with DNR representatives in the evenings or Saturdays to help individual property owners prepare their applications for shoreline improvements. Mr. Larry Schweitzer questioned the status of the sewer service for the southeast portion of the City. Mayor De Angelis advised that at the present time the City has submitted a request to MMSD for approval of our facility plan for the Boxhorn/Ryan/Groveway area and for the Country Club property and we have run into some resistance in plan approval and are hoping that within the next couple of months that they will approve our engineering drawings so that we can move ahead with securing bids and starting construction. Debbie Verburgt moved to cast an unanimous ballot for the five candidates nominated. Seconded by Craig Lawdanski, motion carried. Deputy Commissioner Pilak presented the proposed 1995 Budget. Debbie Verburgt moved to adopt the budget. Seconded by Deputy Commissioner Klenz, motion carried. It was noted the budget would be corrected to reflect the corrections to the list of properties in the boundary, showing 170 on-lake properties and 185 off-lake properties.
